Rumor is the oldest medium of communication. Before the advent of writing, oral communication was the only channel for social interaction. "Rumors convey messages, build or destroy reputations, and trigger riots or wars." (Kapferer, 1991:5) The first systematic study of rumors in modern times emerged in the United States during World War II, initially focusing on the negative impact of the proliferation of rumors on military morale during the war. Whether it was the government, media, or opinion leaders of civilian institutions, all regarded rumors as a potential source of morale corrosion and even destruction, and the idea of rumor control was subsequently put on the agenda.

The representative figures of the rumor control theory are Robert Knapp, Gordon Allport, and Leo Postman. Based on his work with the Massachusetts Committee on Public Safety during World War II, Knapp analyzed over a thousand rumors that were prevalent during the war, concluding that rumors are a result of social disorder (with war being an expression of disorder) and a projection of social attitudes and motivations. He identified that rumors mainly reflect people's hostile and divisive impulses, which are difficult to vent through other means.

Since rumors are so disturbing, their widespread dissemination must be stopped. Knapp proposed five "suggestions," including: the public should have unconditional trust in all official communication media, the public should have absolute faith in their leaders, and work and leisure should be effectively organized, among others (Knapp, 1944: 22-37). These suggestions allow us to infer the grim situation in the United States during World War II: people lacked trust in official communication media, had no confidence in their leaders, the government was secretive about specific events, the public was bewildered and ignorant, and many were unemployed with nothing to do to pass the time. If, in the context of a great war, a nation could be fully mobilized to implement these suggestions, then, as Kapferer pointed out, "it would be like describing a totalitarian state" (Kapferer, 1991:10).

Benefiting from Knapp's empirical analysis, American social psychologists Allport and Postman conducted a specialized study on the issue of rumors during World War II. Their co-authored book "The Psychology of Rumor" is considered the first scientific explanation of the origin and spread of rumors (Allport & Postman, 1947). In their research, they focused on the psychological processes of individual rumor spreaders. They gave a test subject a picture and allowed time for careful observation. Then the subject was asked to describe the scene to a second test subject. The second person then relayed what they heard to a third person, and so on. By the time it reached the fifth or sixth person, 70% of the information was lost, and the final description was vastly different from the original picture.

This actually views the oral transmission of information as a linear, mundane, and predetermined process, where multiple accumulations inevitably lead to distortion. However, this demonstration is not without problems: does the simulated experiment of whispering to each other completely match the operation of rumors in a natural environment? How should we explain those rumors that are eventually proven to be true? If the final distortion is inevitable, how can rumors in some cases preserve accurate information intact?

Unlike Knapp, Allport and Postman viewed rumors as a more everyday behavior, occurring both in wartime and peacetime. However, it is noteworthy that, like Knapp, all the examples they cited involved rumors in crisis situations. Kapferer found that the examples these researchers cited were biased. "They only elaborated on those baseless rumors, and their definition of rumors did not consider any truthfulness in the information conveyed by the rumors. ... They remained silent about the results of later verification of the rumors." (Kapferer: 1991: 7) This involves the issue of the definition of rumors.

The definition of rumors has always been a matter of debate. A scholar's literature review in 1998 showed that psychology, sociology, and communication studies each have different definitions of rumors (Pendleton, 1998: 69-86). Therefore, in social sciences, rumors are a concept lacking a specific definition.

尽管各执一词,谣言研究者们还是对作为传播媒介的谣言存有某些共同的认识。从上世纪40年代迄今,一些代表性的定义可以总结如下:
Despite differing opinions, rumor researchers still have some common understanding of rumors as a medium of communication. Since the 1940s, some representative definitions can be summarized as follows:

According to these definitions, rumors have their own structure and logic, and the definers all attempt to explain these structures and logic. Most of them acknowledge that a rumor is a piece of information or proposition that adds new elements to someone, something, or some condition related to reality. Secondly, rumors are orally transmitted and unverified. Furthermore, many definitions suggest that rumors are intended to make people believe. These definitions outline the characteristics of rumors for us, such as their mode of transmission (oral), the content they spread (rumors are about current events, which to some extent distinguishes them from trivial, personal topics, thus categorizing rumors into the public domain), and the purpose of their spread (to make people believe). However, on some key issues—such as the nature of the information conveyed by rumors and why rumors continue to circulate—researchers have differing opinions.

The most widely accepted definition of rumors considers them as propositions with unclear origins, whose authenticity is highly questionable, and the information conveyed cannot be quickly or ever verified. This definition aligns with common-sense views and often leads to a simplified formula: rumor = false information. For example, Chinese scholar Zhou Xiaohong distinguishes between gossip and rumors as follows: although both are unfounded and inaccurate information, strictly speaking, gossip is unintentionally misreported, while rumors are intentionally fabricated (Zhou Xiaohong, 1998: 427).

如此定义谣言会导致两个窘境:其一,对那些起因于某个事实,在传播过程中被一群心存疑虑的人像滚雪球一般不断“兑水”和夸大的谣言,又该如何解释呢?其二,如果把谣言等同于不实之词,那么它就必然留下这样一种印象:谣言是病态社会的反映,是某种程度上的集体精神病。莫兰分析谣言时就使用了不少医学名词,如病菌、病理学、传染病灶、潜伏期、转移期等等,甚至把谣言直接称为“心理癌症”(Morin,1971)。
Defining rumors in this way leads to two dilemmas: First, how should we explain those rumors that originate from a certain fact but are continuously "watered down" and exaggerated like a snowball by a group of skeptical people during the dissemination process? Second, if we equate rumors with falsehoods, it inevitably leaves the impression that rumors are a reflection of a pathological society, a kind of collective mental illness to some extent. Moran used many medical terms when analyzing rumors, such as bacteria, pathology, infectious foci, incubation period, transfer period, etc., and even directly referred to rumors as "psychological cancer" (Morin, 1971).

Insisting that rumors have no basis is equivalent to declaring that those who believe and spread rumors are irrational and abnormal, and the explanation of rumors can only belong to psychiatry, or to the tradition of despising emotional group behavior pioneered by Le Bon (Le Bon, 1982). This perception has a huge market in China. For example, casually reading current comments on rumors, it is not difficult to find statements such as:

“谣言其实如同病菌一样,只有在阴暗潮湿的地方才能孳生。”[i]
"Rumors are actually like bacteria, they can only breed in dark and damp places." [i]

“如今,通讯和网络的自由度让一些不负责任的话语、别有用心的言论都可能轻易传递,如瘟疫般迅速蔓延,最后成为洪水猛兽,直至淹没了事实的真相。”[ii]
"Nowadays, the freedom of communication and the internet allows some irresponsible words and malicious remarks to be easily transmitted, spreading rapidly like a plague, eventually becoming a monstrous flood that drowns the truth." [ii]

"In such a vortex of rumor generation, people's mentalities vary, information is bizarre, rumors are rampant, and the truth is silently grieving. In such a paradox, society increasingly exhibits a pathological sensitivity to rumors." [iii]

谣言未必全是虚假的,有大量谣言在后来被证明并不是失实的。事实上,谣言之所以有人相信,正因为谣言经常最终被发现是“真实的”。因而,如果单纯用“虚假”来概括谣言,显然有失偏颇。有学者用“未经证实”来修饰谣言。然而,这个“未经证实”其实也是经不起推敲的。首先,在日常生活中,我们很少去证实一下我们从他人处得到的信息。其次,证实的概念与假定进行证实的人是不可分的。人们常常根据向他们提供消息的人的信任程度,而不是原始消息来源的可靠程度,来判定一个谣传的可信度。在谣言的传播中,一个常见的有趣现象是,我们总是由朋友、同事或亲戚那里听到某个事件的发生,而他们往往并非他们所叙述事件的直接见证人,他们的朋友才是目击者。[iv]尽管这个见证的链条并非直接通到我们这里,但由于有目击者的存在,有朋友等对消息的背书,我们就会相信消息的证明。另一方面,如果我们对证实者心存疑虑,那么我们就会对被此人证实了的消息产生怀疑。证实的标准中包含着很大的主观性。
Rumors are not necessarily all false; many rumors have later been proven to be true. In fact, the reason why some people believe in rumors is precisely because rumors are often eventually found to be "true." Therefore, it is clearly biased to simply summarize rumors as "false." Some scholars use "unverified" to describe rumors. However, this "unverified" is also not without flaws. Firstly, in daily life, we rarely verify the information we receive from others. Secondly, the concept of verification is inseparable from the person conducting the verification. People often judge the credibility of a rumor based on the trustworthiness of the person providing the information, rather than the reliability of the original source. A common and interesting phenomenon in the spread of rumors is that we always hear about an event from friends, colleagues, or relatives, who are often not the direct witnesses of the events they describe; their friends are the eyewitnesses. [iv] Although this chain of witnesses does not directly reach us, the existence of eyewitnesses and the endorsement of friends make us believe in the information. On the other hand, if we have doubts about the verifier, we will also doubt the information verified by that person. The standards of verification contain a great deal of subjectivity.

From this perspective, defining rumors based on "unverified" or especially "false" information is highly problematic, "reflecting a bias against rumors and a desire to encourage good behavior." (Kapferer, 1991:11) Pushing this bias to the extreme, as mentioned above, views rumors as a social disease.

谣言作为一种社会认知和集体行动 Rumors as a form of social cognition and collective action

Shibuya Tamotsu's definition is quite different from the dominant understanding of rumors before him. According to his observations, rumors are not abnormal acts but a form of social behavior that attempts to define those ambiguous yet crucial situations in daily life. Shibuya Tamotsu's work implicitly criticizes the contemporary misconceptions about rumors: that rumors are highly directional, irrational, and dangerous; that rumors are inaccurate, distorted, and exaggerated; and that rumors threaten social order. He disagrees with the psychological analysis of rumors that personalizes rumor behavior, which was very popular in rumor research in the 1940s and 1950s. For example, Floyd Allport and Milton Lepkin's study on wartime rationing rumors in the United States concluded that "the more information a person has, the more meticulous their thinking will be, and the less likely they are to be led to believe their often unknown inner impulses." (Allport & Lepkin, 1945: 3-36) Similarly, a 1942 study on the spread and acceptance of wartime rumors calculated a "rumor belief index," indicating that both the spread and acceptance rates were higher among the poor than the rich, higher among those over 45 than the young, and higher among Jews than non-Jews (because Jews are more likely to feel uneasy about fear-inducing rumors) (Allport and Postman, 2003: 5-6).

The early pioneers of rumor research, whether Knapp, Allport, or Postman, assumed that although there are conditions that encourage the existence of rumors at the group level, the actual operation of rumors depends on individual subjective biases and rumor behavior. This research paradigm is based on a series of experiments by William Stern and Frederic Bartlett. Stern used image tests and authenticity experiments to identify factors that influence observers' descriptions. [v] Bartlett used a method where a series of test subjects repeated information in sequence, discovering that people tend to give meaning to originally meaningless or ambiguous things. Thus, memory becomes a form of creation rather than merely a reproduction of consciousness (Allport and Postman, 2003: 31, 33-36).

Stern and Bartlett's ideas were extended by Allport and Postman. They revealed the motivations and methods by which individuals accept and spread rumors, emphasizing that projection (the externalization of personal thoughts, desires, etc.) is an important psychological mechanism that makes individuals believe and spread rumors. They also studied the changes in the content of rumors during the dissemination process and their mechanisms, such as leveling and sharpening, assimilation, inference, and distortion. Most researchers who followed them often adhered to the same path, linking the transformation of rumor materials with individuals' statistical and cognitive characteristics. However, Shibutani argued that attributing the prevalence of rumors to the control of inner impulses and educational deficits of individuals makes it difficult to explain the vitality of rumors and why they often transcend personal boundaries to become a "public" informal medium.

During World War II, many Japanese Americans were interned in camps in California. Through the study of rumors circulating in the camps, Shibutani advocated that rumors are a tool form for social groups to solve problems and are a necessary part of the social process, allowing people to face various uncertainties in life. Therefore, rumors are a form of "collective transaction" that produces "improvised news," which is "the result of the wisdom of a group of people seeking a satisfactory answer to an event." Thus, rumors are both a process of information dissemination and a process of interpretation and commentary. The evolution of rumor content is not due to memory distortion but largely stems from the evolution and reinforcement of interpretation and commentary throughout the dissemination process.

This is a powerful correction to the research path of Allport and Postman. Shibutani refused to acknowledge any proposition that views rumors as unverified, unreliable, or false. He regarded the rumor process as a normal part of social life rather than a pathological one, thus legitimizing rumors. He envisioned rumors as a form of collective action aimed at finding an answer to inexplicable events. This process is cooperative and, to some extent, functional. In this regard, Peterson and Gist's views are similar to Shibutani's. They saw not "leveling" and "sharpening" in the transmission of rumors but the "snowballing" effect or creative cooperation, that is, finding comforting factors and details in rumors and embellishing these details (Peterson & Gist, 1951: 159-167). Shibutani emphasized that rumors are always in a state of "continuous construction," and the changes in rumor content are not merely distortions of information but part of the process of reaching consensus (Shibutani, 1966: 9, 16). Thus, Shibutani viewed rumors more as a form of rational action rather than, as Allport and Postman said, "one of the less rational forms of social activity" (Allport and Postman, 2003: 26), an expression or projection of emotions.

既然谣言被视为那些缺乏足够信息的人寻求解决问题的一种努力,那么,一个谣言的公式也就呼之欲出了:
Since rumors are seen as an effort by those lacking sufficient information to seek solutions to problems, a formula for a rumor emerges:

谣言=(问题的)重要性×(事实的)模糊性 Rumor = (importance of the issue) × (ambiguity of the fact)

这个谣言公式来自于奥尔波特与波斯特曼,在后来被广泛接受,也为涩谷保所承认。该公式是一个乘法关系而不是加法关系,即是说,假如谣言对个人生活的重要性为零,或者事件本身并非含糊不清,谣言就不会产生了(奥尔波特和波斯特曼,2003:17)。谣言的出现是因为同时满足了重要性和含糊性这两个条件,而它的传播的持久性也与这两个变量相关。
This rumor formula comes from Allport and Postman, and it was later widely accepted and recognized by Shibuya. The formula is a multiplicative relationship rather than an additive one, meaning that if the importance of the rumor to personal life is zero, or if the event itself is not ambiguous, the rumor will not arise (Allport and Postman, 2003: 17). The emergence of rumors is due to the simultaneous satisfaction of both importance and ambiguity, and the persistence of its spread is also related to these two variables.

然而,倘若我们仔细地分析,除了重要性和含糊性,至少还有两个条件构成谣言的前提。其一是,一群人需要行动但却迟疑不决,期待身边的形势得到充分的界定;其二是,形势要求在一些基本的层面上群体成员必须共同行动而不是个人单打独斗。
However, if we analyze carefully, in addition to importance and ambiguity, at least two other conditions constitute the premise of rumors. First, a group of people needs to act but hesitates, waiting for the situation around them to be fully defined. Second, the situation requires group members to act together on some basic levels rather than individually.

在三种情形下,上述四个条件会同时具备,从而为谣言提供丰厚的土壤。首先,如果在一种社会秩序中,信息被当局严密控制,谣言就会非常激烈。假使对新闻的控制是一个持续而非暂时的行为,谣言就会变得定期化,成为日常生活的一个基本的组成部分。
In three situations, the above four conditions will be met simultaneously, providing fertile ground for rumors. First, if in a social order, information is tightly controlled by the authorities, rumors will be very intense. If the control of news is a continuous rather than a temporary behavior, rumors will become regular and a basic part of daily life.

其次,当发生的事件威胁了正常生活的理解基础的时候,谣言会不胫而走。一个大的灾难或丑闻都会引发这类挑战。同样地,在一个社会中,潜在的冲突对象或互相竞争的群体之间原有的适应和妥协如果被打破,惯常的行为模式也会受到影响。
Secondly, when an event threatens the fundamental understanding of normal life, rumors will spread rapidly. A major disaster or scandal can trigger such challenges. Similarly, in a society, if the original adaptation and compromise between potential conflicting parties or competing groups are broken, the usual behavior patterns will also be affected.

第三,假如对一个有力的共同行动的推动受到阻遏,谣言也会生发出来。
Thirdly, if the push for a powerful collective action is obstructed, rumors will also arise.

从第一种情形来看,涩谷保指出,当对新闻的需求大于制度性渠道的信息供应的时候,谣言就会大量繁殖。“为了明智地行动,人们对新闻加以寻求,而谣言基本上就是一种新闻。”(Shibutani, 1966:17)把谣言与新闻并列,涩谷保为我们开启了一扇理解谣言的新窗口。它显示了,报纸和广播中的新闻也不一定是客观的和真实的,而是携带了很多价值观主导的意见和假设。在中央极权的社会,制度性的渠道控制了信息的散播,人们普遍寻求通过辅助渠道获取信息,有时会逾越官方主张的特权。这样,无论从谣言的意图还是从其结果来看,谣言都可能具有颠覆性。
From the first scenario, Shibutani points out that when the demand for news exceeds the supply of information through institutional channels, rumors will proliferate. "To act wisely, people seek news, and rumors are essentially a form of news." (Shibutani, 1966:17) By juxtaposing rumors with news, Shibutani opens a new window for us to understand rumors. It shows that news in newspapers and broadcasts is not necessarily objective and true, but carries many value-driven opinions and assumptions. In a centrally authoritarian society, institutional channels control the dissemination of information, and people generally seek information through auxiliary channels, sometimes bypassing the privileges advocated by the authorities. Thus, whether in terms of the intention or the result of rumors, they can be subversive.

卡普费雷对谣言的研究起始于涩谷保的观察,两人同样认定,谣言并非是某种“真实”的偏离,而是一种人们达成何为“真实”的一致意见的努力。涩谷保写道,谣言语境的存在,是在“对新闻的需求与集体亢奋的激烈度呈正向相关”的时候,此时谣言会大肆扩张来满足新闻无法满足的需求(Shibutani, 1966:17)。卡普费雷直截了当地指出:“谣言不是从真相中起飞的,而是要出发去寻求真相。”[1]这种寻求发生在权威的或官方的渠道之外,毋需对消息的正式证实,因而谣言很容易离经叛道。人们一般向当局或是媒介吁请真相,把证实的责任交付给它们,但谣言却打击了这一过程。这就是政府当局为何常常会控制或否认谣言,因为他们担心谣言会引发公众的动荡、恐慌或是不满。
Kapferer's research on rumors began with Shibutani's observations. Both agree that rumors are not a deviation from some "truth," but an effort to reach a consensus on what is "true." Shibutani wrote that the existence of a rumor context is when "the demand for news is positively correlated with the intensity of collective excitement," at which point rumors will expand wildly to meet the unmet demand for news (Shibutani, 1966:17). Kapferer straightforwardly pointed out: "Rumors do not take off from the truth, but set out to seek the truth." This search occurs outside authoritative or official channels, without the need for formal verification of the information, making rumors easily deviant. People generally appeal to authorities or the media for the truth, entrusting them with the responsibility of verification, but rumors undermine this process. This is why government authorities often control or deny rumors, fearing that they will cause public unrest, panic, or dissatisfaction.

再来看第二种情形。谣言活跃于特定的情景中,反过来又为该情景注入动力。这些情景往往与不确定、紧张和危机有关。猜忌、恐惧、仇恨、痛苦会因当下的冲突而进入集体讨论,并塑造和改变冲突本身。在这种情形下,“谣言和闲话是搜集他人信息的重要工具,从中发展出一种公议,这种公议是关于谁应为死亡、疾病、不幸、偷窃、‘不正常’的天气承担责任。这种过程是渐进的,直到它们通过某种事件和人们的解释催化之后显现出来。”(斯特拉森和斯图瓦德,2005:97-98)
Now let's look at the second scenario. Rumors are active in specific contexts and, in turn, inject momentum into those contexts. These contexts are often associated with uncertainty, tension, and crisis. Suspicion, fear, hatred, and pain enter collective discussions due to current conflicts and shape and change the conflicts themselves. In this scenario, "rumors and gossip are important tools for gathering information about others, from which a public opinion develops about who should be responsible for death, disease, misfortune, theft, and 'abnormal' weather. This process is gradual until it is catalyzed by some event and people's interpretations." (Strathern and Stewart, 2005: 97-98)

此一过程中,谣言导致了人们交流中的不确定性,并与产生误解和冲突的可能性交织在一起。谣言在这些情景中试图让步于社会条件,或与社会条件协商。在极端情况下,谣言会产生社会和政治暴力,例如,用言说将人定位于特定的社会价值体系中,给某些人或某些群体贴标签,对被贴上标签的行为进行道德评判,寻找特定的替罪羊,甚而形成一种争取公众支持并用暴力惩罚肇事者的机制。“通过谣言,就像通过其他社会交流方式一样,冲突与延续共存,加强了生命中持续的斗争原则。”(斯特拉森和斯图瓦德,2005:102)
In this process, rumors lead to uncertainty in people's communication and intertwine with the possibility of misunderstandings and conflicts. Rumors in these contexts attempt to yield to or negotiate with social conditions. In extreme cases, rumors can lead to social and political violence, such as using speech to position people within specific social value systems, labeling certain individuals or groups, morally judging the behavior of those labeled, finding specific scapegoats, and even forming a mechanism to garner public support and punish perpetrators with violence. "Through rumors, as through other forms of social communication, conflict and continuity coexist, reinforcing the principle of ongoing struggle in life." (Strathern and Stewart, 2005: 102)

以上可以一般地解释谣言为什么会在动荡时期泛滥成灾——混乱产生谣言,谣言导致更大的混乱,差不多构成了一个“社会心理学的规律”,用奥尔波特和波斯特曼的话来说就是:“从未有一场骚乱的发生不带有谣言的鼓动、伴随和对暴力程度的激化。”(Allport & Postman, 1947:193)例如,在法国大革命中,中外研究者都指出谣言与革命相伴相生的状况,[2]而对中国的辛亥革命,甚至有学者极而言之地称“武昌起义,在某种程度上就是被谣言激发的一场兵变”。[3]
The above can generally explain why rumors spread like wildfire during turbulent times—chaos generates rumors, rumors lead to greater chaos, almost forming a "law of social psychology." In the words of Allport and Postman: "There has never been a riot that did not involve the incitement, accompaniment, and intensification of violence by rumors." (Allport & Postman, 1947:193) For example, during the French Revolution, both domestic and foreign researchers pointed out the coexistence of rumors and revolution. [2] As for China's Xinhai Revolution, some scholars even go so far as to say that "the Wuchang Uprising was, to some extent, a mutiny triggered by rumors." [3]

这些分析很容易把非理性因素同大革命的群众现象关联起来,即认为情绪、感情、信仰等非理性因素在很大程度上支配了人们的政治行为,这不仅使大革命的进程扑朔迷离、一波三折,也为谣言赋予一种独特的活力。然而,革命和骚乱只是社会运动的一种形式,除了大众的非理性造成局势失控的情形,还有一种社会运动是理性人的联合行动。这些行动有一定的策略,因为行动者缺少财力和权力,不得不调动另类的资源以对政治和分配进程产生影响。这些另类资源包括如下的集体行动:罢工,静坐,占领,示威,怠工,阻塞交通等。
These analyses easily associate irrational factors with the mass phenomena of great revolutions, suggesting that emotions, feelings, beliefs, and other irrational factors largely governed people's political behavior. This not only made the process of great revolutions unpredictable and full of twists and turns but also endowed rumors with a unique vitality. However, revolution and unrest are just one form of social movement. Besides the situation where the irrationality of the masses causes the situation to spiral out of control, there is another type of social movement that involves the collective action of rational individuals. These actions have certain strategies because the actors lack financial resources and power and have to mobilize alternative resources to influence political and distribution processes. These alternative resources include collective actions such as strikes, sit-ins, occupations, demonstrations, slowdowns, and traffic blockades.

由此进入第三种情形。詹姆斯·斯科特在观察抵抗的政治时敏锐地意识到,在沉寂不动和激烈反抗之间还存在着一个广大的中间区域,在这个区域中,“事物的限度常常被测试……上次事端的尘埃尚未散去,尝试收复失地的探寻可能就又开始了”(Scott, 1990: 197)。谣言正是中间地带的抵抗中一种有力的手段,谣言武器在现代反抗者手中不像过往的革命者使用得那样强悍,但它又比斯科特曾经观察到的作为“弱者的武器”而发挥的功能更为强大(Scott, 1985)。
This leads to the third scenario. James Scott, in his observation of the politics of resistance, keenly realized that there is a vast middle ground between quiescence and fierce resistance. In this area, "the limits of things are often tested... the dust of the last incident has not yet settled, and the search to regain lost ground may begin again" (Scott, 1990: 197). Rumors are a powerful tool in this middle ground of resistance. The weapon of rumors in the hands of modern resisters is not as formidable as it was for past revolutionaries, but it is more powerful than the function it played as a "weapon of the weak" observed by Scott (Scott, 1985).

了解了谣言作为一种社会抗议的功用,我们才能深切地明白,何以卡普费雷对谣言的定义特别强调“官方的公开证实”或“官方的辟谣”。这是因为,
Understanding the function of rumors as a form of social protest allows us to deeply comprehend why Kapferer particularly emphasizes "official public confirmation" or "official refutation" in his definition of rumors. This is because,

“谣言既是社会现象,也是政治现象。……‘官方’来源的概念就是政治性的,它取决于一种共识,这种共识阐明了谁拥有法律上的发言权,即便其缺乏道德上的发言权。谣言是与当局的一种关系:它揭露秘密,提出假设,迫使当局开口说话,同时,又对当局作为唯一权威性消息来源的地位提出异议。谣言在无人邀请的情况下自发地争夺发言的权力。它经常是反对派的发言:官方的辟谣并不能说服它,因为它感觉官方与可靠性并不是相辅而行的。谣言令我们质疑当局,对‘谁有权对什么事发言’提出质疑。谣言提供的信息与官方信息有时是相左的,所以,谣言构成了一种反权力,即对权力的某种制衡。”(Kapferer, 1990: 14)
"Rumors are both social and political phenomena. ... The concept of 'official' sources is political; it depends on a consensus that clarifies who has the legal right to speak, even if they lack moral authority. Rumors are a relationship with the authorities: they expose secrets, propose hypotheses, force the authorities to speak, and at the same time, challenge the status of the authorities as the sole authoritative source of information. Rumors spontaneously compete for the right to speak without invitation. They are often the voice of the opposition: official refutations cannot convince them because they feel that officialdom and reliability do not go hand in hand. Rumors make us question the authorities and challenge 'who has the right to speak about what.' The information provided by rumors sometimes contradicts official information, thus constituting a form of counter-power, a certain check on power." (Kapferer, 1990: 14)

作为“反权力”的谣言,反抗的是经济上的剥削,政治上的压迫,以及社会关系上的不平等。
As a "counter-power" rumor, it resists economic exploitation, political oppression, and social inequality.

被“妖魔化”的谣言 The "demonized" rumor

从以上所述我们可以看到,需要对谣言的定义的细微之处加以仔细的辨别,方能全面认识谣言这一人类社会挥之不去的现象。但在中国的语境中,谣言却几乎一边倒地被视为没有事实根据的惑众之言,听信谣言者是受“蒙蔽”的、“不明真相”的群众,而谣言的初始传播者常常被指为“别有用心的一小撮”。官方一向视谣言为不稳定因素而大加制止和弹压,在很多时候,公民因为传谣信谣而而遭受训话、监视甚至拘捕。
From the above, we can see that it is necessary to carefully distinguish the nuances of the definition of rumors in order to fully understand this persistent phenomenon in human society. However, in the Chinese context, rumors are almost universally regarded as baseless and misleading statements, with those who believe in them seen as "deceived" and "uninformed" masses, and the initial spreaders of rumors often accused of being a "small group with ulterior motives." The authorities have always viewed rumors as destabilizing factors and have vigorously suppressed them. In many cases, citizens have been reprimanded, monitored, or even arrested for spreading or believing in rumors.

不能不说,在谣言问题上学术视野的逼仄是造成和助长这种局面的原因之一。周裕琼统计说,中国内地从上世纪八十年代开始发表的近百篇相关论文,无不对谣言持否定态度(周裕琼,2008)。同一时间出版的传播学与舆论学著作,其中涉及谣言的内容也对其多给予负面的评价,甚至认为谣言就是谎言。例如,刘建明认为谎言是没有事实根据的假话,谣言也是缺乏事实根据的虚假消息,谣言和谎言都是虚的,它们的共同特点是都把假的说成真的,以假充真,以假乱真,以欺骗他人(刘建明,2001)。郭庆光认为流言是一种信源不明、无法得到确认的消息或言论,有自发产生的,有人为制造的,但大多与一定的事实背景相联系;而谣言则是有意凭空捏造的消息或信息(郭庆光,1999:99)。
It must be said that the narrow academic perspective on the issue of rumors is one of the reasons for and contributors to this situation. Zhou Yuqiong's statistics show that nearly a hundred related papers published in mainland China since the 1980s all hold a negative attitude towards rumors (Zhou Yuqiong, 2008). Communication and public opinion books published during the same period also mostly give negative evaluations of rumors, even equating them with lies. For example, Liu Jianming believes that lies are false statements without factual basis, and rumors are also false information lacking factual basis. Both rumors and lies are false, and their common characteristic is that they present falsehoods as truths, deceive others by mixing falsehood with truth (Liu Jianming, 2001). Guo Qingguang believes that rumors are information or statements with unclear sources that cannot be verified, some of which arise spontaneously, while others are deliberately fabricated, but most are related to certain factual backgrounds; whereas rumors are intentionally fabricated information or messages (Guo Qingguang, 1999:99).

姑且不论对流言与谎言的这种区别是否准确,我们看到,郭庆光在国内流传最广的传播学教材之一当中在给谣言下定义的时候,引入了一个更加富有争议的参数,即“动机”因素。除了传播学,谣言研究亦是社会心理学的基本内容之一,邓文初曾以两部影响极大的教科书为例,指出国内学者始终强调“动机”(特定意图)与“真实”(缺乏事实根据)两个因素。
Regardless of whether this distinction between rumors and lies is accurate, we see that Guo Qingguang, in one of the most widely circulated communication textbooks in China, introduces a more controversial parameter when defining rumors, namely the "motivation" factor. Besides communication studies, rumor research is also a fundamental aspect of social psychology. Deng Wenchu once used two highly influential textbooks as examples to point out that domestic scholars consistently emphasize two factors: "motivation" (specific intent) and "truth" (lack of factual basis).

It defines rumors as follows: "Rumors are information disseminated by certain individuals, groups, organizations, or countries based on specific motives and intentions. It defines rumors as follows: "Depending on the motives of the rumor creators, rumors can be subdivided into gossip and rumors. The former is largely unconscious dissemination, while the latter is deliberately fabricated, generally with malicious intent, aimed at creating trouble." (Zhou Xiaohong, 2008: 236)

在这里,“动机”二字都直接进入了谣言的定义中,周的定义甚至还突出了“恶意”的目的。邓文初指出:“在这种溢出学术界之外的‘研究’中,以‘真实性’为标准,‘谣言’成了‘没有任何事实根据’的消息。依据‘动机’标准,谣言就不仅仅是‘有意捏造’而且成了‘毁谤中伤’。谣言定定义过程中的情感色彩进一步强化,学术的中性完全丧失,‘谣言’被完全‘妖魔化’了。”[1]
Here, the word "motive" directly enters the definition of rumors, and Zhou's definition even highlights the purpose of "malice." Deng Wenchu pointed out: "In this kind of 'research' that spills over beyond academia, using 'truthfulness' as the standard, 'rumors' become information with 'no factual basis.' Based on the 'motive' standard, rumors are not only 'deliberately fabricated' but also become 'slander and defamation.' The emotional color in the process of defining rumors is further strengthened, academic neutrality is completely lost, and 'rumors' are completely 'demonized.'"[1]

“动机论”在中国的传统文化中源远流长。由春秋曲笔生出的“诛心之论”,就是在批评对方之时,不针对对方的行为、语言谈问题,而是绕过行为、语言去指责对方此行为、语言的目的和动机。这种重动机判断(其后紧跟的是价值判断、道德判断)的思维方式长期成为桎梏言论自由和理性讨论的障碍。尤其在极左时期,“动机论”曾经是一根万能的棍子。把“动机论”应用在谣言上,极其容易将谣言涂抹上伦理色彩,视同捏造、挑拨、诽谤、诬蔑,进而产生一系列可见的恶果:
The "motive theory" has a long history in traditional Chinese culture. The "heart-punishing theory" derived from the Spring and Autumn Annals is a criticism that does not address the behavior or language of the opponent but instead bypasses the behavior and language to accuse the opponent's purpose and motive behind the behavior and language. This way of thinking, which emphasizes motive judgment (followed by value judgment and moral judgment), has long been an obstacle to freedom of speech and rational discussion. Especially during the extreme left period, "motive theory" was once a universal stick. Applying "motive theory" to rumors makes it extremely easy to paint rumors with an ethical color, equating them with fabrication, incitement, slander, and defamation, leading to a series of visible negative consequences:

一是当权者常以此为标签,“妖魔化”反抗和持不同意见的群体,化解和打击对方的舆论攻势,抹杀抗争和质疑的正当性。
First, those in power often use this as a label to "demonize" groups that resist and hold different opinions, neutralize and counter the opponent's public opinion offensive, and obliterate the legitimacy of resistance and questioning.

例如,2007年,在厦门市民对PX化工项目进行抵制时,政府控制的《厦门日报》、《厦门晚报》接连发表文章,称在市民中群发的手机短信所散布的有关PX危害的内容为“谣言”,[2]并把市民因在正常渠道无法获知与公共利益密切相关的信息而私下互相流通的传闻鄙视为“‘路透社’消息”,指责它们后面“有双无形的、肮脏的手在操纵”,“谣言制造者和传播者或蛊惑人心,或煽风点火,或惟恐天下不乱,总有着其不可告人的目的。”[3]
For example, in 2007, when the citizens of Xiamen resisted the PX chemical project, the government-controlled "Xiamen Daily" and "Xiamen Evening News" consecutively published articles claiming that the content about the dangers of PX spread through mass text messages among citizens was "rumors," and they despised the rumors privately circulated among citizens who could not obtain information closely related to public interests through normal channels as "‘Reuters’ news," accusing them of being manipulated by "invisible, dirty hands," and stating that the "rumor makers and spreaders either incite people, fan the flames, or fear chaos in the world, always having ulterior motives."

在这方面,官方已经形成了一整套“义正辞严”的话语,被一位知名博客讽刺性地总结为“情绪都是煽动的,真相都是不明的,群众都是一小撮的”。[4]2008年6月28日,贵州瓮安县城发生一起严重的群体性事件,新华网于6月29日发出的电讯即称,按照当地警方的说法,事件缘起于一名女学生溺水死亡,其亲属对瓮安县公安局作出的死因鉴定结果不满,“在县政府有关负责人接待过程中,一些人煽动不明真相的群众冲击县公安局、县政府和县委大楼”,其中,极少数别有用心的人的“煽动”被认为是事件的起因,群众的“不明真相”则是导致事态扩大的原因之一。[5]
In this regard, the official discourse has formed a whole set of "righteous and stern" rhetoric, sarcastically summarized by a well-known blogger as "emotions are all incited, truths are all unclear, and the masses are always a small handful." On June 28, 2008, a serious mass incident occurred in Weng'an County, Guizhou. According to a report from Xinhua News Agency on June 29, based on the local police's statement, the incident originated from the drowning death of a female student. Her relatives were dissatisfied with the cause of death identified by the Weng'an County Public Security Bureau. "During the reception by relevant county government officials, some people incited the masses who were unclear about the truth to attack the county public security bureau, county government, and county committee building." Among them, the "incitement" by a very small number of people with ulterior motives was considered the cause of the incident, and the masses' "unclear truth" was one of the reasons for the escalation of the situation.

这些词语和句式已被官方沿用多年,凡是出现社会运动就必然有“一小撮别有用心的人”、“不明真相的群众”和“不可告人的目的”。它们成为执政者处理公共危机时必不可少的话语策略,不是没有理由的。对于国家层面的执政者而言,这里关系到政权的合法性这一致命的问题。现存政治哲学的基础在于设定了一种能够代表人民根本利益的群体,在此基础上产生的政府也就顺理成章地具有了先验的正当性。然而,在实践中,这套正当性推理日益瓦解。政府既难以推行一个为广大民众所接受的国家赖以建立其合法性的价值观,又由于现存国家权力的合法性基础仍然是绩效型的而非法律-选举型的,难以确立国家镇压的合法性,只有使用一套“冷战”的话语策略才能勉强维系自身统治的合法性。在这套话语策略之下,任何对于政府的抗议,都会被用一种敌对的思维作出解读。
These words and sentence patterns have been used by the authorities for many years. Whenever a social movement occurs, there will inevitably be "a small handful of people with ulterior motives," "masses unclear about the truth," and "ulterior motives." They have become an indispensable discourse strategy for the rulers in handling public crises, and not without reason. For national-level rulers, this relates to the fatal issue of the legitimacy of the regime. The foundation of the existing political philosophy is to establish a group that can represent the fundamental interests of the people. On this basis, the government generated also naturally possesses a priori legitimacy. However, in practice, this legitimacy reasoning is increasingly disintegrating. The government finds it difficult to implement a value system accepted by the majority of the people on which the legitimacy of the state is based, and because the legitimacy foundation of the existing state power is still performance-based rather than law-election-based, it is difficult to establish the legitimacy of state repression. Only by using a set of "Cold War" discourse strategies can it barely maintain its own ruling legitimacy. Under this discourse strategy, any protest against the government will be interpreted with a hostile mindset.

对于地方层面的执政者来说,这套话语则是官员追求利益最大化的一种必然结果。最近若干年里,中央实行重大责任事故负责制,一旦出现公共事故,当地领导人就很可能被撤职。其结果一方面促进当地领导人去防止公共事故的发生,但另一方面也促使他们在发生公共事故时,第一反应就是如何封锁事故的传播,争取时间和空间去自己处理、自我消化。在地方政府不需向民众负责、而是向上级负责的政治传统下,官员被激励去选择封锁消息。民间将此称做“惟上不惟下,瞒外不瞒内”。一旦瞒不住了,内部无法消化了,地方政府就会转而把社会运动说成是有计划、有组织的行动,甚至具有“反党反政府”的性质,这样政治上的“上纲上线”在构陷群众的同时,可以把上级党委、政府也绑架进来,从而掩盖地方吏治的极度恶化和自身的严重失职。
For local-level rulers, this discourse is an inevitable result of officials pursuing maximum benefits. In recent years, the central government has implemented a major responsibility system for accidents. Once a public accident occurs, local leaders are likely to be dismissed. As a result, on the one hand, it promotes local leaders to prevent public accidents, but on the other hand, it also prompts them to first think about how to block the spread of the accident when it occurs, to buy time and space to handle and digest it themselves. Under the political tradition where local governments are not accountable to the people but to their superiors, officials are incentivized to choose to block information. The public refers to this as "only obeying the superior, not the inferior, hiding from the outside but not from the inside." Once it can no longer be hidden and cannot be internally digested, the local government will turn to describe the social movement as a planned and organized action, even with "anti-party and anti-government" nature. This political "escalation" can frame the masses while also dragging the superior party committee and government into it, thereby covering up the extreme deterioration of local governance and their own serious dereliction of duty.

二是动辄动用法律手段,对一些有一定事实依据、但又不甚准确的说法,以谣言视之,强力打压,导致在重大社会和安全事件中,中国公民的言论具有极大的法律风险。
Secondly, they often resort to legal means, treating some statements with certain factual basis but not entirely accurate as rumors, and suppressing them forcefully, leading to great legal risks for Chinese citizens' speech in major social and safety incidents.

中国《刑法》第105条第2款、第181条、第221条、第291条第1款,分别对以造谣等方式煽动颠覆国家政权、编造并且传播影响证券交易的虚假信息、捏造并散布损害他人商业信誉和商品声誉的虚伪事实、编造和明知编造而故意传播恐怖信息等等行为作出有罪规定;《治安管理处罚法》第25条第1项规定,“散布谣言,谎报险情、疫情、警情或者以其他方法故意扰乱公共秩序的”,要承担罚款、拘留等行政责任。
Article 105, Paragraph 2, Article 181, Article 221, and Article 291, Paragraph 1 of the Criminal Law of China respectively stipulate criminal penalties for acts such as inciting subversion of state power through rumor-mongering, fabricating and spreading false information that affects securities trading, concocting and disseminating false facts that damage others' commercial reputation and product reputation, and fabricating and knowingly spreading terrorist information. Article 25, Item 1 of the Public Security Administration Punishment Law stipulates that "spreading rumors, falsely reporting dangers, epidemics, police situations, or deliberately disturbing public order by other means" will result in fines, detention, and other administrative responsibilities.

就谣言在新媒体当中的发布和传播,2000年9月25日公布的《中华人民共和国电信条例》规定,任何组织或者个人不得利用电信网络制作、复制、发布、传播“散布谣言、扰乱社会秩序、破坏社会稳定”的信息;2000年12月28日全国人大常委会《关于维护互联网安全的决定》称,对于“利用互联网造谣、诽谤或者发表、传播其他有害信息,煽动颠覆国家政权、推翻社会主义制度,或者煽动分裂国家、破坏祖国统一”、“利用互联网编造并传播影响证券、期货交易或者其他扰乱金融秩序的虚假信息”、“利用互联网侮辱他人或者捏造事实诽谤他人”等行为,将依照刑法的有关规定,追究刑事责任;国务院新闻办公室、信息产业部2005年9月25日联合发布的《互联网新闻信息服务管理规定》要求互联网新闻信息服务中不得含有“散布谣言,扰乱社会秩序,破坏社会稳定”的内容。
Regarding the release and dissemination of rumors in new media, the Telecommunications Regulations of the People's Republic of China, promulgated on September 25, 2000, stipulate that no organization or individual may use the telecommunications network to produce, copy, publish, or disseminate information that "spreads rumors, disrupts social order, or undermines social stability." The Decision on Maintaining Internet Security, issued by the Standing Committee of the National People's Congress on December 28, 2000, states that those who "use the internet to fabricate rumors, defame, or publish and disseminate other harmful information, incite subversion of state power, overthrow the socialist system, or incite the division of the country and undermine national unity," "use the internet to fabricate and spread false information that affects securities, futures trading, or other financial order," or "use the internet to insult others or fabricate facts to defame others" will be held criminally responsible according to relevant provisions of the Criminal Law. The Provisions on the Administration of Internet News Information Services, jointly issued by the State Council Information Office and the Ministry of Information Industry on September 25, 2005, require that internet news information services must not contain content that "spreads rumors, disrupts social order, or undermines social stability."

这些条款,由于缺乏具体的判断标准而显得含糊不清。例如,要进行行政处罚,必须有“扰乱公共秩序”的后果,但怎样才算“扰乱了公共秩序”,始终是相关案件中的一个颇有争议的话题。而且,法律将散布谣言和谎报险情、疫情、警情等相并列,并涉及“故意”这样的主观因素,由此产生了一个问题:对于个人来说,如果他或她并非出于 “故意”而发布或者传播了一些与事实并不完全相符的信息,是不是要承担相应的法律责任?
These provisions are vague due to the lack of specific criteria for judgment. For example, to impose administrative penalties, there must be consequences of "disrupting public order," but what constitutes "disrupting public order" remains a controversial topic in related cases. Moreover, the law equates spreading rumors with falsely reporting dangers, epidemics, police situations, etc., and involves subjective factors such as "intent." This raises a question: if an individual publishes or disseminates information that is not entirely accurate without "intent," should they bear corresponding legal responsibility?

从2006年的“张志坚事件”,[i]到2007年的“红钻帝国”,[ii]再到2008年的“SS山地师”,[iii]各地接连出现因在网上“转载”或“跟帖”,当事网友被公检法机构逮捕或拘留的案例。另外一种情形是因短信而获罪,例如,2007年1月,北京警方称,发“病猪肉”谣言短信可判5年以上徒刑;[iv]太湖蓝藻污染期间,无锡市民丁某向130余人散发“太湖水致癌物超标200倍”的手机短信,被无锡警方处以治安拘留。[v]
From the "Zhang Zhijian Incident" in 2006, to the "Red Diamond Empire" in 2007, and the "SS Mountain Division" in 2008, cases of netizens being arrested or detained by public security, procuratorial, and judicial agencies for "reposting" or "commenting" online have emerged one after another. Another situation involves being convicted due to text messages. For example, in January 2007, Beijing police stated that sending text messages about "diseased pork" rumors could result in a prison sentence of more than five years. During the Taihu Lake blue algae pollution period, Ding from Wuxi was administratively detained by Wuxi police for distributing text messages to over 130 people claiming that "Taihu Lake water contains carcinogens exceeding the standard by 200 times."

根据法律规定仔细辨别这些案例,不难发现,政府存在明显的滥用法律行为。首先,政府倾向于把凡是与事实不完全符合的传言都定性成法律意义上的谣言。“SS山地师”在转发帖子时,相关部门正在调查处理,信息庞杂,虽转贴伤亡人数有误,但仍可证明事故造成重大伤亡。事实上,在大的灾害事故发生后的较短时间内,即便政府也往往没有能力马上判断言论的真假。当局严重混淆散布谣言扰乱公共秩序与出于自身安全考虑传播小道消息的区别,后者根本不属于违法行为。在重大灾难之后,许多人都曾传播不知真假的小道消息,提醒亲友注意安全,从现行的法律体系来看,他们中几乎每一个都可能被抓起来。
A careful examination of these cases according to legal provisions reveals obvious abuses of the law by the government. Firstly, the government tends to classify any rumor that does not completely align with the facts as a legal rumor. When the "SS Mountain Division" post was forwarded, relevant departments were investigating and handling the situation, and although the reposted casualty numbers were incorrect, it still proved that the accident caused significant casualties. In fact, shortly after major disaster incidents, even the government often lacks the ability to immediately determine the truth of statements. Authorities severely confuse the distinction between spreading rumors to disrupt public order and spreading hearsay for personal safety, the latter of which is not illegal. After major disasters, many people have spread unverified hearsay to warn friends and family of safety concerns. Under the current legal system, almost every one of them could be arrested.

其次,谣言是否“故意扰乱公共秩序”或足以“严重扰乱社会秩序”,而不是所散布的信息的真假,才应该是处理谣言案件的出发点。“红钻帝国”和“SS山地师”的帖子是转载和引述,虽然态度激烈,但是否构成“扰乱公共秩序”,则需要视帖子的影响面以及造成的客观结果而定,比如,帖子的传播范围有多广,是否激发了公众的心理恐慌,影响到正常的生产、工作、教学、生活秩序等。
Secondly, whether the rumor is "intentionally disrupting public order" or sufficient to "seriously disrupt social order," rather than the truthfulness of the information being spread, should be the starting point for handling rumor cases. The posts of "Red Diamond Empire" and "SS Mountain Division" are reposts and quotes. Although the tone is intense, whether it constitutes "disrupting public order" depends on the scope of the post's influence and the objective results it causes. For example, how widely the post is spread, whether it has triggered public psychological panic, and affected normal production, work, teaching, and living order.

特别需要强调的是,公众有权质疑、批驳任何报道乃至政府公告的真实性,公民发短信或者转发相关帖子,即使有不实之处,也应被视作自保或者行使监督权,政府部门只能用更加公开透明的信息来平息大家的忧虑,消除不实之言。一场灾难过后,人们尚未获知政府部门关于预警系统、抗灾能力和救援措施的检讨,却先发现普通市民因为参与灾难后果的讨论而被警方拘留,这不能不使网络民意的焦点集中在权力是否滥用、言论是否自由等问题上。
It is particularly important to emphasize that the public has the right to question and refute the authenticity of any report or even government announcements. Citizens sending text messages or forwarding related posts, even if there are inaccuracies, should be seen as self-protection or exercising their right to supervise. Government departments can only calm everyone's concerns and eliminate false statements with more open and transparent information. After a disaster, people have not yet learned about the government's review of the early warning system, disaster response capabilities, and rescue measures, but they first find that ordinary citizens are detained by the police for discussing the aftermath of the disaster. This inevitably focuses online public opinion on issues such as whether power is being abused and whether freedom of speech is being upheld.

杨支柱指出:“基于保护言论自由的需要,判断一种言论是否扰乱公共秩序,应该采用‘明显而紧迫的危险’标准;因为允许政府因不明显的危险阻止或惩罚言论,将使言论者发表任何言论都胆战心惊,而非紧迫的危险是政府有时间采取措施避免的。”(杨支柱,2007)之所以要对媒体在灾难和事故方面的报道以及公民的关注采取宽容态度,非常重要的一个理由是这样可以及时避免更大的危害、抢救更多的生命,与之相比,“可能的恐慌混乱仍然属于较小的恶,是不得已的容忍”(顾肃,2006)。从补救措施上看,对于言论者可能产生的偏向,政府通过公布真相进行解释说明、揭露言论者散布虚假信息的行为就能消除影响,并不应因批评采用虚构方式就予以强力打击。
Yang Zhizhu pointed out: "Based on the need to protect freedom of speech, the standard of 'clear and present danger' should be used to judge whether a speech disrupts public order; because allowing the government to prevent or punish speech due to an unclear danger will make speakers fearful of expressing any opinion, while non-urgent dangers are something the government has time to take measures to avoid." (Yang Zhizhu, 2007) One very important reason for adopting a tolerant attitude towards media reports on disasters and accidents and citizens' concerns is that it can timely avoid greater harm and save more lives. In comparison, "possible panic and confusion are still relatively minor evils that must be tolerated" (Gu Su, 2006). From the perspective of remedial measures, the government can eliminate the influence by disclosing the truth to explain and expose the behavior of spreading false information, and should not resort to strong measures just because of criticism using fictional methods.

一方面,公权机关常常以扰乱公共秩序为由拘捕公民,另一方面,值得注意的是,在一些谣言案件中,诽谤罪成了公权打击私权的武器。2008年7月,在上海闸北袭警案发生后不久,网上就流传,犯罪嫌疑人杨佳因遭民警殴打导致丧失生育能力才伺机报复。7月14日,上海市检察院第二分院对编造、散布谣言的郏啸寅以涉嫌诽谤罪批准逮捕。检察机关称,郏啸寅于7月2日下午编造了题为《上海袭警事件内幕》的文章,虚构杨佳因被闸北公安分局民警打伤生殖器、丧失生育能力而萌生报复袭警等内容,在网上多次发布、张贴,并被其他网站大量转载。检察机关认为,郏啸寅利用互联网捏造事实严重损害了执法民警的名誉和公安机关的形象,其行为已触犯《刑法》第246条,涉嫌诽谤罪。
On one hand, public authorities often arrest citizens on the grounds of disrupting public order. On the other hand, it is worth noting that in some rumor cases, defamation has become a weapon for public power to attack private rights. In July 2008, shortly after the police assault case in Zhabei, Shanghai, it was rumored online that the suspect Yang Jia retaliated because he lost his reproductive ability due to being beaten by the police. On July 14, the Second Branch of the Shanghai Municipal Procuratorate approved the arrest of Jia Xiaoyin on suspicion of defamation for fabricating and spreading rumors. The procuratorial agency stated that on the afternoon of July 2, Jia Xiaoyin fabricated an article titled "The Inside Story of the Shanghai Police Assault Incident," falsely claiming that Yang Jia sought revenge because he lost his reproductive ability due to being injured by the police of Zhabei Public Security Bureau. This article was repeatedly posted online and widely reposted by other websites. The procuratorial agency believed that Jia Xiaoyin's use of the internet to fabricate facts seriously damaged the reputation of law enforcement officers and the image of the public security agency, and his behavior violated Article 246 of the Criminal Law, constituting defamation.

《刑法》第246条的规定是,“以暴力或者其他方法公然侮辱他人或者捏造事实诽谤他人,情节严重的,处三年以下有期徒刑、拘役、管制或者剥夺政治权利。”必须注意的是,此条规定放在刑法第四章“侵犯公民人身权利、民主权利罪”当中。也就是说,诽谤罪,是指故意捏造并散布虚构的事实,贬损他人人格,破坏他人名誉,情节严重的行为。这一犯罪侵犯的对象,必须是公民而不是企业、国家机关或者其他组织的名誉。不可否认,郏的造谣对上海警方和办案民警的形象造成了一定的负面影响,但并不一定就是应该动用国家强制力处罚的违法或犯罪行为。如果把对于公职人员的公权行为的评判以诽谤罪入刑,其结果必然是,任何人都不敢对公权实施监督,公民言论自由的崇高价值也无法得到保障。
Article 246 of the Criminal Law stipulates that "whoever publicly insults another person by violence or other methods or fabricates facts to defame another person, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance, or deprivation of political rights." It must be noted that this provision is placed in Chapter IV of the Criminal Law, "Crimes of Infringing upon Citizens' Personal Rights and Democratic Rights." In other words, defamation refers to the intentional fabrication and dissemination of false facts to damage another person's character and reputation, with serious circumstances. The target of this crime must be a citizen, not the reputation of enterprises, state agencies, or other organizations. It is undeniable that Jia's rumor caused some negative impact on the image of the Shanghai police and the handling officers, but it does not necessarily mean that state coercive power should be used to punish such illegal or criminal behavior. If the evaluation of public officials' actions is criminalized as defamation, the result will inevitably be that no one dares to supervise public power, and the noble value of citizens' freedom of speech cannot be guaranteed.

言论自由天然包含了说错话的自由,尤其是质疑权力的自由。这就要求公共官员面对批评甚至夸大事实的捏造时,不能动辄以诽谤为由主张名誉权和隐私权,更不能以国家暴力机器来满足个人的私利。而一个又一个因发送短信、网络发帖获罪的案件,却多次显示一些地方长官借助手中掌握的公共权力资源,习惯性地把一切未经官方认可的信息当作谣言来打击,甚至不惜顶着挟私报复的恶名钳制言论,由此制造了一个人人自危的社会和舆论环境。
Freedom of speech inherently includes the freedom to make mistakes, especially the freedom to question authority. This requires public officials to face criticism and even fabrications of facts without readily claiming defamation to assert their rights to reputation and privacy, and certainly not using state violence to satisfy personal interests. However, a series of cases where individuals were convicted for sending text messages or posting online have repeatedly shown that some local officials habitually use public power resources to suppress any information not officially recognized as rumors, even at the risk of being accused of personal revenge, thus creating a social and public opinion environment where everyone feels threatened.

[i] 2006年3月,身为海口一家制药企业工作人员的张志坚,在制药领域的专业网站小木虫网站(http://emuch.net)和丁香园网站(http://www.dxy.cn)上转帖了一篇揭露浙江康力元投资集团与国家食品药品监督管理局原局长郑筱萸和原药品注册司司长曹文庄等多名国家药监局工作人员进行“官药勾结”的网文。康力元公司因此向海口警方“报案”,4月26日,海口市公安局以涉嫌损害商业信誉罪为由拘留了张志坚,6月1日,检察院批准将张志坚逮捕。2007年2月6日,检察院以案件事实、证据有变化为由撤诉,并准许取保候审。2007年4月12日,检察院以事实不清、证据不足,警方已撤案为由取消取保候审。2007年7月,在案发近一年三个月之后,被司法机关错误羁押的张志坚获得24000元国家赔偿。7月6日,张志坚转帖网文中的当事人曹文庄被判处死刑,缓期二年执行;7月10日,郑筱萸在北京被执行死刑。 [ii] 2007年7月18日,济南特大暴雨,水位迅速上升的护城河完全没过银座购物广场的排水出口,这座济南最大最繁华的标志性商场成了一个巨大的蓄水池。数天后,银座发布官方消息,称“由于疏导及时,超市内无一伤亡”。这成了后来在网络上争议最大的话题之一。一个注册名为“红钻帝国”的23岁的女孩在济南舜网(http://www.e23.cn)回帖参与论坛的济南暴雨讨论,声称听亲友说大水涌入银座广场而死了不少人。济南警方依据《治安管理处罚法》,以“散布谣言”为罪名对其予以治安拘留,认定她的跟帖“内容有明显的唬人噱头,营造了暴雨过后的恐怖气氛,里面有灾害造成多人死亡的虚假信息”。当地一家媒体报道说:“暴雨可怕,谣言更可怕!” [iii] 2008年4月28日,一场近10年来中国铁路行业罕见的列车相撞事故在胶济铁路上发生。当天,21岁的山东高密网民“SS山地师”在百度高密贴吧转发了一条名为《火车相撞特大内幕!》的帖子,被当地公安机关认定为“内容严重歪曲了正规广播电视媒体关于4·28 事件的真实报道”,违反了《治安管理处罚法》第25条,“涉嫌散布虚假信息,扰乱公共秩序”,对其处以治安拘留。警方同时警告网民“不要相信网上的一些虚假信息,更不要散布虚假信息,特别是这种严重扰乱社会公共秩序的虚假信息,一旦发现散布这种信息的人员,公安机关将予以严惩”。“SS山地师”不仅遭到了治安处罚,还被当地电视台以反面事例曝光,以教育观众。 [iv] 《北京警方:发“病猪肉”谣言短信可判刑5年以上》, 《北京日报》2007年1月16日。 [v] 新华网南京2007年6月6日消息。

A few days later, Yinzuo released an official statement claiming that "due to timely evacuation, there were no casualties in the supermarket." This became one of the most controversial topics on the internet. A 23-year-old girl with the username "Red Diamond Empire" participated in the Jinan rainstorm discussion on the Jinan Shun website (http://www.e23.cn), claiming that she heard from relatives and friends that many people died when the floodwaters rushed into the Yinzuo Plaza. The Jinan police detained her for "spreading rumors" under the Public Security Administration Punishment Law, stating that her post "contained obvious sensationalism, creating a terrifying atmosphere after the rainstorm, and included false information about multiple deaths caused by the disaster." A local media outlet reported, "The rainstorm is scary, but rumors are even scarier!" [iii] On April 28, 2008, a rare train collision accident in the Chinese railway industry occurred on the Jiaoji Railway. On the same day, a 21-year-old netizen from Gaomi, Shandong, with the username "SS Mountain Division," reposted a post titled "Major Insider of Train Collision!" on the Baidu Gaomi forum. The local public security authorities determined that the post "seriously distorted the true reports of the 4.28 incident by regular broadcast and television media," violating Article 25 of the Public Security Administration Punishment Law, "suspected of spreading false information and disrupting public order," and imposed administrative detention. The police also warned netizens "not to believe some false information on the internet, and especially not to spread false information that seriously disrupts public order. Once such information is found to be spread, the public security authorities will severely punish the individuals involved." "SS Mountain Division" not only faced administrative punishment but was also exposed as a negative example on local television to educate the public. 谣言与大众媒体的对立 The Opposition Between Rumors and Mass Media

2008年5月12日,北京召开会议全面部署抗震救灾工作,在会议要求中,“加强正面舆论引导”和“依法处理”谣言是在同一个句子中出现的,这也是官方长期一贯的做法。由于政府垄断着媒体资源,“加强正面舆论引导”往往是新闻封锁、新闻限制的同义词。毋宁说,正是官方“加强正面舆论引导”的行为,导致了官方信息的匮乏和不可信,才为“谣言”的传播培育了丰厚的土壤。官方一方面给谣言留下传播的空间,另一方面却又声色俱厉地打击谣言,从而令自身陷入一种难以破解的矛盾当中。
On May 12, 2008, Beijing held a meeting to comprehensively deploy earthquake relief work. In the meeting's requirements, "strengthening positive public opinion guidance" and "handling rumors according to law" appeared in the same sentence, which has been the consistent practice of the authorities for a long time. Since the government monopolizes media resources, "strengthening positive public opinion guidance" often becomes synonymous with news blockade and news restriction. It can be said that it is precisely the actions of the authorities to "strengthen positive public opinion guidance" that have led to the scarcity and untrustworthiness of official information, thereby cultivating fertile ground for the spread of "rumors." On one hand, the authorities leave room for rumors to spread, while on the other hand, they harshly crack down on rumors, thus trapping themselves in an inextricable contradiction.

自2003年非典以来,突发事件中有关部门对媒体报道压制所造成的巨大损失和危机的扩大,一次又一次地证明着,媒体或者失语、或者成为强势话语的代言人,往往是造成谣言扩散、社会恐慌和危机加剧的主要原因。
Since the SARS outbreak in 2003, the enormous losses and crisis expansion caused by the suppression of media reports by relevant departments during emergencies have repeatedly proven that the media's silence or becoming a spokesperson for powerful discourse is often the main reason for the spread of rumors, social panic, and the exacerbation of crises.

2005年11月13日,中国石油吉林石化公司双苯厂发生着火爆炸事故。在发生爆炸的当天,吉林市环保部门就已经发现松花江水体受到污染,后来还递交了相关污染的监测数据。但几天内吉林市委、市政府仍未做统一安排去向公众进行解释与澄清;一周后,吉林省有关部门仍坚称没有听说吉林石化公司发生爆炸污染松花江水源的说法。甚至在下游的哈尔滨市于21日早晨宣布停水时,石化厂和吉林市仍然拒不承认苯流入江水对人和环境造成剧毒性危害。
On November 13, 2005, a fire and explosion accident occurred at the Double Benzene Plant of China National Petroleum Corporation Jilin Petrochemical Company. On the day of the explosion, the Jilin City Environmental Protection Department had already discovered that the Songhua River water was polluted and later submitted relevant pollution monitoring data. However, within a few days, the Jilin Municipal Party Committee and Municipal Government still did not make unified arrangements to explain and clarify to the public; a week later, relevant departments in Jilin Province still insisted that they had not heard of the explosion at the Jilin Petrochemical Company polluting the Songhua River water source. Even when the downstream city of Harbin announced a water stoppage on the morning of the 21st, the petrochemical plant and Jilin City still refused to admit that benzene flowing into the river water caused highly toxic harm to people and the environment.

哈尔滨市政府宣布停水的原因竟然是“对市政供水管网全面检修”。在这关键时刻,官员们采取了鸵鸟政策,拒绝回答媒体和公众的质询,甚至把环保部门的对外报道权也控制起来。居民们既无法从政府部门、也不能从当地媒体报道获得明确、真实和完整的信息,令哈尔滨市陷入了前所未有的恐慌,饮用水、啤酒、牛奶等统统遭遇抢购。小道消息不胫而走,甚至出现地震的流言,事情愈闹愈大,市政府才在十小时后不得不再出公告,解释停水原因是由于日前吉林化工双苯厂爆炸污染了松花江。
The reason given by the Harbin Municipal Government for the water stoppage was "comprehensive maintenance of the municipal water supply network." At this critical moment, officials adopted an ostrich policy, refusing to answer inquiries from the media and the public, and even controlled the external reporting rights of the environmental protection department. Residents could not obtain clear, truthful, and complete information from either government departments or local media reports, plunging Harbin into unprecedented panic, with drinking water, beer, milk, and other items being snapped up. Rumors spread quickly, even leading to earthquake rumors. As the situation escalated, the municipal government had to issue another announcement ten hours later, explaining that the water stoppage was due to the recent explosion at the Jilin Chemical Double Benzene Plant polluting the Songhua River.

在“正确的舆论导向”之下,传统的主流媒体对重大社会政治事件实行选择性报道,选择的标准完全由他们来掌握,他们认为是反面的、消极的、添乱的、抹黑的就按下不表,确定为正面的、积极的、鼓劲的、添彩的就公开宣扬,而区分的根本标准,就是看其是否对抽象的社会稳定构成威胁,丝毫不管是否对民众的知情权造成损害,是否可能给民众的生命财产带来巨大危险。
Under the "correct public opinion guidance," traditional mainstream media selectively report on major social and political events. The selection criteria are entirely controlled by them; they suppress what they consider negative, passive, disruptive, or tarnishing, and openly promote what they deem positive, active, encouraging, or embellishing. The fundamental standard for differentiation is whether it poses a threat to abstract social stability, regardless of whether it infringes on the public's right to know or potentially endangers people's lives and property.

当正常的社会传播系统功能被削弱,非常态的传播机制就会活跃起来。在松花江水污染事件中,有关“水污染”和“地震”的传闻多是通过口口相传、手机短信、互联网论坛等传播的,而且流传时间比报纸、电视、电台等传统媒体正式发布的时间早得多。人们与其相信报纸、电视等大众媒体的正式新闻报道,更倾向于相信来路不明的谣言,导致“新闻像谣言,谣言像新闻”的怪象出现。在政府的权力控制下,被行政力量扭曲了的传播手段在谣言广泛散布的环境里,最终取得了相反的效果。
When the normal function of the social communication system is weakened, abnormal communication mechanisms become active. In the Songhua River water pollution incident, rumors about "water pollution" and "earthquakes" were mostly spread through word of mouth, text messages, and internet forums, and circulated much earlier than the official releases by newspapers, television, and radio. People were more inclined to believe the unclear origins of rumors rather than the official news reports from mass media, leading to the bizarre phenomenon where "news resembles rumors, and rumors resemble news." Under the government's power control, the communication methods distorted by administrative forces ultimately achieved the opposite effect in an environment where rumors were widely spread.

观察新媒体事件中的谣言传播,很容易发现一种现象:政府习惯于在谣言四起的时候,四处删帖、封帖,但这样做反而立刻吸引了网上的注意。人们总是倾向于认为,被删被封的有可能是真相,于是就会想方设法搜索被删被封的东西。结果,被封掉的是国家控制下的喉舌,人们传播的反而是“别有用心者”的谣言。这样的事情一再重演,导致公共行政部门本身失信于民,危及其执政权威。
Observing the spread of rumors in new media events, it is easy to notice a phenomenon: the government tends to delete and block posts everywhere when rumors are rampant, but this instead immediately attracts online attention. People always tend to believe that what is deleted or blocked might be the truth, so they will try every means to search for the deleted or blocked content. As a result, what gets blocked is the state-controlled mouthpiece, while what people spread are the rumors of "those with ulterior motives." Such incidents repeatedly occur, leading to the public administrative departments themselves losing credibility with the people, endangering their governing authority.

谣言与政府和政府控制下的大众媒体的对立,反映了一种严峻的社会现实:民众表达自己声音的正常渠道近乎完全被封闭。所谓谣言,最近几年似乎在成为一个越来越敏感的问题,这种敏感性往往与屡屡爆发的突发性事件和群体性事件相联系,而这些事件的产生,则非常多地是因为民众无法通过正常渠道解决利益攸关的重大问题。
The opposition between rumors and the government and government-controlled mass media reflects a grim social reality: the normal channels for the public to express their voices are almost completely blocked. The so-called rumors seem to have become an increasingly sensitive issue in recent years. This sensitivity is often associated with the frequent outbreaks of sudden incidents and mass events, and the occurrence of these events is largely due to the public's inability to resolve major issues of interest through normal channels.

在厦门反PX游行之前,各种正常渠道的上访、专家咨询会、全国政协会议提案等手段都未能有效地促成PX项目的公开、科学和全面的论证。为什么在游行前体制内的解决手段失效?现有地方政治权力过于集中是最重要的原因。舆论、司法、人民代表大会等正常渠道,在这种集权的情况下,要么工具化而沦为行政权力的附庸,完全服务于行政意图;要么干脆处于沉睡状态。当正常渠道不正常的时候,一旦发生矛盾和冲突,绕过正常渠道就成了民众自然的选择;谣言就是这种“绕道”的体现之一。而谣言之所以令官方感觉如此不舒服,正是因为权力无法完全控制这种渠道。
Before the anti-PX march in Xiamen, various normal channels such as petitions, expert consultation meetings, and proposals at the National Committee of the Chinese People's Political Consultative Conference failed to effectively promote the open, scientific, and comprehensive demonstration of the PX project. Why did the institutional solutions fail before the march? The most important reason is the excessive concentration of existing local political power. Under such centralized power, normal channels such as public opinion, judiciary, and the people's congress either become tools and vassals of administrative power, completely serving administrative intentions, or simply remain dormant. When normal channels are abnormal, once conflicts and contradictions arise, bypassing normal channels becomes a natural choice for the public; rumors are one manifestation of this "bypassing." The reason why rumors make the authorities feel so uncomfortable is precisely because power cannot completely control this channel.

在信息制造、传播链上居于劣势的弱势群体,如果完全拒绝传闻类信息,他们又该从何处获知他们的处境、了解他们的?益所在,用什么方式宣泄他们的情绪、宣示他们的诉求呢?政府因知情而说谎,民众因不知情而造谣。在此意义上,谣言不仅仅是替代性的,而且是补充性的。
If the disadvantaged groups, who are at a disadvantage in the information production and dissemination chain, completely reject rumor-like information, how can they learn about their situation, understand their interests, and express their emotions and demands? The government lies because it knows the truth, while the public creates rumors because they do not know the truth. In this sense, rumors are not only a substitute but also a supplement.

在很长的时间里,人们一直把谣言当做一个代用品:例如,《广州日报》负责人曾经撰文指出,在2003年2月蔓延广东全省的有关非典的传言和谣言,“不仅引发了广东历史上极为罕见的社会恐慌,也引爆了一场党报主流媒体与传言和谣言之间的遭遇战”,而“各种传言和谣言之所以能够通过人际传播的方式兴风作浪,主要是因为缺乏权威资讯引导的结果”(薛晓峰等,2003)。言下之意是说,通过大众媒体与官方对权威信息的发布,就可以中止或减少谣言的散布,有效杜绝危机的发生。
For a long time, people have regarded rumors as a substitute: for example, the head of the Guangzhou Daily once wrote that the rumors and hearsay about SARS that spread across Guangdong province in February 2003 "not only triggered an extremely rare social panic in Guangdong's history but also sparked a confrontation between the mainstream media of the party newspaper and the rumors and hearsay," and "the reason why various rumors and hearsay could stir up trouble through interpersonal communication was mainly due to the lack of authoritative information guidance" (Xue Xiaofeng et al., 2003). The implication is that the dissemination of authoritative information through mass media and official channels can stop or reduce the spread of rumors and effectively prevent crises.

然而,卡普费雷却指出,大众传播媒介和谣言之并存证明了,“谣言是作为补充的传播媒介,传播的是另一种事实”(卡普费雷,1991:274-275)。这是因为,大众媒体总是处于一种自上而下的交流形式,从知情的人传到不知情的人。于是公众获知的是他人想对其灌输的信息。而谣言是小道消息,更近似于个人情绪感受的一种表达,罗斯诺称之为“夹杂了个人对这世界如何运转的主观臆测的公众传播”,表达了试图认知自身生存环境的人们的忧虑和困惑(Rosnow, 484-496)。由此来看,谣言并不完全只与信息有关。它也用来满足人们的心理和社会需求。甚至即便其事实基础被证伪,谣言也仍然会经久不息。
However, Kapferer pointed out that the coexistence of mass media and rumors proves that "rumors are a supplementary communication medium, spreading another kind of truth" (Kapferer, 1991: 274-275). This is because mass media always operate in a top-down communication form, from those who know to those who do not. Thus, the public learns what others want to instill in them. Rumors, on the other hand, are more like personal emotional expressions, which Rosnow calls "public communication mixed with personal subjective speculation about how the world works," expressing the concerns and confusion of people trying to understand their living environment (Rosnow, 484-496). From this perspective, rumors are not entirely about information. They also serve to meet people's psychological and social needs. Even if their factual basis is debunked, rumors can still persist for a long time.

更重要的是,谣言会在沉默的人群中间诞生,会在那些为着自身的利益或是破坏反对者的声音而制造信息的群体中生发出来,作为一种政治传播策略而出现。何时大众传播媒介成为官方消息的唯一提供者,何时就会有谣言现身,提供与官方真实不同的真实。
More importantly, rumors are born among silent crowds and emerge from groups that create information for their own benefit or to undermine the voices of opponents, appearing as a political communication strategy. Whenever mass media becomes the sole provider of official news, rumors will appear, offering a reality different from the official truth.

正因如此,谣言不会是一种一时的、短暂的现象,大众媒介的兴起,也不会消除这种最古老的传播媒介。信息永远存在两个来源:一个是大众媒介所说的,另一个则是个人从他周围最直接的人那里、他的社交圈子里获得的。而后者就是谣言。谣言的扩散经常显示出一种对官方渠道消息的不信任,甚至对政府本身就缺乏信任。在2006年一度闹得沸沸扬扬的“广东高州物管打死考上清华学生”的网络谣言事件中,有网友在跟贴中写道:“大家宁可相信谣言,而不相信你们,因为你们不值得信任”。[i]在实行新闻管制的国家,在人们普遍不信任官方信息的情况下,谣言在某些时候甚至成为唯一的媒介。
For this reason, rumors are not a temporary or short-lived phenomenon, and the rise of mass media will not eliminate this oldest form of communication. Information always has two sources: one is what the mass media says, and the other is what individuals obtain from the people around them, their social circles. The latter is rumors. The spread of rumors often shows a distrust of official channels and even a lack of trust in the government itself. In the 2006 online rumor incident about "Guangdong Gaozhou property management beating a student admitted to Tsinghua University to death," a netizen wrote in a comment: "Everyone would rather believe rumors than believe you because you are not trustworthy." In countries with news control, where people generally do not trust official information, rumors sometimes become the only medium.

这意味着,在一个缺乏信息自由的社会里,谣言这种媒介成长得最好。一个政府越是经常掩盖和操纵信息,谣言的力量也就越大。这种不受控制的现象意味着审查制度的无效,它揭开秘密和找到被掩盖的事实,表达被统治者的缄默愿望,给无声者以声音,告诉政府民众和国家之间横亘着一条公信力鸿沟。
This means that in a society lacking information freedom, the medium of rumors grows best. The more a government frequently covers up and manipulates information, the stronger the power of rumors. This uncontrolled phenomenon signifies the ineffectiveness of censorship; it uncovers secrets and finds hidden facts, expresses the silent wishes of the governed, gives a voice to the voiceless, and tells the government that there is a credibility gap between the people and the state.

谣言无法消除,只能削减。事实上,只存在一种消除谣言的办法,即禁止人民的相互交流。官方存在一种从自身利益出发看来合理的想法:只想让他们认为可靠的消息流传,这种想法在现实操作中,体现为种种“净化”舆论空间的努力,它直接导致新闻控制,进而导致侵害言论自由。2003年非典期间,就有文章称“谣言比瘟疫更可怕”,2008年汶川地震期间,又有文章说“谣言比地震更可怕”。其实,比谣言更加可怕的是对言论自由的剥夺。
Rumors cannot be eliminated, only reduced. In fact, there is only one way to eliminate rumors, which is to prohibit people from communicating with each other. The government has a seemingly reasonable idea from its own interests: it only wants the information it deems reliable to spread. This idea, in practical operation, is reflected in various efforts to "purify" the public opinion space, which directly leads to news control and further infringes on freedom of speech. During the SARS period in 2003, there were articles claiming that "rumors are more terrifying than the plague," and during the Wenchuan earthquake in 2008, there were articles saying that "rumors are more terrifying than the earthquake." In fact, what is more terrifying than rumors is the deprivation of freedom of speech.

既然纳普提出的使公众对所有官方传播媒介和政府无保留地信任的做法在任何实行民主和法治的国家都无法行得通,那么,无论是政府还是官方媒体,都必须修正自己落后的执政和传播理念,才能充分保证社会的健康和可治理。“把谣言和虚假联系在一起的这种消极观念来自工艺程序:只有可控制的信息交流才是好的。谣言却从反面提出另一种价值观:只有不受约束的信息交流才是好的,哪怕其可靠性受到影响。”(卡普费雷,1991:275)
Since the approach proposed by Nap to make the public unreservedly trust all official media and the government cannot be implemented in any country that practices democracy and the rule of law, both the government and official media must correct their outdated governance and communication concepts to fully ensure a healthy and governable society. "The negative view that associates rumors with falsehood comes from a technical process: only controlled information exchange is good. Rumors, however, propose another value from the opposite perspective: only unrestricted information exchange is good, even if its reliability is affected." (Kapferer, 1991: 275)

我们可以把媒介的发展史分成口传媒介时期、文字媒介时期、电子媒介时期、网络媒介时期。文字媒介的代表是报纸,电子媒介的代表是电视,两者共同构成了由中央广播者向外发布信息的大众传播方式。无论是报纸还是电视,都未能使谣言烟消云散。尽管有了大众媒介,人们仍继续以口传媒介的方式获取一部分信息。甚至在21世纪里,尽管交流手段凭借新媒体和新的数据传输技术已变得极其先进,直接的口耳相传仍然在散播信息的过程中发挥着关键作用。
We can divide the history of media development into the oral media period, the written media period, the electronic media period, and the network media period. The representative of written media is the newspaper, and the representative of electronic media is television. Together, they constitute the mass communication method where information is disseminated from a central broadcaster outward. Neither newspapers nor television have been able to completely eliminate rumors. Despite the presence of mass media, people continue to obtain some information through oral media. Even in the 21st century, despite the advanced communication methods enabled by new media and new data transmission technologies, direct word-of-mouth still plays a crucial role in the dissemination of information.

新媒体最为典型的代表是万维网,作为一种不断变幻的对话,它与古老的口传叙事之间存在着更多的类似之处。它不像大众传播媒介那样恒定和固化,而是允许人们在信息流中自我选择,对信息加以改变和回应,并和他人一起创造信息。这种做法和人们曾经在篝火旁、茶馆里、集市上分享故事、新闻和民谣的情形是一样的,分享的过程从来没有两次完全一致。随着听众的不同和讲述故事的氛围的变化,故事会被重塑、变形和调整,而听众从来也不是信息的简单接收者,而是参与性很高的共同创造者。
The most typical representative of new media is the World Wide Web. As a constantly changing dialogue, it has more similarities with ancient oral narratives. Unlike mass media, which is constant and fixed, it allows people to self-select, alter, and respond to information within the information flow, and to create information together with others. This practice is similar to how people used to share stories, news, and ballads around campfires, in teahouses, and at markets. The sharing process is never exactly the same twice. With different audiences and changing storytelling atmospheres, stories are reshaped, deformed, and adjusted. The audience is never just a simple receiver of information but a highly participatory co-creator.

从传播技术的角度来看,口传媒介和互联网的相似性要高于它们与大众媒介之间的相似性。然而,互联网毕竟是一种发展程度更高的传播媒介。如果将口传媒介视为一种被时间和空间条件严格限制的媒介,那么互联网则是一种借助信息技术完全打破了时间和空间条件限制的媒介。古代的口耳相传需要身体与身体的接近,其传播方式是单点对单点,在以往年代造谣生事能量相对有限;而网络传播把身体从地域之中解放出来,缩短了传播时速,扩大了传播范围,其传播的方式是单点对多点乃至多点对多点,大大改变了信息不对称的情况。网络传播所具有的即时、互动、匿名、缺乏过滤机制和跨国界等特性,使其成为谣言滋生蔓延的温床。
From the perspective of communication technology, oral media and the internet are more similar to each other than they are to mass media. However, the internet is ultimately a more advanced communication medium. If oral media is seen as a medium strictly limited by time and space conditions, then the internet is a medium that completely breaks these limitations with the help of information technology. Ancient word-of-mouth required physical proximity, with a single point-to-single point transmission method, limiting the energy for rumor-mongering in past eras. In contrast, internet communication liberates the body from geographical constraints, shortens transmission time, expands the transmission range, and changes the transmission method to single point-to-multipoint or even multipoint-to-multipoint, significantly altering the situation of information asymmetry. The characteristics of internet communication—immediacy, interactivity, anonymity, lack of filtering mechanisms, and cross-border nature—make it a hotbed for the breeding and spreading of rumors.

另外一种影响巨大的新媒体是手机短信。尽管中国的互联网普及率不断提高,但手机用户数仍然大大高于网民数量。由于操作简便、随时随地可以使用、接通率高、互动性好,再加上文化习惯上的原因,短信成为极为广泛的手机应用。 由于手机短信具有信息转发功能,奥尔波特等人所提出的“信息失真”在谣言通过手机的传播中被减到了最小,大众能够在短期内被统一动员。其次,短信传播效率高,许多短信可以直接在网上群发,使信息的扩散远远超过了传统的口耳相传的范围。第三,手机短信的传播途径沿着扩展了的人际传播网络进行,具有较强的说服性,而且由于发送效率增加,一个信息接受者可能收到多人发出的相同信息,增加了信息的感染性。
Another highly influential new media is mobile text messaging. Despite the continuous increase in internet penetration in China, the number of mobile phone users still far exceeds the number of internet users. Due to its ease of use, availability anytime and anywhere, high connection rate, good interactivity, and cultural habits, text messaging has become an extremely widespread mobile application. Because mobile text messaging has an information forwarding function, the "information distortion" proposed by Allport and others is minimized in the spread of rumors through mobile phones, allowing the public to be mobilized uniformly in a short period. Secondly, the efficiency of text message dissemination is high, and many text messages can be mass-sent online, making the spread of information far exceed the traditional word-of-mouth range. Thirdly, the dissemination of mobile text messages follows an expanded interpersonal communication network, which is highly persuasive. Moreover, due to the increased sending efficiency, a recipient of information may receive the same message from multiple people, increasing the infectiousness of the information.

经由新媒体的作用,谣言从经典传播模式(人与人之间的流言蜚语)裂变为网络模式,出现了新型的网络谣言。网络谣言往往发端于BBS讨论区、网站留言板、个人博客、即时通信和手机短信,但其起源通常无法查证,大部分谣言的信息来源不明,而网络特有的匿名作用,使得谣言来源不明的特性更加明显,上述的发端地可能也只是网络谣言传播的中继站。当网民和手机用户获知网络谣言后,基于不同的心理动机,除了利用网络媒体传播,也会通过人际传播的方式,将消息转告亲朋好友。如果网络谣言在网络上成为热门的讨论话题,可能成为大众媒体的报道对象,此时,网络谣言便从虚拟世界进入现实世界,成为新闻议题,许多不使用网络的人也可能得知消息,影响的层面更为扩大。由此可知,网络谣言的发展并非单一渠道传播,许多谣言都是多渠道传播。信息的发送方与接受方各自的人际网络产生交集,信息传播的速度爆炸性提高,而网络的快速传播,又反过来助长了谣言,使谣言如滚雪球一样越滚越大。
Through the role of new media, rumors have evolved from the classic communication model (gossip between people) to a network model, resulting in new types of online rumors. Online rumors often originate from BBS discussion areas, website message boards, personal blogs, instant messaging, and mobile text messages, but their origins are usually untraceable. Most rumors have unknown sources of information, and the anonymity unique to the internet makes the unknown origin of rumors even more apparent. The aforementioned originating places may only be relay stations for the spread of online rumors. When netizens and mobile phone users learn about online rumors, based on different psychological motivations, they not only use online media to spread the rumors but also pass the messages to friends and family through interpersonal communication. If online rumors become hot topics of discussion on the internet, they may become subjects of mainstream media reports. At this point, online rumors enter the real world from the virtual world, becoming news topics, and many people who do not use the internet may also learn about the rumors, further expanding the scope of influence. Therefore, it can be seen that the development of online rumors is not a single-channel dissemination; many rumors are spread through multiple channels. 其一,信息来源莫衷一是,缺乏民众公认的“权威发布”。很多事件在发生之后,都会出现两个截然相反的版本,例如,在杨佳袭警案中,上海警方出面否定民间版本,并很快抓获了在网上发布民间版本的苏州男子郏啸寅。过去几年轰动全国的数起因强奸(虐杀)妇女而引发的群体性事件中,民间版本都是无辜少女+强奸致死+官权掩盖,而官方版本都是家人拒绝+不明真相的群众+少数别有用心的人的煽动。无论从事件参与人数、持续时间、冲突剧烈程度、造成的影响看,瓮安事件都构成了这类事件中的“标本性事件”,但在瓮安事件平息之后,“许多人虽已不信网上‘谣传’,但也不愿看官方公布的‘真相’”。

In terms of the number of participants, duration, intensity of conflict, and impact, the Weng'an incident constitutes a "model event" of this type. However, after the Weng'an incident was quelled, "many people no longer believe the online 'rumors,' but they are also unwilling to accept the 'truth' released by the authorities."

其二,尽管在传递过程中,信息经过传递者和再传递者的添油加醋,可能出现许多不同的版本,但对一些特定群体,在一种相互加强及情绪渲染的谈话情境下,群体成员可能会产生群体思维(group think),坚信群体所讨论的内容是真实的,看法是正确的。由于这群人对于需要什么、信仰什么、期望什么都很明确一致,所以经过流传、增益、删减、润饰之后的版本虽然可能?同于原始版本,却非但?会淡化、弱化或歪曲该群体的共同目标和诉求,反而有助于提高该信息的可接受性。例如,当上海警方第一时间在苏州抓获郏啸寅后,曾公开就种种谣言进行驳斥,而这时马上就有人说郏啸寅造谣本身就是谣言。杨佳在一些论坛中继续被追捧为“大侠”、“当代武松”乃至“中国佐罗”。
Second, although during the transmission process, the information may be embellished by transmitters and retransmitters, resulting in many different versions, for certain groups, in a conversation context of mutual reinforcement and emotional rendering, group members may develop groupthink, firmly believing that the content discussed by the group is true and the views are correct. Because this group is very clear and consistent about what they need, believe in, and expect, the versions that have been circulated, enhanced, deleted, and embellished, although possibly different from the original version, do not dilute, weaken, or distort the group's common goals and demands. Instead, they help improve the acceptability of the information. For example, when the Shanghai police first arrested Jia Xiaoyin in Suzhou, they publicly refuted various rumors, but immediately someone said that Jia Xiaoyin's rumor-making itself was a rumor. Yang Jia continued to be hailed as a "hero," "modern-day Wu Song," and even "China's Zorro" in some forums.

其三,信息内容在传播过程中的扭曲剧烈而多样,但万变不离其宗,矛头总是指向政府、指向公安部门、指向司法不公和政治腐败。如哈尔滨发生的两起新媒体事件虽然事隔五年,但舆论的指向存在惊人的一致。2003年苏秀文驾驶宝马车撞死农妇事件中,肇事人具有强大官方背景的谣言在民间社会迅速散布,引发极为激烈的网络讨论与道德愤怒,在新浪网上的评论达23万条,突破了开站以来发帖评论之最。搜狐网也有20万条,网易共计18万条。而在2008年10月哈尔滨六警察伤人致死案中,舆论因传言一波三折:最初,当“六警察打死大学生”的报道见诸媒体时,舆论几乎是一边倒地谴责警察,同情“无辜”大学生。随后,当现场视频被公开,尤其是死者林松岭的所谓特殊家庭背景信息——“林父是房地产开发商”、“舅舅是高官”、“已被安排到人事局上班”、“开着奔驰”被传上网络,关于此案的舆情几乎发生了180度逆转,几乎淹没了对现场视频是否被剪辑的质疑,最终汇聚成一个鲜明的标题——“六提辖拳打林衙内”。而等到黑龙江省政府新闻办召开发布会,哈尔滨市公安局官员称网上传言不属实、死者林松岭家没有高官背景,社会心理再次向死者倾斜,要求严惩涉案警察的呼声又渐次高涨起来。可以说,在多起新媒体事件中,“权势人物与老百姓的对立”谣言模式一再复制并引发骚乱,绝非偶然。谣言的散布传播反映出一个重要的群体共识,那就是,公权机关长期的所作所为让公众产生了不安全感,在每一具体事件中,公众下意识地将公权机关的代表看做是为政不仁、滥用权力、惯于隐瞒真相的暴力实施者,而普通百姓则沦为被欺凌、被侮辱、被侵害的弱势者。

In the 2003 incident where Su Xiuwen drove a BMW and killed a peasant woman, rumors about the perpetrator having a strong official background quickly spread in civil society, sparking intense online discussions and moral outrage. Comments on Sina.com reached 230,000, breaking the site's record since its inception. Sohu.com had 200,000 comments, and NetEase had a total of 180,000 comments. In the 2008 incident where six Harbin police officers injured and killed a person, public opinion fluctuated due to rumors: initially, when reports of "six police officers beating a university student to death" appeared in the media, public opinion overwhelmingly condemned the police and sympathized with the "innocent" student. Later, when the on-site video was released, especially with the so-called special family background information of the deceased Lin Songling—"Lin's father is a real estate developer," "his uncle is a high-ranking official," "he was arranged to work at the personnel bureau," "he drives a Mercedes"—surfaced online, public opinion almost reversed 180 degrees, nearly drowning out doubts about whether the on-site video was edited. It eventually converged into a clear headline—"Six police officers beat Lin, the official's son." When the Heilongjiang Provincial Government Information Office held a press conference, and Harbin Public Security Bureau officials stated that the online rumors were untrue and that Lin Songling's family had no high-ranking official background, public sentiment shifted back towards the deceased, and calls for severe punishment of the involved police officers gradually increased. It can be said that in multiple new media incidents, the rumor pattern of "opposition between powerful figures and ordinary people" has been repeatedly replicated and caused unrest, which is by no means accidental. The spread of rumors reflects an important group consensus, that is, the long-term actions of public authorities have made the public feel insecure. In each specific incident, the public subconsciously views representatives of public authorities as violent enforcers who are unkind in governance, abuse power, and are accustomed to concealing the truth, while ordinary people are seen as the bullied, humiliated, and victimized underdogs.

其四,在“施暴者/受害者”对立模式中,谣言出现了新内容,即“性”主题的浮现。无论是贵州瓮安的李树芬,还是上海袭警案中的杨佳,谣传中的暴力行为一个是轮奸,一个是被殴打以致失去生育能力。这些谣言可以视作暴露了大众的集体无意识,如邓文初所说,谣言所传达的民众感受已经由“被欺凌”进入到“受侮辱”的层次。“在这种‘受侮辱’的民众‘想象’(姑且就算是想象吧)中,‘官民对立’的权力冲突已经转换为‘善恶对立’的道德冲突,在有的言论中,甚至转化为‘人兽对立’模式——只有畜生才干得出这样的事情!”在这样的绝对道德审判之下,人们对法律失望,对权力仇恨,对正义彻底失去信心。谣言作为社会舆论,其产生、接受与传播过程,也是群体共识的形成过程,当底层社会“被欺凌与受侮辱”的感觉成为一种广泛的共同感受、一种集体记忆的时候,每一次新媒体事件中,谣言都会引发大规模的抗议活动,就丝毫不足为奇了。
Fourthly, in the "perpetrator/victim" opposition model, rumors have introduced new content, namely the emergence of the "sex" theme. Whether it is Li Shufen in Weng'an, Guizhou, or Yang Jia in the Shanghai police assault case, the violent acts in the rumors are either gang rape or being beaten to the point of losing reproductive ability. These rumors can be seen as exposing the collective unconscious of the public. As Deng Wenchu said, the feelings conveyed by the rumors have shifted from "being bullied" to the level of "being humiliated." "In this 'humiliated' public 'imagination' (let's assume it is imagination), the power conflict of 'officials versus civilians' has transformed into a moral conflict of 'good versus evil.' In some statements, it has even turned into a 'human versus beast' model—only beasts could do such things!" Under such absolute moral judgment, people become disappointed with the law, hate power, and completely lose faith in justice. As social public opinion, the generation, acceptance, and dissemination of rumors is also a process of forming group consensus. When the feeling of "being bullied and humiliated" in the lower society becomes a widespread common sentiment and a collective memory, it is not surprising that every new media incident will trigger large-scale protests.

在新媒体环境下如何看待谣言 How to view rumors in the new media environment

中国的网民现有三亿之众,互联网已成为空前重要和普及的信息传播途径。此种情况下,谣言的传播速度和范围会越来越快、越来越广,这是中国互联网无法回避的一种未来趋势,也是政府部门和大众媒体必须面对的一个新课题。

In this context, the speed and scope of rumor spreading will become faster and wider, which is an inevitable future trend for the Chinese internet and a new issue that government departments and mass media must face.

对于政府来说,谣言作为一种非官方的表达,既是对社会稳定的潜在的威胁,又是观察民众态度和心理的有用的窗口。所以,面对谣言,执政者难免存在一种爱恨交织的心情,这也反映了政府的某种内在困境:一方面,它对允许公民就公共事务公开发表未经审查的意见十分警觉;另一方面,它极其渴望了解民众的所思所想。国家投入可观的资源监控自己的国民的心态和舆论,固然,这种监控有助于当局发现特定个人的不轨企图、不满表达和不法动作,但它更是为了从全体民众的信息汇聚中衡量民众的态度,并依此作出更好的反应。所以我们可以看到,政府不仅把任何与官方对现实的建构相悖的信息和评论都命名为“谣言”而实施强力打压,同时也大量提供信息试图重塑民众的态度和价值观,以期他们与官方保持一致。
For the government, rumors as an unofficial expression are both a potential threat to social stability and a useful window to observe public attitudes and psychology. Therefore, when facing rumors, rulers inevitably have mixed feelings, which also reflects a certain internal dilemma of the government: on the one hand, it is very vigilant about allowing citizens to publicly express opinions on public affairs without censorship; on the other hand, it is extremely eager to understand what the public thinks. The state invests considerable resources to monitor the mindset and public opinion of its citizens. While this monitoring helps the authorities detect specific individuals' malicious intentions, expressions of dissatisfaction, and illegal actions, it is more about measuring public attitudes from the aggregation of information from the entire population and responding better accordingly. 对于官方大众媒体而言,必须意识到,发生于网络时代的群体性事件,官权的封锁无法完全奏效,所以,敏感的大型公共事件发生后,总是最先现身于网络。如果官方媒体没有对这些事件作跟进式报道,当民间传言甚嚣尘上的时候,引发的不仅是人们对官方媒体的公信力的质疑,还有舆论对政府如何解决问题所造成的巨大压力。政府逐渐意识到,官方媒体还是要尽可能地起一个主要媒体渠道的作用,让人们能够了解到更多信息。这就是为什么在瓮安事件之后,新华社几乎是立即对骚乱进行了报道,这与以往在类似事件发生数日后才予以披露的做法形成了鲜明对比;瓮安当地官员在骚乱发生不到两天后就召开了新闻发布会,就此事给出他们的解释。

而处于弱势或体制外的反抗群体,也在一次次的新媒体事件中,懂得他们可以借助谣言在民间的传播速?和影响?,为己方营造有?的舆论环境,强化群体的抗争诉求。2007年年底,已经沉寂近半年的厦门PX项目突然出现转机,经过听证,最终确定迁址。最值得关注的不仅是项目的迁址,还有政府话语的变化。从春夏之交,厦门当地媒体“搬起石头砸自己的脚”的“文革”式的语句,到新年将近,厦门市政府副秘书长朱子鹭说出的那句耳熟能详的话:“我反对你的意见,但我誓死捍卫你说话的权利”,抗议者品尝到利用信息的巨大力量。短信,博客,BBS,QQ群……厦门人的一场网络总动员,让信息封锁完全失效。

第一,信息证实的危机越来越明显。网络发布的信息难以找到当事人或公正的第三方来加以证实,即便出现证实,证实的效果也取决于所证实之事的意涵,证实过程对模糊性的策略建构,以及信息接受者诠释这种证实的特定意愿。互联网舆论场成为各方利益必争之地,在中国,不仅商业利益对新闻和舆论的操控和冒充行为,多到让人熟视无睹,政治力量也学会了越来越娴熟地有意传达对自己有利的信息,近年来各地大力建设的网络评论员队伍,就是具体表现之一。瓮安2008年6月28日出事,6月29日,当地政府的事件应急指挥部成立,下设8个工作组,其中就有一个“政策舆论法规宣传组”,组长为贵州省委宣传部副部长周晓云。宣传组的主要任务是组织人员上网跟帖,“以贵州的媒体影响全国的舆论”。

Even when verification occurs, its effectiveness depends on the meaning of the verified matter, the strategic construction of ambiguity during the verification process, and the specific willingness of information recipients to interpret this verification. The internet public opinion arena has become a battleground for various interests. In China, not only is the manipulation and impersonation of news and public opinion by commercial interests so prevalent that it has become commonplace, but political forces have also become increasingly adept at intentionally conveying information that benefits them. The network of online commentators that has been vigorously built in recent years is a concrete manifestation of this. On June 28, 2008, an incident occurred in Weng'an, and on June 29, the local government's emergency response command center was established, with eight working groups, including a "policy, public opinion, and legal propaganda group," led by Zhou Xiaoyun, Deputy Minister of the Propaganda Department of the Guizhou Provincial Party Committee. The main task of the propaganda group was to organize people to post online comments, "using Guizhou's media to influence national public opinion."

可以说,中国互联网已经步入“丛林时代”,商业力量、政治力量、甚至草根网民自己的力量,都在这个平台上博弈,“哈尔滨六警察打死人”命案后的网络暗战就是最好的注脚。现实世界的扭曲,一度被认为在网络中可以得到有力的纠正,人们通过互联网发现真相。实际上,互联网正在变成一种舆论工具,被怀有各种目的的群体操纵和摆弄。
It can be said that the Chinese internet has entered a "jungle era," where commercial forces, political forces, and even grassroots netizens' own forces are competing on this platform. The online battle following the "Harbin six policemen beat a man to death" case is the best illustration. The distortions of the real world, once thought to be effectively corrected in the online world, are now being manipulated and exploited by groups with various agendas through the internet.

第二,当不同的消息源散发彼此矛盾的谣言时,整个社会的焦虑和恐惧会加深。谣言不是别的,是我们自身的回响,它反映的是一个社会的欲望、恐惧和痴迷。卡普费雷说:“到处弥漫的焦虑,或者失望,从来没有离开过社会,受到抑制、疏导和给予合法地位的仅仅是其表达之方式。它们首先体现在窃窃私语之中,如果条件合适的话,就会变成谣言。……谣言反复出现是城市、社会群体和国家持久混乱的标志。”(卡普费雷,1991:125)
Second, when different sources of information disseminate contradictory rumors, the anxiety and fear of the entire society deepen. Rumors are nothing but echoes of ourselves, reflecting a society's desires, fears, and obsessions. Kapferer said, "The pervasive anxiety or disappointment has never left society; only its modes of expression are suppressed, channeled, and legitimized. They first manifest in whispers, and if conditions are right, they turn into rumors... The repeated occurrence of rumors is a sign of enduring chaos in cities, social groups, and nations." (Kapferer, 1991:125)

在这种情况下,建立民意表达机制,以及各种利益的博弈机制,就不仅仅是一种向善治的推进,也是在推动整个社会的健康与福祉。如果一个社会不允许设立“出口”,特别是灾难性地缺少信息安全阀,那么,民众的焦虑与不稳心态对中国整个社会的安定都会构成重大威胁。以此观之,谣言在中国社会发展的这一极端反复出现也有其积极意义,它意味着国家由于这样那样的因素放松了惯常的管制、阻遏和疏导,使潜伏的东西不再受到抑制,得以表达出来。透过谣言的遭遇,我们能够直观地感受到一个健康社会跳动的脉搏。
In this case, establishing mechanisms for public opinion expression and various interest negotiation mechanisms is not only a promotion of good governance but also a push for the health and well-being of the entire society. If a society does not allow the establishment of "outlets," especially if it catastrophically lacks information safety valves, the anxiety and instability of the public will pose a significant threat to the stability of the entire society in China. From this perspective, the repeated extreme appearance of rumors in the development of Chinese society also has its positive significance. It means that the state, due to various factors, has relaxed its usual control, obstruction, and guidance, allowing latent issues to be expressed. Through the experience of rumors, we can intuitively feel the pulse of a healthy society.

第三,在一个高度媒介化和网络化的社会中,媒体呈现一种崭新的“融合文化”,在这种文化之中的谣言成为了“信息炸弹”。在互联网上产生的信息能够影响以其他形式出现的媒介内容生产;新媒体技术及其背后的商业价值都强调速度第一,核实信息的时间大大缩减,进入信息传播网络的人数以倍数激增;新闻的娱乐化,政治的营销化,公众对八卦新闻的追求,都帮助创造着戴扬和卡茨意义上的“新”媒体事件。毋需进行多少受众研究就可以知道,这种“信息炸弹”的影响是惊人的。在中国,当门户网站用可观的篇幅报道谣言,当知名论坛对某一谣言的评论盖起了宏伟的“高楼”,当源于网络的谣言登上“旧媒体”的大雅之堂,当某个政界或商界要人被迫花费时间和精力修复被损害的形象和人格,当丑闻把一些人从高高的位置上掀翻下马,我们就可以懂得民众赋予这些谣言以多大的重要性。
Thirdly, in a highly media-driven and networked society, the media presents a brand-new "fusion culture," in which rumors become "information bombs." Information generated on the internet can influence the production of media content in other forms; new media technology and its underlying commercial value emphasize speed first, greatly reducing the time to verify information, and the number of people entering the information dissemination network has multiplied; the entertainment of news, the marketing of politics, and the public's pursuit of gossip news all help create "new" media events in the sense of Dayan and Katz. Without much audience research, it is clear that the impact of such "information bombs" is astonishing. In China, when portal websites report rumors with considerable coverage, when well-known forums build grand "skyscrapers" of comments on a certain rumor, when rumors originating from the internet make it to the "elegant halls" of old media, when a political or business figure is forced to spend time and effort to repair a damaged image and reputation, and when scandals topple some people from high positions, we can understand how much importance the public attaches to these rumors.

正是为此,本文希望指出,谣言研究十分有必要超越传统的人际传播和大众媒介传播对谣言的旧认识,研究网络谣言提出的许多新命题,并以此探讨有关新的政治和社会关系的新思维。这之所以成为必要,是因为我们面对的新转折与之前相比,要复杂得多,危险得多,也激动人心得多。
It is precisely for this reason that this article hopes to point out that it is very necessary for rumor research to go beyond the traditional understanding of rumors in interpersonal communication and mass media communication, to study the many new propositions posed by online rumors, and to explore new thinking about new political and social relationships. This has become necessary because the new turning points we face are much more complex, dangerous, and exciting compared to before.

This construction of rumors reflects the collective beliefs of society, so discussing the issue of rumor distortion as before is meaningless because rumors are real.

Following their views, this article believes that rumors often appear as a form of social protest.

在中国许多学者的研究中,倾向于否定谣言中的真实性,从而将谣言定性为“虚构”、“捏造”、“毁谤”,其中甚至不乏动机判断。很显然,对谣言内涵的演变以及谣言在现实中发生的相关语境进行认真考察和研究,将有助于传播学者提示官方文本、主流思维之外的另类谣言观,解读特定历史时空中造谣、传谣的群体心态和社会氛围,描绘出更加多维度、多层次的历史图像。
In the research of many scholars in China, there is a tendency to deny the authenticity of rumors, thereby characterizing rumors as "fabrications," "inventions," and "slanders," often including judgments of motives. It is evident that a serious examination and study of the evolution of the connotation of rumors and the relevant contexts in which rumors occur in reality will help communication scholars reveal alternative views on rumors outside of official texts and mainstream thinking, interpret the group mentality and social atmosphere of rumor-making and rumor-spreading in specific historical contexts, and depict a more multidimensional and multi-layered historical image.
