The Hon’ble Court vide its order dated 26.03.2025 has issued comprehensive directions to the States and Union Territories for implementation of provisions of Drugs & Magic remedies Act (copy enclosed). One of the directions in the above stated order is as below: माननीय न्यायालय ने अपने दिनांक 26.03.2025 के आदेश के तहत ड्रग्स एंड मैजिक रेमेडीज एक्ट के प्रावधानों के कार्यान्वयन के लिए राज्यों और केंद्र शासित प्रदेशों को व्यापक निर्देश जारी किए हैं (प्रतिलिपि संलग्न)। उपर्युक्त आदेश में दिए गए निर्देशों में से एक नीचे दिया गया है:
“(iii) We direct the States to sensitize the police machinery through the Police "(iii) हम राज्यों को पुलिस के माध्यम से पुलिस मशीनरी को संवेदनशील बनाने का निर्देश देते हैं
Training Institutes in the States about the importance of the implementation of the provisions of 1954 Act and Rules framed thereunder.” 1954 के अधिनियम और उसके तहत बनाए गए नियमों के प्रावधानों के कार्यान्वयन के महत्व के बारे में राज्यों में प्रशिक्षण संस्थान।
It is pertinent to mention that the Drugs & Magic remedies (Objectionable Advertisement) Act, 1954 is a central Act which prohibits advertisements of drugs for certain diseases and conditions. Under Section 9A, an offence punishable under this Act shall be cognizable. यह उल्लेख करना उचित है कि ड्रग्स एंड मैजिक रेमेडीज (आपत्तिजनक विज्ञापन) अधिनियम, 1954 एक केंद्रीय अधिनियम है जो कुछ बीमारियों और स्थितियों के लिए दवाओं के विज्ञापनों पर प्रतिबंध लगाता है। धारा 9 ए के तहत, इस अधिनियम के तहत दंडनीय अपराध संज्ञेय होगा।

provisions of the Act in letter and spirit. A copy the Act and Rules framed there under is also enclosed with this letter. अधिनियम के प्रावधानों को अक्षरश लागू किया गया है। इस पत्र के साथ अधिनियम और उसके अंतर्गत बनाए गए नियमों की एक प्रति भी संलग्न है।
The Hon’ble Court has also directed that all coneerned Respondents fire their compliance affidavits/reports before the Court by the end of June 2025. You are requested to kindly take necessary action under intimation to undersigned so hat same may be reflected in the compliance affidavit. माननीय न्यायालय ने यह भी निर्देश दिया है कि सभी प्रतिवादी जून 2025 के अंत तक न्यायालय के समक्ष अपने अनुपालन हलफनामे/रिपोर्ट को जमा करें। आपसे अनुरोध है कि कृपया अधोहस्ताक्षरी को सूचना के तहत आवश्यक कार्रवाई करें ताकि अनुपालन हलफनामे में यह परिलक्षित हो सके।
