A Grid connection is part of the scope of supply and installation services. The Bidder shall be responsible for the costs of designing, procuring equipment for, and installing all interconnection facilities required for delivering the plant's electrical output to the proposed point of interconnection on electrical system, including any additional transmission lines that will be required to connect to the site, i.e. the transmission lines and extension at Medina substation. The important aspect of the grid connection is to coordinate with the 132 kV Makunduchi substation EPC Contractor as detailed previously.

The Bidder shall fulfil all applications, prepare the studies and testing procedures to complete the interconnection process. All costs associated with the electrical interconnection shall be borne by the Bidder. During the initial start-up phase, the Employer shall be invited to observe and verify the system's performance.

The Contractor should submit to the Employer / Engineer: drawings, design data, survey reports, samples, patterns, models, Operation and Maintenance Manuals, as may be called for therein, or as The Employer may reasonably require or as requested in the Detailed Technical Specifications.

The sequence of submission should be such that information is available for review of each document when it is received. The accepted date of documents is considered after receipt of the hard copies when registered at Administrative Office.

All drawings from the very first sent by the Contractor to the Employer should bear a serial number corresponding to a drawing classification plan to be agreed upon by the Contractor and the Employer.

Each document must have a uniform, unique document number, issue date, revision date, and revision status.

The diagrams, drawings, calculations, parts lists, instruction, and maintenance manuals for all phases mentioned below to be prepared for the project are to be supplied in English. The drawings should be supplied in AutoCAD format and submitted as Soft - and hard-copy (two copies to the Employer and two copies to the Consultant).

Before submitting any drawings for review, the Contractor should obtain the Employer / Engineer acceptance of the list of drawings he proposes to submit. The reviewed drawing list should include those components procured from others.

The civil drawings shall include all dimensions required for the execution of the civil work and excavation.

Final Documentation and As-Built Drawings

On completion of the entire project, all drawings should be updated by the Contractor to show the "As -Built" status and the drawings should be stamped As Built.

The Contractor should submit detailed progress reports. The reports should show clearly and accurately the position of all activities associated with design, material procurement, manufacture, QA activities, works tests, shipping, mobilization, site erection, testing and commissioning, health & safety, environmental and social issues with regard to the agreed contract Program.

The Contractor, who should state the action he is taking to effect completion of the contract Program, should detail any delay, which would affect the completion, testing and commissioning dates of any item of plant.

The Contractor should prepare a Final Report on the project, which should be submitted, to the Employer/Engineer not later than one month after the Certificate of Taking Over for the entire installations has been issued. Any delays, or expected delays, in design, manufacture or erection of equipment should be re-corded and its influence on the completion date should be explained in the reports.

The project construction duration is 12 months and 36 months for defect liability period i.e. initial operation period

The Bidder may propose a time schedule for implementation based on the program of work, which then should become part of the Contract. The Bidder should prepare his Program of Work in accordance with the conditions of the contract.

The Bidder's Program of Work should clearly show all major and important activities related to the project implementation, such as but not limited to site mobilization, surveys, studies, design, manufacture factory testing, delivery, civil work, erection, and commissioning. Quality Assurance

To ensure that the supply and services under the Scope of this Contract, whether manufactured or performed within the Contractor's works or at his subcontractors' premises or at sites or at any other place of work are in accordance with the Specification, Regulations and relevant authorized standards, the Contractor shall adopt suitable quality assurance programs and procedures to ensure that all activities are being controlled as necessary.

The Quality System, a document provided by the Contractor, should give a description of the quality system adopted by the Contractors for the Works. A quality assurance program of the Contractor shall cover, but not limited, to the following:

Quality Monitoring

The Employer / Engineer is entitled to perform Quality Inspections on the various parts within the scope of the Contract. The Contractor has to provide any assistance that is necessary concerning visa, traveling and lodging reservations. The Contractor should also arrange a health insurance to cover all medical costs that may be required for the inspection periods.

Quality Inspection Plan

The prime responsibility for inspection and testing rests with Contractor. Inspection reports should include as a minimum the contract identity, the name of inspector/tester, date of inspection/test, operation/inspection, technique used, acceptance standard, and acceptability.

The Employer/Engineer should inform the Contractor about additional information that may be required.

In case of rejection after unsuccessful inspection, all concerned supplies and services should be replaced by new in conformity with the Technical Requirements.

Prior to the issuance of each respective "Release Certificate" or agreement for shipping, of material and equipment, the Contractor should submit to the Employer/Engineer the requested copies of the completed Certificate of Conformity.

The Contractor should ensure that any Suppliers or Subcontractors appointed by them should conform to the requirements of the Bidding documents. Prior to the appointment of any Supplier/Subcontractor, the Contractor should ensure that their Quality Assurance arrangements comply with the requirements of ISO 9001:2015 or equivalent certificate and the hereby-mentioned Technical Requirements.

Employer's Supervision

To eliminate delays and avoid disputes and litigation to the Contract, all matters and questions should be resolved in accordance with the provisions of this document.

The manufacturing of the product should be carried out in accordance with the specifications. The scope of the duties of the Employer, pursuant to the contract, would include but not be limited to the following:

Monitoring by the Engineer

During the course of the Contract, the Engineer reserves the right to monitor the implementation of the Contractor's quality assurance arrangements.

The Engineer should monitor the Contractor's compliance with equipment, documentation, drawing, delivery, construction, installation, and commissioning schedules.

Monitoring may be done by means of a program of formal audits and/or surveillance of activities at the work locations. Where deficiencies requiring corrective actions are identified, the Contractor should implement an agreed corrective action program. The Engineer should be afforded unrestricted access at all reasonable times to review the implementation of such corrective actions.

The site engineers in charge reserves the right to monitor the subcontractors and the Contractor should ensure that all subcontracts include, and subcontractors are aware of this requirement.

Warranty

Maintenance of software and hardware of the system SCADA/EMS/OMS, Telecommunication, Substation Automation, Protection Relays as well for any supplied third-party products/components during the warranty shall be in conformance with the terms of the warranty sections of this Contract defined in General Terms and Conditions. Failed equipment shall be replaced or repaired, and spares inventories replenished to their delivered level throughout this period. Any spare parts found to be defective during initial delivery inspection or during the Warranty period shall be replaced within one week after notification. There shall be no charges to ZECO for these replacement parts, including delivery charges. All spare parts replaced under maintenance shall be new parts unless otherwise accepted by ZECO.

Maintenance and support after warranty

Bidder shall describe standard options available for maintenance support program. It is expected that the following basic maintenance support program components shall be covered in the Bidder’s offered maintenance program.

Bidder shall guarantee the availability of upgrades, technical support for all SCADA/EMS/OMS software, and announcements of software and hardware releases applicable to the SCADA/EMS/OMS for a period of ten (10) years after the expiration of the warranty. Subsequent to this minimum support period, Bidder and the SCADA/EMS/OMS software Bidders shall provide to ZECO a minimum of one (1) year's advance notice of their intent to terminate such support.

Licensing requirements

Bidder shall clearly identify in the proposal licensing requirements and associated pricing separately for all supplied software modules and programs including third party software Bidder shall provide a description of its licensing policies for all SCADA/EMS/OMS components depending on number of telemetered points, database elements, users, workstations, instances of applications. If Bidder supplied software has license restriction on the number of users, then ZECO’s preference is to have floating licenses for applications that have restrictions on the number of concurrent users. Bidder shall grant to ZECO a personal, non-exclusive, non-transferable, perpetual, irrevocable license to install and use the Software Products (including OEM vendor standard support, associated documentation and the results of any benchmark testing) upon acceptance of each SCADA/EMS/OMS Software Product/Component.

Tests and Arrangement

Type tests and Routine tests shall, unless otherwise specified, be carried out in accordance with the provisions of the Particular Specifications concerned. Four (4) copies of all test results shall be provided for analysing and recording purposes.

All equipment being supplied shall conform to Type tests as per Technical specification.

The Reports / Certificates for all the Type tests as per technical specification shall be furnished by the Bidder along with equipment / material drawings.

The Type tests conducted earlier should have been conducted in an accredited laboratory based on IEC Test standards.

In the event of any discrepancy in the test reports i.e. any test report not acceptable due to any design / manufacturing changes (including substitution of components) or due to non‐compliance with the requirement stipulated in the Technical Specification or any/all additional Type tests not carried out, same shall be carried out without any additional cost implication to the Employer.

One (1) copy of all tests results recorded during an inspection visit shall be handed to the Employer or his authorized representative(s) on that day. In addition, four (4) copies of the test certificates shall be required fifteen (15) days thereafter.

Factory Acceptance Tests (FAT)

Extensive Factory Acceptance Testing (FAT) shall be conducted on material and equipment incorporated in the works to verify that the equipment, material and parts have been manufactured to meet the requirement of technical specifications and that the various systems and assemblies as a whole function as specified. Successful factory tests release the parts, material, systems and equipment for shipment.
应对工程中包含的材料和设备进行广泛的工厂验收测试(FAT),以验证设备、材料和部件的制造符合技术规范的要求,以及各种系统和组件作为一个整体按规定运行。成功的工厂测试将放行零件、材料、系统和设备用于装运。
Shipment or release of the particular item shall not be granted in case there are major shortcomings in quality, functions or performance, or a large amount of smaller deficiencies. Instead, the Contractor shall be required to correct the system at factory, and thereafter re‐do the relevant factory tests.

The Contractor shall submit for approval the proposed Inspection and Test Plan at least two (2) months before the FAT.

After successful completion of FAT, the Contractor shall submit the completed and signed FAT records “For Information” if the tests have been witnessed by the Employer / Engineer, otherwise “For Approval”.

In the event that the inspection of any item is waived, test certificates shall still be required.

Tests shall be performed in accordance with a detailed test program prepared by the Contractor and approved by the Employer.

The Contractor shall prepare an Environmental and Social Management Plan for the project and his/her operations. The Contractor shall be responsible for injuries to trees and shrubs caused by his/her operations. If damage occurs, the employer shall determine the method of repair or treatment to be used for injured trees and shrubs as recommended by experienced experts at the expense of the Contractor.

Trees or shrubs that, in the opinion of the employer, are beyond saving shall be replaced and compensated. The replacements shall be the same species, or other approved species, and of the maximum size that is practicable to plant and sustain growth in the particular environment. In addition to replacement, the Contractor shall compensate the Owner of the trees.

The Contractor’s construction activities shall be performed by methods that shall prevent entrance, or accidental spillage, of solid matter, contaminants, debris, and other pollutants and wastes into streams, flowing or dry watercourses, lakes, and underground water sources. Such pollutants and wastes include, but are not restricted to, refuse, garbage, sanitary waste, oil and other petroleum products.

Preservation of Historical and Archaeological Data

The Contractor agrees that should he/she or any of his/her employees in the performance of this Contract discover evidence of possible scientific, historical, prehistoric, or archaeological data he/she shall notify the employer immediately giving the location and nature of the findings. Written confirmation shall be forwarded within 2 days. The Contractor shall exercise care so as not to damage artifacts or fossils uncovered during excavation operations and shall provide such cooperation and assistance as may be necessary to preserve the findings for removal or other disposition by the Employer.

Pesticides, Toxic Waste and Hazardous Substances

Pesticides include herbicides, insecticides, fungicides, rodenticides, pesticides, surface disinfectants, animal repellents, and insect repellents. Should the Contractor find it necessary to use pesticides in work areas of this Contract, he/she shall submit his/her plan for such use to the employer for written approval.

It is the responsibility of the Contractor to seek the required permissions to handle substances or compounds that are defined as hazardous, i.e. the Contractor must be up to date on the definitions and regulations pertaining to hazardous substances. Hazardous substances are also such as depletes the ozone layer.

Disposal of non-combustible materials shall be by burying, where burial of such materials is approved by the employer, or by removal from the construction area. Waste materials removed from the construction area shall be dumped at an approved dump site.

Only materials approved by the employer may be buried. Burial shall be in pits the location, size and depth of which shall be approved by the employer. The pits shall be covered by at least 0.6 Meter of earth material prior to abandonment.

Disposal of material by burning

All materials to be burned shall be piled in designated burning areas in such a manner as shall cause the least fire hazards and air pollution. Burning shall be thorough and complete and all charred pieces remaining after burning, except for scattered small pieces, shall be removed from the construction area and disposed of as otherwise provided in this Sub clause.

The Contractor shall, at all times, take special precautions to prevent fire from spreading beyond the piles being burned and shall be liable for any damage caused by his/her burning operations. The Contractor shall have available, at all times, suitable equipment and supplies for use in preventing and suppressing fires and shall be subject to all laws and regulations locally applicable for pre-suppression, suppression, and prevention of fires.

Disposal of material by removal

Material to be disposed of by removal from the construction area shall be removed from the area prior to the completion of the work under these specifications. All materials removed shall become the property of the Contractor.

Materials to be disposed of by dumping shall be hauled to an approved dump by a licensed waste handler. Polychlorinated Biphenyls (PCBs) are synthetic chlorinated organic chemicals and has following characteristics:

There are two options in relation to the management of PCB-contaminated equipment, namely decontamination and disposal. Decontamination is an operation by which the concentration of PCBs in fluids in equipment is reduced. For decontamination to be effective it should result in a residual total PCB concentration of at most 0.05% (500ppm) and ideally less than 0.005% (50ppm). Disposal is any operation by which PCBs and PCB-contaminated equipment is treated to destroy or irreversibly transform the PCB content.

PCB contaminated equipment storage should be in a building with an adequate roof and walls that is in a location selected to protect the PCBs from the possibility of release. Leaking equipment should be stored in metal drums with lids. Containment should prevent escape of PCBs into the environment through volatilization and containers should carry PCB marks with clear demarcation.

Occupational Health and Safety

The Contractor shall ensure, so far as is reasonably practicable, the health, safety and welfare at work of his/her employees including those of his/her sub-Contractors and of all other persons on the Site. The Contractor shall comply with the Occupational Health and Safety Act, the Public Health Act, the Worker's Compensation Act and other Statutory Regulations, rules and byelaws regarding occupational health, safety and gender. In this respect the Contractor shall liaise with the various local authorities.

Protective clothing, equipment etc.

This covers the provision of protective clothing and equipment, first aid stations with such personnel and equipment as are necessary and such information, instruction, training and supervision as are necessary to ensure the health and safety at work of all persons employed on the Works all in accordance with the Laws of Tanzania/Zanzibar. The Contractor shall provide, at his/her own expense, the protective clothing and safety equipment to all staff and labour engaged on the Works to the satisfaction of the Employer.

All employees shall be given training on how to ensure their own personal safety and on ways to reduce the accident risk on those sites where large, mobile heavy vehicles and equipment or equipment with moving parts are in use.

All the Contractor's personnel shall, before starting to work, have an induction course on safety and health at the site. The Project Manager shall take part in at least the first part of the training. He/she shall present the Contractor's safety policy and goal, the responsibilities and roles in relation to safety and health of all individuals, and the more specific responsibilities and roles of key staff (Site Manager, EHS Officer, Sociologist, engineers, foremen, and others).

A Safety Booklet written in English shall spell out the most important aspects of occupational safety and health. The Safety Booklet may take its starting point in the Contractor's general description of safety and health, but it shall be very specific for Contract works. The safety booklet shall be handed to all staff at the introduction course and used as training material. More training material might be relevant to use at the induction course.

Safe access

The Contractor shall provide and maintain access to all places on the Site in a condition that is safe and without risk of injury. The Contractor shall ensure that only pits for the number of poles that can be erected a day are excavated. This is to prevent children and animals accidentally falling into them. The Contractor shall be liable for any accident caused as a result of negligence and shall duly compensate the affected parties.

The Contractor shall provide adequate waterborne sanitation; and refuse collection and disposal, complying with the Laws of Tanzania to the satisfaction of the employer.

Control of harmful insects

The Contractor shall execute appropriate measures in consultation with the Public Health Authority to control within the construction site including the camp sites (where applicable), mosquitoes, flies and pests including the application of suitable chemicals to breeding areas.

Reporting of accidents and other criminal behaviour

Contagious diseases

The Contractor shall manage the risk of spreading contagious diseases (e.g. cholera, tuberculosis) through awareness raising programs, especially when workers come from outside the locality. The Contractor shall manage the risk of harassment and sexual assaults, especially for the female workers. The Safety Officer or Health Services shall inform the workers and the community about the danger of communicable diseases including those transmitted by insects, water, oral and sexual contact. The Contractor shall comply with Government regulations in case of epidemic outbreaks.

Grievance Redress Mechanism (GRM)

Partnerships between the Contractor and the local community leaders including but not limited to Local Council chairpersons, councillors and opinion leaders to form Grievance Redress Committees to quickly handle PAPs complaints at village level. The Grievance Redress Committees (GRCs) shall also work as early warning mechanisms to reduce complaints from PAPs and promptly check any likely social issues that may arise as a result of project activities and staff.

The Contractor’s Management Plan for HIV/AIDS and STI shall include details of the measures he/she proposes to adopt to combat the spread of HIV/AIDS and sexually transmitted Infections (STI) among their employees as well as within the project host communities.

This shall include display of relevant education materials in both English and local language. The Safety Officer or another of the Contractor’s staff may carry out the awareness training if qualified; otherwise an external service provider (e.g. from Hospital) may be hired to carry out the awareness training.

The deputed site managers should be employed of the contractor, in no way the site supervision should be delegated to the relevant subcontractors. Since the project concerns electrifications works where some parts could be under operation, a complete shutdown of the whole network is not possible. The necessary shutdowns have to be applied and discussed in advance with the Employer / the Engineer. Temporary connections shall be installed to minimize the sectional power supply out-ages. The Contractor shall, at his own expense, be responsible for all temporary connections to minimize the power supply outages.

The Earthing/Grounding System shall perform satisfactorily for the whole lifetime (20 years) without deterioration due to corrosion. It should continually maintain a low resistance to the ground, satisfy thermal stability, and be capable of carrying maximum anticipated full fault currents without deterioration and the material should be cupper.

Galvanizing

Galvanizing, where specified, or is a requirement of the design, such galvanizing shall be applied by the hot - dip process to the appropriate IEC or BS standards. i.e. Standard Code BS5493; protective coating of iron and steel structures against corrosion; ASTM A123 for structural steel and ASTM A153

The preparation for galvanizing and the galvanizing process shall not affect the mechanical properties of the material being coated.

Drilling, punching, cutting, removal of burrs and all machining shall be completed before galvanizing.

The zinc coating shall be smooth, clean and of uniform thickness and free from defects. The preparation for galvanizing and the galvanizing itself shall not adversely affect the mechanical properties of the coated material.

All galvanized steel, which has been cut, drilled or worked on site, shall be painted with an approved zinc rich paint.

Given the hot and humid environmental conditions, the minimum zinc coating thickness shall be 90 microns (equivalent to approximately 640 g/m²) for all surfaces, except steel wires, bolts and nuts. Galvanizing shall be tested in accordance with the appropriate IEC or equivalent standards in order to determine that it complies with this requirement.

All bolts and screwed rods for the connection of galvanized steel parts shall be galvanized including the threaded portion (s) to a minimum average coating weight of 305g/m2 or 43 micron thickness. The threads of all bolts and screwed rods shall be cleared of spelter by spinning or brushing. A die shall not be used for cleaning the threads unless specially approved by the Employer / Engineer. All nuts shall be galvanized. White rust formation subsequent to galvanizing must be inhibited using an approved inhibitor applied according to the manufacturer's instructions.

Surfaces in contact with oil shall neither be galvanized nor cadmium plated, unless finished with oil resisting varnish.

Material on which galvanizing has been damaged shall be re-dipped unless; in the opinion of the Employer / Engineer the damage is local and can be repaired by applying a coat of galvanizing repair paint. Where such repair is authorized, the damaged area shall be cleaned by wiping with clean rags saturated with mineral spirits or xylene followed by wire brushing. After wire brushing, the area shall be re-cleaned with solvent to remove residue and shall be given a minimum of two coats of zinc rich paint in accordance with the manufacturer's instructions.

Labels and Name plates

All apparatus, plant and equipment shall be clearly and permanently labelled in English, to the approval of the Employer. They shall be of suitable size as to be readable at normal operating positions.

The Contractor shall submit for approval to the Employer, details of the labels indicating the identification and the type of label being supplied prior to the labels being ordered.

Packing of Material

These steps may constitute the greasing on surfaces, the application of a protective coat, enclosure of the items in a hermetically sealed container, the addition of vapour phase inhibitor paper to the package, or other approved means.

Cases shall be marked with large lettering to show which side up the case is to be, and, if the contents are fragile marked "FRAGILE" in large letters with the international wine glass symbol. Packages shall be marked with their place of destination in such a way that rough handling or the effect of weather cannot remove or obliterate the marking. Each item shall be marked with its gross weight, and for all lifts over two tons, marks on the cases shall show where the weight is bearing, and the correct positions of the slings.

The cases shall, whenever possible, be packed so that they can safely be placed on the ability of those who shall handle the cases to read written or understand pictorial instructions. Cases that have to be slung in a certain way shall, as far as possible, be so constructed that they cannot conveniently be slung in any other way and packages shall preferably be so large that they cannot be easily rolled over or thrown about; thus when practicable small cases shall be crated together to form one larger one. Crates shall be sufficiently strong to be capable of being slung from the outside even when provision is also made for slings to be attached direct to a major article inside.

Special steps shall be taken to guard against theft during transport. No small items, such as padlocks, nameplates and so forth, which could be torn off or unscrewed, shall be accessible. Cases, crates, barrels and drums shall be banded in such a manner as to obstruct the theft of any of the timber used for packaging, and the bands shall be so secured that they are not rendered ineffective by shrinkage of the wood.

A descriptive and fully itemized list shall be prepared of the contents of each packing case. A copy of this list shall be placed in a waterproof envelope under a metal or other suitable plate securely fastened to the outside of one end of the case, and its position indicated by stencilling on the case. Where appropriate, drawings showing the erection markings of the items concerned shall be placed inside the case.

Shipping marks are to be stencilled in oil based paint in block letters and symbols. When unobstructed flat smooth surfaces of sufficient size are not available on the case for the shipping marks they are to be stencilled on marine-ply notice boards of adequate size and of at least 6mm thickness securely fastened to the packing case.

Shipment

The Contractor shall, at its own risk and expense, ship and transport all the Plant and Equipment to the Site in an expeditious and orderly manner. The Contractor’s tasks include any formalities for customs clearance in accordance with applicable GCC Clauses. The customs clearance agent used by the Contractor shall be subject to the Employer’s approval.

The Contractor shall notify the Employer of dispatch of each shipment by submitting the Notification of Shipment (NOS) form by facsimile or by e-mail.

The required number of originals and copies of Shipping Documents shall be informed to the Contractor at the kick-off meeting. It is advisable that at shipment, the Contractor forwards an advance copy of the shipping documents so as to enable the Employer carry out some lead preparatory works before the arrival of the equipment. This way the clearing time may be lessened.

Upon receipt of an item on Site, the Contractor and the Employer shall visually inspect the shipment. A Delivery Note (DN) shall be prepared by the Contractor and confirmed by the Employer. The format of the Delivery Note shall be presented to the Contractor during the kick-off meeting of the Contract.

Normally one DN and associated Payment Certificate shall be prepared for each shipment, although the items of the shipment may have been transported to different sites.

Site Handling and Storage

Plant shall be protected during site handling and storage against loss, corrosion, weather damage, deformation or distortion and contamination by dirt.

Parts on which the final alignment and running clearances of the equipment depend shall be adequately blocked and protected to prevent distortion during storage, handling and erection.

If the equipment is received at the site before it can be erected, the whole equipment, as packed, shall be stored in a clean and protected place.

For the duration of work on site, the Contractor shall provide covered storage facilities, weatherproof shelters, loading and unloading facilities as required for the works.

All deliveries within the Contract shall be checked and any discrepancies noted and reported to the Employer. Lost items shall be replaced. Damaged items shall be replaced, or repaired if permitted by the Employer, to conform to the Specifications.

Transports to Port of Embarkation, Loading and Unloading

The Contractor shall arrange and provide for the transport of materials, equipment and plant components from the manufacturer's premises to the port of embarkation. The Contractor shall assign special personnel to supervise the transport, loading and unloading of materials, equipment and plant components. They shall use due skill and care in the performance of transport, loading and unloading of these materials and equipment.

Overseas Transport

The Contractor shall be responsible for transportation of all imported materials all the way from the manufacturers’ premises to the project site. Overseas transport media as well as for the whole transport period.

Local Transport

The Contractor shall be responsible for the local transportation of all materials and equipment from the port of disembarkation to the works site, unloading and storage at site. Any damages arising out transportation of equipment and materials to the projects site shall be to the Contractor’s account.

Damage to Equipment

The Contractor shall submit Receiving cum Damage Reports (RCD-Report) to the Employer/Engineer to cover each individual shipment received. On arrival at Site, all material and equipment shall be unloaded, opened and carefully inspected prior to incorporation in the projects, reject material and equipment for which no acceptance certificate can be provided and not being in compliance with the specification. The counter signature of the Employer/ Project Manager does not release the Contractor from his responsibilities of the Contract. In case of any damages to material/ and/or equipment, the Contractor shall immediately submit a Damage Report countersigned by the Employer/Engineer to the insurance company with copies to the Employer/Engineer. Where damage has occurred in marine transportation, a copy of the Damage Report shall also be sent to the registered/appointed surveyor.

In all cases of irreparable damage, the Contractor shall immediately notify the relevant manufacturer for renewed manufacture and replacement of the damaged part (s). He shall also immediately notify the Employer/Engineer of the actions he is going to undertake in order to repair or replace the damaged part (s) and of the consequences this damage shall have on the completion date of the plant.

Performance and Erection of the Works

The Contractor shall be responsible for scheduling and carrying out works.

The Contractor shall maintain up-to-date copies of and instruction book, approved designs and drawings, and specifications.

Unloading and Storage at Site
现场卸载和储存
The Contractor shall unload all equipment and material at Site from trucks and trailers and delivery vehicles as the case may be. All sites for storage of equipment and materials shall be agreed beforehand with the Employer / Engineer. Storage methods shall be such as to cause minimum inconvenience to the public and shall be arranged in a manner that facilitates unencumbered inspection and withdrawing of materials from stores. In general, no equipment or materials shall be stored directly on the ground to avoid contact with soil or water.
承包商应在现场从卡车、拖车和运输车辆上卸下所有设备和材料(视情况而定)。所有设备和材料的存放地点应事先与业主/工程师达成一致。储存方法应尽量减少对公众造成的不便,并应便于检查和从仓库中取出材料。一般情况下,不得将设备或材料直接存放在地面上,以避免与土壤或水接触。
All packing shall become the property of the Employer as soon as the equipment and material, which is contained therein is delivered to Site.

Safety Measures

The Contractor shall be responsible for the safety of all employees and other persons entering the works and shall, at his own expense (where not otherwise stated) and to the approval of the Employer take all measures necessary to ensure their safety. Reference in these respects is made to the Conditions of Contract, however, in general such measures shall include, but not be limited to, the following:
承包商应负责进入工程的所有雇员和其他人员的安全,并应自费(如无另行说明),经业主批准,采取一切必要措施确保其安全。在这些方面参考合同条件,但一般而言,此类措施应包括但不限于以下内容:
Provision of proper safety and emergency procedures and regulations in terms of fire, gas leakage and electric shock prevention as well as of provision of stretchers and first aid boxes together with general rescue facilities. The procedures and regulations shall be place of work specific;

Safe shoring and fencing of excavations;

Provision of efficient safety helmets for all personnel;

Provision of safety shoes, glasses, belts and other protections adapted to the risks encountered. Without compromising safety standards, women should be consulted on the most appropriate choice. Safety wear for women should take into account convenience, ease of use and general appropriateness. e.g robust but lighter boots for women and two-piece overalls instead of the traditional joined ones;
提供安全鞋、眼镜、安全带和其他适合所遇到风险的保护措施。在不影响安全标准的情况下,应就最适当的选择征求妇女的意见。女性安全服应考虑方便、易用和一般适当性。例如,为女性提供结实但较轻的靴子,以及两件式工作服,而不是传统的连体工作服;
Provision and maintenance of suitable lighting to provide adequate illumination of the works with appropriate spares especially in potentially risky places such as places of convenience for both women and men;

Provision of good and safe access to any part of the works;

Provision of notices written in English and local language to be erected at points likely to be used by the public, which shall warn the public of the existence of the works. These notices shall be in addition to any statutory requirements demanded from the Contractor;

The Contractor shall submit detailed proposals of how he intends to fulfil the above requirement for the approval of the Employer. Once the procedures and regulations have been approved and before the works commence, the Contractor shall distribute copies of the same in English and the local language commonly used in the region to all their employees and to the Employer;

The Contractor shall train all his employees in safety aspects including first aid training and shall ensure that they are fully conversant with the regulations, emergency and rescue procedures, etc., and moreover, shall enforce the rule that any Employee committing a serious breach of such regulations shall be instantly dismissed and shall not be reemployed.
承包商应对其所有员工进行安全方面的培训,包括急救培训,并应确保他们完全熟悉法规、应急和救援程序等。并对严重违反本规定的劳动者,实行立即开除,不得重新录用的规定。
