(二)產業用地(一):雲林縣台西鄉新興段 286-10 地號及 286-11 地號等 2筆土地(以下簡稱本區土地),至其規劃坵塊及面積如下表所示,實際面積以地政機關實測面積為準,位置標示及坵塊劃分詳附圖 1,填地高程詳附圖2。
(b) Industrial land (1): 2 lots of land (hereinafter referred to as the land in this area), including Lot 286-10 and Lot 286-11 in the Xinxing section of Taishi Township, Yunlin County, with the planned hillocks and areas as shown in the table below, with the actual areas based on actual surveys conducted by the land administration authorities, the location markers and hillock delineation detailed in Attachment 1, and the elevation of the landfill detailed in Attachment 2. The elevation of the reclaimed land is shown in Figure 2.

(三)本區土地之出租依經濟部工業局(以下簡稱工業局)規劃開發圖說辦理,並依規劃坵塊按現況(不再施作公共設施)受理申請,申請人於提送申請文件前,應先行赴現場勘查,不得要求工業局辨理分割及增設任何
(c) The leasing of land in this area is handled in accordance with the planning and development plans of the Industrial Development Bureau (hereinafter referred to as the Bureau) of the Ministry of Economic Affairs, and applications are accepted in accordance with the planning of the hillocks in their current condition (no longer used for public facilities). (四)本區土地之申請案件依每一坵塊個別受理,即每一坵塊之申請案件皆應檢齊本公告及本區土地出租須知規定之申租時應提之書件及興辦事業能力計畫書。惟申請承租本區土地不以一坵塊為限。
(d) Applications for land in the district are processed on a hillock-by-hillock basis. In other words, each application for land on a hillock must include the documents required by this announcement and the Guidelines for Leasing Land in the District, as well as a plan for establishing a business. However, applications to lease land in the district are not limited to one hillock.
二,土地租金,擔保金,預繳2年租金及營業稅  II. Land rent, security deposit, prepayment of 2 years' rent and business tax
(一)土地租售價格由工業局依產業創新條例第46條規定審定,並自審定土地開發成本利息結算基準日之次日起按月加計開發成本利息。至土地租金按年租金率 1.4 % 1.4 % 1.4%1.4 \% 計列,中華民國108年12月31日前租金詳如下表所示。
(a) The land rental and sale price shall be determined by the Industrial Development Bureau in accordance with Article 46 of the Industrial Innovation Ordinance, and the interest on the development cost shall be added on a monthly basis starting from the day following the base date of the determination of the interest on the development cost of the land. The land rental is calculated based on the annual rental rate 1.4 % 1.4 % 1.4%1.4 \% , and the rental before December 31, 2008 is detailed in the following table.

(二)申請人承租本區土地應繳價款包含租金,擔保金,預繳 2 年租金及營業税:
(b) The price to be paid by the applicant for the lease of land in this district includes rent, security deposit, prepayment of rent for 2 years and sales tax:
1.第1年租金為簽約繳款當月之土地售價按年租金率 1.4 % 1.4 % 1.4%1.4 \% 計算。
1. The first year's rent shall be calculated at the annual rental rate of 1.4 % 1.4 % 1.4%1.4 \% , based on the land price in the month of signing and payment.

第2年起據以計算租金之售價逐年於契約簽訂日之相當日,按最近一期行政院主計總處公布之消費者物價指數調整幅度比率調整之。
From the second year onwards, the rental price shall be adjusted annually at the rate of the consumer price index published by the General Accounting Office of the Executive Yuan on the equivalent date of the contract signing date.
適用「擴大投資方案-工業區土地出租優惠方案」,申租案件2年内或經「經濟部工業局產業園區土地或建築物租售審查小組」審查會核定之計畫期程內按核定計畫取得電業執照(或再生能源發電設備登記)者,即享有前 2 年免土地租金之優惠。
Under the "Investment Expansion Program - Industrial Park Land Rental Promotion Program", those who obtain an electric license (or registration of renewable energy power generation equipment) within 2 years of the lease application or within the project period approved by the "Examination Group on Rental and Sale of Land or Buildings in Industrial Parks, Bureau of Industry, Ministry of Economic Affairs" will be entitled to the first 2 years of the land rental waiver.
2.各期應繳租金,按繳款當期調整後之租金重新計算。
2. The rent payable for each period shall be recalculated on the basis of the adjusted rent for the period in which the payment is made.

3.擔保金按 6 個月租金同額計算,於租約終止且無違約須扣除擔保金之情形者,全額無息退還。
3. The security deposit shall be calculated on the basis of 6 months' rent and shall be fully refunded without interest upon termination of the tenancy agreement without any breach of contract requiring deduction of the security deposit.
4.申請人於簽訂土地租賃契約時應預繳 2 年租金(按簽約時審定月租金 × 12 × 12 xx12\times 12 個月 × 2 × 2 xx2\times 2 年),依規定按核定計畫取得電業執照(或再生能源發電設備登記)者,即享有前 2 年免土地租金之優惠,以現金繳納之 2年租金可抵繳第 3 年,第 4 年租金,或申請無息退還。
4. The applicant shall pay 2 years of rent in advance (based on the monthly rent × 12 × 12 xx12\times 12 months × 2 × 2 xx2\times 2 years as determined at the time of signing the land lease) at the time of signing the land lease, and if the applicant obtains the electricity license (or registration of renewable energy power generation equipment) according to the approved plan, the applicant will enjoy the privilege of exempting the rent of the land for the first 2 years, and the 2 years' rent paid in cash may be credited to the rent of the third year, the fourth year, or applied for a non-interest-free refund.

(三)實際應繳價款以服務中心繳款通知指定簽約繳款當月之價額為準。三,出租對象及限制
(c) The actual price to be paid shall be based on the price of the month in which the Service Center's payment notice specifies the signing of the contract for payment. Rental Targets and Restrictions

(一)本區土地以出租供商號,法人,政府依法設立之事業機構,電業籌備處從事工業園區各種用地用途及使用規範辦法第 3 條電力供應業規定之使用為限,並應符合本區土地容許引進產業項目之規劃使用。至本區土地容許引進產業項目如下表所示。
(a) The land in this zone shall be leased for use by firms, corporations, government agencies established by law, and the Electricity Preparatory Office in accordance with Article 3 of the Regulations on the Use of Various Types of Land in Industrial Parks for Electricity Supply, and shall be used in conformity with the land use plan for the industrial projects permitted to be introduced in this zone. The following table summarizes the permitted industrial projects in the region.

備註:1.本表產業項目第1,2項應符合「再生能源發電設備設置管理辦法」之相關規定。
Remarks: 1. Items 1 and 2 of this table shall comply with the relevant provisions of the "Administrative Measures for Renewable Energy Power Generation Facilities".

2.本區土地應設置太陽光電發電設備,不得單獨設置風力發電設備(即不允許僅設置風力發電設備),倘申請人有需求,可規劃太陽光電發電設備及風力發電設備併用。
2. The land in this zone shall be equipped with solar electric power generation equipment and shall not be equipped with wind power generation equipment alone (i.e. only wind power generation equipment is not permitted), but if the applicant has the demand, solar electric power generation equipment and wind power generation equipment can be planned to be used together.

(二)申請人以電業籌備處名義申請者,並應符合下列實收資本額及發電設備累積設置容量之規定:
(b) If the applicant applies in the name of the Electricity Preparatory Office, the applicant shall meet the following requirements for paid-in capital and accumulated installed capacity of power generation equipment:
1.電業籌備處發起人之一持股比例達 50 % 50 % 50%50 \% 以上,且實收資本額達新台幣 3 億元以上或籌備處之自有資金達新台幣 3 億元以上。
1. One of the promoters of the Electricity Preparatory Office has a shareholding ratio of 50 % 50 % 50%50 \% or more, and the paid-in capital is NT$300 million or more, or the Preparatory Office has its own capital of NT$300 million or more.
2.電業籌備處發起人中持股比例達 30 % 30 % 30%30 \% 以上者,其現持有之發電設備累積設置容量達2,000峰瓦(kWp)以上。
(2) If the shareholding ratio of the promoter of the Electricity Preparation Office reaches 30 % 30 % 30%30 \% , the cumulative installed capacity of the power generation equipment currently held by the promoter reaches 2,000 kWp or more.
四,申租權利轉讓及使用限制  Transfer of Tenancy Rights and Restrictions on Use
(一)承租土地之租期以年為單位,首次承租者,最低不得少於 6 年,最高不得超過20年。
(a) The lease term of the leased land is based on years. For the first time, the minimum lease term shall be not less than 6 years and the maximum lease term shall not exceed 20 years.

(二)申請人應自簽訂租賃契約之日起 2 年內或經「經濟部工業局產業園區土地或建築物租售審查小組」審查會核定之計畫期程内按核定計畫取得電業執照(或再生能源發電設備登記)後即享有前 2 年免土地租金之優惠,以現金預繳之 2 年租金可抵繳第 3 年,第 4 年租金,或申請無息退還。申請人未依期限按核定計畫取得電業執照(或再生能源發電設備登記),以現金繳納之 2 年租金視同繳納第 1 年,第 2 年之租金,以銀行保證書,銀行可轉讓定期存單設質者,得依約追繳前 2 年之租金,即不得享有前 2 年免租金之優惠,且工業局得終止租賃契約收回
(b) The applicant shall obtain an electric license (or registration of renewable energy power generation equipment) within 2 years from the date of signing the lease agreement or within the project period approved by the "Examination Group on Rental and Sale of Land or Buildings in Industrial Parks, Bureau of Industry, Ministry of Economic Affairs, Taiwan" and enjoy the first 2 years of free land rent. The 2 years of rent paid in cash can be credited to the 3rd and 4th years of rent or applied for a non-interest-bearing refund. (c) If the applicant is engaged in a business that is recognized by the Environmental Protection Administration, Executive Yuan, as a business that should be subject to environmental impact assessment in accordance with the "Detailed Environmental Impact Assessment and Criteria for Environmental Impact Assessment of Development Activity" and its related regulations, or if the applicant is recognized by the Ministry of the Interior as being subject to the application for a permit to develop a specific area along the coastline in accordance with the "Coastal Management Law" and its related regulations, the applicant should complete the relevant procedures (including submission of applications for examination) in accordance with the requirements within one year from the date of the signing of the land lease agreement. If the application is rejected, the application shall be submitted for review and completion within 1 year from the date of rejection.
且須於前開各中央主管機關審查通過之日起 2 年内或經「經濟部工業局產業園區土地或建築物租售審查小組」審查會核定之計畫期程内按核定計畫取得電業執照(或再生能源發電設備登記),即享有前2年免土地租金之優惠,以現金繳納之 2 年租金可抵缴第 3 年,第 4 年租金,或申請無息退還。倘申請人未依期限按核定計畫取得電業執照(或再生能源發電設備登記),以現金繳納之 2 年租金視同缴納第 1 年,第 2年之租金,以銀行保證書,銀行可轉讓定期存單設質者,得依約追缴前 2 年之租金,即不得享有前 2 年免租金之優惠,且工業局得終止租賃契約收回土地。
If the applicant obtains an electric license (or registration of renewable energy power generation equipment) within 2 years from the date of examination and approval by the central government authorities or within the project period approved by the "Examination Group on Rental and Sale of Land or Buildings in Industrial Parks, Industrial Development Bureau, Ministry of Economic Affairs," the applicant will be entitled to the first 2 years of land rental exemption, and the 2 years of cash rent can be credited against the rent for the third and fourth years, or applied for a non-interest-bearing refund. If the applicant fails to obtain an electricity license (or registration of renewable energy power generation equipment) within the approved time limit and according to the approved plan, the two years' rent paid in cash will be treated as the first year's and the second year's rent, and the applicant will be entitled to recover the rent for the first two years in accordance with the agreement if the applicant has a bank guarantee and a bank transferable time deposit certificate, which means that he/she will not be entitled to the first two years' rent-free privilege and the Industrial Development Bureau may terminate the lease agreement to recover the land.
依前開及其他相關法令進行之各項作業所需費用由申請人自行負擔。
The applicant is responsible for the costs of all operations carried out in accordance with the preceding and other relevant laws and regulations.
倘申請人放樜承租或未於規定期限内按核定計畫取得電業執照(或再生能源發電設備登記),且經工業局終止租賃契約收回土地時,申請人應承諾配合辦理申請撤回或廢止本環境影響評估案。
In the event that the applicant withdraws the lease or fails to obtain an electrical license (or registration of renewable energy generating equipment) within the required time period in accordance with the approved plan, and the land is repossessed by the Industrial Development Bureau upon termination of the lease, the applicant shall undertake to cooperate in withdrawing or abrogating the application for this EIA.

(四)申請人經強化使用,惟於期限内仍未能按核定計畫取得電業執照(或再生能源發電設備登記)者,有不可歸責之原由時,得依經濟部工業局訂定之「經濟部工業局產業園區個案開發期程限期改善作業原則」協處。
(D) If the applicant has been intensified in use, but still fails to obtain an electric license (or registration of renewable energy power generation equipment) within the time limit according to the approved plan, and there are reasons that cannot be attributed to the applicant, the applicant may be dealt with in accordance with the "Principles for Improvement of Operation Periods for Case Development in Industrial Parks, Industrial Development Bureau, Ministry of Economic Affairs, Taiwan".

(五)申請人承租之土地不得設定地上權。   (e) The land leased by the applicant shall not be subject to the creation of a right to land.
(六)申請人不得將承租土地全部或一部轉租,出借或以其他方式供他人使用。
(f) The applicant shall not sublet, lend or otherwise make available all or part of the leased land for the use of others.

)申請人不得將興建之建築物及設施全部或一部移轉,出租,出借或以其他方式供他人使用。
( ) The applicant shall not transfer, lease, lend or otherwise make available for use by others all or any part of the buildings and facilities to be constructed.
五,受理申請時間,地點,程序及應備文件  Time, place, procedure and documents to be prepared for accepting applications
(一)受理申請時間:自108年11月25日起(例假日除外),每日上午9時至下午5時,可分別向公告事項之指定地點(或網站)領取(或下載)申
(a) Application Acceptance Period: Starting from November 25, 2008 (except public holidays), applications can be obtained (or downloaded) from the designated place (or website) of the announcement respectively from 9:00 a.m. to 5:00 p.m. daily.
請書表及出租手冊。  Request Form and Rental Brochure.
(二)申請人應備文件內容及份數,請參閱本區土地出租須知之規定,另投資計畫書内容除服務中心提供之表格外,並請參閱本公告事項之評核項目另行製作「興辦事業能力計畫書」(1式15份,内容包含項目請参閱本區土地出租須知),以供評選参考。
(b) For the contents and number of documents to be prepared by the applicant, please refer to the regulations in the Notes on Land Leasing in this district. In addition to the form provided by the Service Center, please refer to the "Plan for Establishment of Business Capacity" (15 copies in 1 form, including the project content, please refer to the Notes on Land Leasing in this district), which is prepared separately for the evaluation of the items in this announcement, for the reference of the selection process.

(三)應繳納按申租土地年租金 3 % 3 % 3%3 \% 計算之保證金。請向指定行庫:臺灣銀行斗六分行;户名「產業園區開發管理基金-雲林離島中心 455 專戶」,帳號「031036070525」,繳納取據,並黏貼於應備文件之保證金憑證影本黏貼單。
(c) A security deposit calculated on the basis of the annual rent of the land applied for 3 % 3 % 3%3 \% shall be paid. Please pay the receipt to the designated bank: Bank of Taiwan, Douliu Branch; account name "Industrial Park Development Management Fund - Yunlin Outlying Island Center 455 Special Account", account number "031036070525", and paste it onto the photocopy of the security deposit certificate.

(四)自108年11月25日起至108年12月24日止(例假日除外),每日上午 9 時至下午 5 時,在公告事項指定一地點同時受理申請;通訊申請恕不受理。
(d) Applications will be accepted concurrently from 9:00 a.m. to 5:00 p.m. every day from November 25, 108 to December 24, 108 (except public holidays) at the place designated in the Notice; applications by correspondence will not be accepted.

(五)出租作業程序   (v) Procedures for renting out a business
1.出租作業採二階段辨理:   1. Rental operations follow a two-stage process of discernment:
(1)第一階段:資格審查   (1) Phase I: Eligibility check
申請案件由服務中心收件初審,於文件齊全,資格符合後,再轉送工業局評選及審查。
Applications will be received by the Service Center for initial review, and will be forwarded to the Industrial Development Bureau for selection and review after all documents are complete and eligibility criteria have been met.

(2)第二階段:工業局擇日召開評選委員會,依每一坵塊申請案件之興辨事業能力計畫書綜合考量進行評核。至其相關規範如下所示。
(2) Stage 2: The Industrial Development Bureau will convene a selection committee on a specific day to evaluate each hillock application based on a comprehensive evaluation of the proposal for the development of the hillock's business capacity. The relevant regulations are set forth below.

申請人平均分數達 70 分者始取得承租資格。惟同—坵塊有 2 以上申請人同時申請承租之案件,除平均分數須達 70 分,並擇優錄取。
Applicants with an average score of 70 points are eligible to apply for a lease. However, if more than two applicants apply for a lease on the same hillock at the same time, the applicant must have an average score of 70 points and will be selected on a case-by-case basis.

2.經評選結果,未獲承租資格者,予以退件,已繳保證金無息退還。
2. After the evaluation, those who are not qualified for the lease will be returned and the deposit paid will be refunded without interest.

(六)公告期限屈満並經評選完㻐後,倘有剩餘土地,由服務中心繼續受理申請並依第(五)款程序辦理至租完為止。至第二階段評選原則上於當期「經濟部工業局產業園區土地或建築物租售審查小組」會議前召開評選委員會。倘申請人之申請案件未能於評選委員會召開前遞送,則於下次評選會議評核。
(f) If there is any land remaining after the expiration of the announcement period and the selection process, the Service Center shall continue to accept applications and follow the procedures in paragraph (5) until the lease is completed. In principle, the evaluation committee for the second stage of the evaluation will be convened before the meeting of the "Examination Group for Leasing and Sale of Land or Buildings in Industrial Parks, Bureau of Industry, Ministry of Economic Affairs". If the applicant's application is not submitted before the Evaluation Committee is convened, the application will be evaluated at the next Evaluation Committee meeting.

(七)申請人經審查核准承租後,應依服務中心缴款通知指定期限及金額,向指定行庫缴納擔保金,預繳 2 年租金及 5 % 5 % 5%5 \% 管業稅,並洽經濟部雲林離島式基礎工業區服務中心辦理簽訂租賃契約書手續。
(g) After the applicant has been examined and approved for the lease, the applicant shall pay the guarantee deposit to the designated bank according to the period and amount specified in the service center's payment notice, prepay the rent for 2 years and 5 % 5 % 5%5 \% management tax, and contact the Yunlin Outlying Islands-type Basic Industrial Zones Service Center of the Ministry of Economic Affairs for the signing of the lease contract.

(一)申請人經審查核准承租土地後,有關簽約,繳款,土地點交及使用土地等相關事宜,悉依工業局所訂「雲林離島式基礎工業區新與區東二區土地出租須知」辨理,申請人應書面切結遵守,如有違反者,視同違約處理。
(1) After the applicant has been examined and approved to lease the land, matters related to the signing of the contract, payment of fees, delivery of the land and use of the land shall be handled in accordance with the "Guidelines for Leasing of Land in Yunlin Outlying Islands-type Basic Industrial Area, New and Eastern District No. 2" stipulated by the Industrial Development Bureau, which the applicant shall comply with in writing, and any violation of this guideline shall be treated as a breach of the contract.

(二)申租土地所需各項證照如有需變更或申請者,申請人應於送件前先行備妥,不得請求日後補件。
(b) If there is a need to change or apply for any of the certificates and licenses required for the application of land lease, the applicant should prepare them before submitting the application, and shall not request for replacement at a later date.

(三)雲林離島式基礎工業區新興區東二區之臨時施工便橋原規劃使用年限至 97 年 10 月屈満,屈滿迄今(108 年)已逾10年,此期間該便橋僅供人員及巡邏機車通行,除保全人員目視檢視外,並無額外施行保養維蒦等相關措施,基於安全考量,本施工便橋不提供進駐廠商施工,維護機具及車輛通行使用。
(c) The temporary construction bridge in East Area 2 of Yunlin Outlying Islands Infrastructure Industrial Park was originally planned to be used until October 1997, and it has been more than 10 years since its expiration (108 years). During this period, the bridge was only used for the passage of personnel and patrol motorcycles, and there was no additional maintenance and repair measures except for the visual inspection by security personnel. For safety reasons, this construction bridge is not available for the use of construction and maintenance equipment and vehicles of the resident companies.

(四)為保蒦雲林離島式基礎工業區新興區東二區填地料源不被掏刷,本區土地設置北側及西側之臨時性海堤並由服務中心維護管理,申請人應依產業創新條例第 53 條之規定,繳交其他特定設施之使用費或維護費。
(d) In order to protect the reclaimed land source of the East Area II of Yunlin Outlying Islands Basic Industrial Zone from being dredged, the temporary seawalls on the north and west sides of the land in this area are set up and maintained and managed by the service center, and the applicant shall pay the use fee or maintenance fee of other specific facilities in accordance with the provisions of Article 53 of the Industrial Innovation Ordinance.

(五)雲林離島式基礎工業區新興區其他分區所需圍堤之卵塊石等料源堆置於已填地完成之新興區東二區劃設之卵塊石堆置區(新興段 286-8, 286-9,286-12 地號),其所堆置之卵塊石依重量或粒徑大小分開堆置,經長時間堆置,造成堆置區下方填地可能因壓密沉陷而填地高程較低 (詳附圖 2),考量卵塊石料源之移除需另覚他處堆置及搬運,移除後須再整地,故本卵塊石堆置區依現況保留,本堆置區内之卵塊石不得遥為使用,且本卵塊石堆置區不提供出租。
(e) The pebbles and other material sources for the dike in other sub-districts of Yunlin Island-type Infrastructure Industrial Zone were piled up in the pebble dumping area in the eastern two districts of the new zone (Lot Nos. 286-8, 286-9, and 286-12 of the new zone) where reclamation had been completed, and the pebbles piled up were stacked up separately according to their weights or grain sizes. (六)本區土地現況尚有零星之消波塊,抽砂管等施工料源或設備,前述施工料源或設備屬工業局財產,如相關料源或設備影響申請人之開發使用,申請人得書面向服務中心提出申請移置,經同意後由申請人遥行移置至工業局指定之雲林離島式基礎工業區新興區東二區卵塊石堆置區(新與段286-8,286-9,286-12 地號)堆放並負擔相關費用,不得占為已有,必要時服務中心得派人巡查。
(F) There are still scattered construction materials or equipments such as wave elimination blocks, sand extraction pipes, etc., which belong to the property of the Industrial Development Bureau. 1.申請人應先向台電公司系統規劃處洽詢可併聯之容量,孔位及拱位,台電公司亦將會邀集廠商進行現勘確認。

This Notice is provided in accordance with Article 15 of the Regulations on the Use of Revenues and Disposal of Land, Buildings and Facilities in the Industrial Park.

(本區土地出租之法規依據)  (The legal basis for leasing land in the district)

二,經濟部工業局(以下簡稱工業局)開發之雲林離島式基礎工業區新興區東二區土地(以下簡稱本區土地)之出租,依本須知規定辨理,本須知未規定者,依產業創新條例暨其施行細則,產業園區土地建築物與設施使用收益及處分辨法及其他相關法令規定辦理。
The leasing of the land in the East 2nd District of Yunlin Island-type Basic Industrial Park (hereinafter referred to as the land in this district) developed by the Industrial Development Bureau of the Ministry of Economic Affairs (hereinafter referred to as the Industrial Development Bureau) shall be handled in accordance with the provisions of this Circular, while those not provided for in this Circular shall be handled in accordance with the regulations of the Industrial Innovation Ordinance and its implementation details, the Law on the Distribution of Proceeds from the Use of Land, Buildings and Facilities in Industrial Parks, as well as other relevant laws and regulations.

三,本區土地出租之相關事宣,由經濟部雲林離島式基礎工業區服務中心 (以下簡稱服務中心)辨理,並依規定公告之。
The Service Center of Yunlin Outlying Islands Basic Industrial Zone (hereinafter referred to as the Service Center) of the Ministry of Economic Affairs shall handle all matters related to the lease of land in this zone and make public announcements in accordance with the regulations.

(出租標的)  (Subject of lease)

四,本須知適用範圍為雲林離島式基礎工業區新興區東二區産業用地(一)雲林縣台西鄉新興段 286-10 地號及 286-11 地號等 2 筆土地,詳附圖 1,雲林離島式基礎工業區新興區東二區土地坵塊劃分圖所示。

五,本區土地之出租依工業局規劃開發圖說辦理,並依規劃坵塊按現況(不再施作公共設施)受理申請,申請人於提送申請文件前,應先行赴現場勘查,不得要求工業局辨理分割及增設任何公共設施。
Fifth, the leasing of land in this area is handled in accordance with the Industrial Development Bureau's planning and development plans, and applications are processed in accordance with the planning of the hillocks in their current condition (no more public facilities). 六,本區土地之申請案件依每一坵塊個別受理,即每一坵塊之申請案件皆應檢齊出租公告及本須知第 16 點規定之申租時應提之書件及興辦事業能力計畫書。惟申請承租本區土地不以一坵塊為限。
Fifth, applications for land in the district are processed on a hillock-by-hillock basis. In other words, each application for land on a hillock must be accompanied by a copy of the lease notice, as well as the documents required to apply for a lease and a plan for the establishment of a business, as stipulated in section 16 of these Guidelines. However, applications to lease land in the district are not limited to one hillock.

(出租對象及限制)  (Objects and limitations of rental)

七,本區土地以出租供商號,法人,政府依法設立之事業機構,電業籌備處從事工業園區各種用地用途及使用規範辦法第 3 條電力供應業規定之使用為限,亚應符合本區土地容許引進產業項目之規劃使用(詳附表1)。
The land in this zone shall be leased for use by firms, corporations, government agencies, and the Electricity Preparatory Office for the purpose of engaging in the electric power supply industry as stipulated in Article 3 of the Regulations on the Use of Various Land Uses and Uses in Industrial Parks, and the use of such land shall be in accordance with the land use plan of this zone for the purpose of attracting industrial projects (please refer to Attachment 1 for details).

八,申請人以電業籌備處名義申請者,應符合下列實收資本額及發電設備累
If the applicant applies in the name of the Electricity Preparatory Office, the applicant shall meet the following requirements in respect of paid-in capital and accumulated power generation equipment
積設置容量之規定:  The capacity of the equipment is determined by the regulations:
(一)電業籌備處發起人之一持股比例達 50 % 50 % 50%50 \% 以上,且實收資本額達新台幣 3 億元以上或箁備處之自有資金達新台幣 3 億元以上。
(a) The shareholding ratio of one of the promoters of the Electricity Preparatory Office is at least 50 % 50 % 50%50 \% , and the paid-in capital is at least NT$300 million or the reserve fund of the Electricity Preparatory Office is at least NT$300 million.

(二)電業籌備處發起人中持股比例達 30 % 30 % 30%30 \% 以上者,其現持有之發電設備累積設置容量達 2,000 峰門( kWp )以上。
(b) If the percentage of shareholding of the promoter of the power plant organization reaches 30 % 30 % 30%30 \% , the cumulative installed capacity of the power generation equipment currently held by the promoter reaches 2,000 kWp or more.
九,申請人承租之土地不得設定地上權。  The land leased by the applicant shall not be subject to the creation of land rights.

(完成使用之規定)  (Completion of utilization requirements)

十,申請人於簽訂土地租賃契約時,須先預繳 2 年租金(按簽約時審定月租金 × 12 × 12 xx12\times 12 個月 × 2 × 2 xx2\times 2 年),並得以現金,銀行保證書,銀行可轉讓定期存單設質方式為之。如申請人於簽訂土地租賃契約之日起 2 年内或經「經濟部工業局產業園區土地或建築物租售審查小組」審查會核定之計畫期程内按核定計畫取得電業執照(或再生能源發電設備登記)者,即享有前 2 年免土地租金之優惠;以現金繳納之 2 年租金可抵缴第 3 年,第 4 年租金,或申請無息退還。申請人未依期限按核定計畫取得電業執照(或再生能源發電設備登記),以現金繳納之 2 年租金視同缴納第 1 年,第 2 年之租金,以銀行保證書,銀行可轉讓定期存單設質者,得依約追綮前 2 年之租金,即不得享有前 2 年免租金之優惠,且工業局得终止租賃契約收回土地。
Upon signing the land lease, the applicant shall pay 2 years' rent in advance (based on the monthly rent × 12 × 12 xx12\times 12 months × 2 × 2 xx2\times 2 yearly, as determined at the time of signing the lease) in the form of cash, bank guarantee, and negotiable time deposits from the bank. If the applicant obtains an electric license (or registration of renewable energy power generation equipment) within 2 years from the date of signing the land lease agreement or within the project period approved by the "Industrial Park Land or Building Lease and Sale Examination Group" of the Industrial Park Bureau, Ministry of Economic Affairs, Taiwan, the applicant will be entitled to the first 2 years of the land rent free of charge, and the 2 years of cash rent can be credited to the 3rd and 4th years of the rent or can apply for a non-interest-bearing refund. If the applicant fails to obtain an electric license (or registration of renewable energy power generation equipment) in accordance with the approved plan by the deadline, the 2-year rent paid in cash is deemed to be the first year's rent and the second year's rent, and if the applicant uses a bank guarantee or a bank's negotiable time deposit certificate as a pledge, the applicant will be able to recover the rent of the first 2 years in accordance with the contract, which means that the applicant will not be entitled to the preferential treatment of free rent for the first 2 years, and the Industrial Development Bureau will be able to terminate the lease to take back the land.
十一,申請人所從事之事業如為行政院環境保護署依「開發行為應實施噮境影響評估細目及範圍認定標準」及其相關法規認定應實施環境影響評估之開發行為,或為内政部依「海岸管理法」及其相關法規認定應申請海岸特定區位開發許可者,應於簽訂土地租賃契約之日起1年内依規定自行辨理完成相關程序(含遞件申請審查),倘經駁回,亦須於駁回之日起 1年内另案提送審查完成。
XI. If the applicant is engaged in a business that is recognized by the Environmental Protection Administration of the Executive Yuan as a business that should be subject to environmental impact assessment in accordance with the "Criteria for Determining the Details and Scope of Environmental Impact Assessment to be Implemented for Developments" and its related regulations, or if the applicant is recognized by the Ministry of the Interior as being subject to the application for a permit to develop a specific area along the coastline in accordance with the Coastal Management Law and its related regulations, the applicant shall complete the relevant procedures (including submission of applications for examination and approval) in accordance with the requirements within one year from the date of the signing of the land lease agreement. If the application is rejected, the application shall be submitted for review and completion within 1 year from the date of rejection.
且須於前開各中央主管機關審查通過之日起 2 年内或經「經濟部工業局產業園區土地或建築物租售富查小組」審查會核定之計畫期程内按核定計畫取得電業執照(或再生能源發電設備登記)後即享有前 2 年免土地租金之優惠,以現金缴納之 2 年租金可抵繳第 3 年,第 4 年租金,或申請無息退還。倘申請人未依期限按核定計畫取得電業執照(或再生能源發電設備登記),以現金繳納之 2 年租金視同缴納第 1 年,第 2 年之租金,以銀行保證書,銀行可轉讓定期存單設質者,得依約追缴前 2 年之租金,即不得享有前 2 年免租金之優惠,且工業局得終止租賃契約收回土地。依前開及其他相關法令進行之各項作業所需費用由申請人自行負擔。
If the applicant obtains an electric license (or registration of renewable energy power generation equipment) within 2 years from the date of approval by the central government authorities or within the project period approved by the "Industrial Development Bureau, Ministry of Economic Affairs, R.O.C. Rental and Sale of Land and Buildings in Industrial Parks", the applicant will be entitled to the first 2 years of land rent exemption, and the 2 years' rent in cash can be credited to the 3rd and 4th year's rent, or can be refunded without any interest. If the applicant fails to obtain an electricity license (or registration of renewable energy power generation equipment) within the approved time limit, the two years' rent paid in cash will be treated as the first and second year's rent, and the applicant will be required to pay the rent for the first two years based on a bank guarantee or a bank transferable time certificate of deposit, which means that the applicant will not be entitled to the first two years' free rent and that the Industrial Development Bureau will be entitled to repossess the land upon termination of the lease. The applicant is responsible for the costs of all operations carried out in accordance with the preceding and other relevant laws and regulations.
倘申請人放秦承租或未於規定期限内按核定計畫取得電業執照(或再生能源發電設備登記),且經工業局終止租賃契約收回土地時,申請人應承鄀配合辦理申請撤回或廢止本環境影響評估案。
In the event that the applicant has cancelled the lease or failed to obtain an electricity license (or registration of renewable energy generating equipment) within the specified period of time according to the approved plan, and the land has been repossessed by the Industrial Development Bureau after termination of the lease, the applicant shall undertake to place a placeholder to cooperate with the withdrawal of the application or annulment of this Environmental Impact Assessment case.
十二,申請人經強化使用,惟於期限内仍未能按核定計畫取得電業執照(或再生能源發電設備登記)者,有不可歸責之原由時,得依經濟部工業局訂定之「經濟部工業局產業園區個案開發期程限期改善作業原則」協處。
If the applicant fails to obtain an electric license (or registration of renewable energy power generation equipment) within the time limit according to the approved plan after enhanced use, and there are reasons that cannot be attributed to the applicant, the applicant may be dealt with in accordance with the "Principles for Improvement of Industrial Park Development Procedures in Industrial Parks by the Industrial Development Bureau, Ministry of Economic Affairs," as stipulated by the Industrial Development Bureau of the Ministry of Economic Affairs.

(承租權轉讓之限制)  (Restrictions on Assignment of Tenancy Rights)

十三,申請人不得將承租土地全部或一部轉租,出借或以其他方式供他人使用。
XIII. The applicant shall not sublet, lend or otherwise make available for use by others all or part of the leased land.
十四,申請人不得將興建之建築物及設施全部或一部移轉,出租,出借或以其他方式供他人使用。
The applicant shall not transfer, lease, lend or otherwise make available for use by others all or any part of the buildings and facilities to be constructed.

(出租程序)  (Rental program)

十五,本區土地之出租採二階段辩理。  The District adopts a two-stage defense for the lease of land.
(一)第一階段:資格雷查   (i) Stage 1: Identification of information
申請案件由服務中心收件初審,於文件齊全,資格符合後,再轉送工業局評選及審查。
Applications will be received by the Service Center for initial review, and will be forwarded to the Industrial Development Bureau for selection and review after all documents are complete and eligibility criteria have been met.

(二)第二階段:工業局擇日召開評選委員會,依每一坵塊申請案件之興辨事業能力計畫書綜合考量進行評核。至其相關規範如下所示。
(b) Stage 2: The Industrial Development Bureau will convene a selection committee on a specific day to evaluate each hillock application based on a comprehensive evaluation of the project's ability to identify new business opportunities. The relevant regulations are set forth below.
1.由工業局擇日召開評選委員會,第一階段通過資格審查之申請人就所提與辨事業計畫内容進行簡報說明。申請人参加評選委員會人數至多不超過 5 人,簡報時間不得超過 25 分鐘。
1. The Industrial Development Bureau will convene an evaluation committee on a certain date. Applicants who have passed the qualification examination in the first stage will give a presentation on the contents of their proposed business plan. The number of applicants participating in the selection committee shall not exceed five (5), and the presentation time shall not exceed twenty-five (25) minutes.

2.興辨事業能力評核項目及比重詳本須知附錄一所示。
2. The items and weightings of the diagnostic capacity assessment are set out in Appendix I to this note.

3.申請人平均分數達 70 分者始取得承租資格。惟同一坵塊有 2 以上申請人同時申請承租之案件,除平均分數須達 70 分,並擇優録取。
3. Applicants with an average score of 70 points are eligible to apply for a lease. However, if more than two applicants apply for a lease on the same hillock at the same time, the applicant must have an average score of 70 points and will be selected on the basis of merit.

(三)公告期限屈滿並經評選完竣後,倘有剩稌土地,由服務中心繼續受理申請並依本點第(一)項及第(二)項程序辨理至租完為止。至第二階段評選原則上於當期「經濟部工業局產業園區土地或建築物租售富查小組」會議前召開評選委員會。倘申請人之申請案件未能於評選委員會召開前遞送,則於下次評選會議評核。
(3) After the expiration of the announcement period and the completion of the selection process, if there is any sticky rice land left, the Service Center will continue to accept applications and process them according to the procedures in (1) and (2) of this point until the lease is completed. In principle, the evaluation committee for the second stage of the selection process will be convened before the meeting of the "FUCHA Group for Renting and Selling Land or Buildings in Industrial Parks, Bureau of Industry, Ministry of Economic Affairs". If the applicant's application is not submitted before the Evaluation Committee is convened, the application will be evaluated at the next Evaluation Committee meeting.

(申租時應提之書件)  (Documents to be submitted when applying for the lease)

十六,申請人應依本區土地出租公告指定之時間,地點,每一坵塊之申請案件皆應檢齊下列文件 1 式 2 份向服務中心提出申請:
Applicants should submit two copies of the following documents for each hillock to the Service Center at the time and place specified in the district's land rental notice:

(一)申租土地申請書(表格由服務中心提供,如附表3)。
(i) Application for Land Lease (The form will be provided by the Service Center, e.g. Schedule 3).

(二)申租標的位置圖(如附圖 3)。   (b) A map showing the location of the subject site of the lease application (as shown in Figure 3 attached).
(三)申租土地規劃圖,内容須包括:   (c) A plan of the land to be leased, which shall include:
1.發電設備設置平面與立面布置圖。   1. Layout and elevation of the generating equipment.
2.供本區土地進出之聯外交通配置。   2. Provide for off-site transportation to and from the District's land.
(四)設備來源及性質說明書(表格由服務中心提供,如附表4)。
(iv) A description of the source and nature of the equipment (the form will be provided by the Service Center, e.g., Exhibit 4).

(五)投資計畫書(表格由服務中心提供,如附表5)。
(v) Investment Plan (form provided by the Service Center, e.g., Exhibit 5).

(六)土地承諾書及切結書(表格由服務中心提供,如附表 6 至表 6-2)。
(vi) Land Undertaking and Cut-off Letter (Forms to be provided by the Service Center, e.g., Exhibit 6 to Table 6-2).

(七)工業區土地出租優惠方案切結書(表格由服務中心提供,如附表 7)
(vii) Cut-off Letter for Land Rental Concession Scheme for Industrial Areas (Form to be provided by the Service Center, e.g., Schedule 7)

(八)開發事項檢查表(表格由服務中心提供,如附表 8)。
(viii) Development Project Checklist (form provided by the Service Center, e.g., Exhibit 8).

(九)缴納按申租土地年租金 3 % 3 % 3%3 \% 計算之保證金憑證影本,請向指定行庫:臺灣銀行斗六分行;户名「產業園區開發管理基金-雲棭離島中心 455 䢙戶」,帳號「031036070525」,繳納取據,並黏貼於應備文件之保證金憑證影本黏貼單。(表格由服務中心提供,如附表9)。
(ix) To pay the annual rent of the leased land 3 % 3 % 3%3 \% based on the photocopy of the certificate of security deposit, please pay to the designated bank: The Bank of Taiwan, Douliu Branch; account name "Industrial Park Development and Management Fund - Yunlin Island Center 455 䢙 account", account number "031036070525", and take the receipt, and paste it on the sticky sheet of the certificate of security deposit of the documents to be filed. (十)民間新增投資案件資料表(表格由服務中心提供,如附表10)。 (十一)申請人資格證明文件:
(j) Information form for cases of new private investment (the form will be provided by the service center, e.g., Exhibit 10). (xi) Documents certifying the applicant's qualifications:
1.以法人名義申請者檢附公司設立登記或變更登記表及代表人身分證影本。
(1) Applicants in the name of a legal person must attach a copy of the company's establishment or change registration form and the representative's ID card.

2.以商號名義申請者檢附設立或變更登記證明文件及負責人身分證影本。
(2) The applicant in the name of a firm must attach the establishment or change of registration documents and a copy of the identity card of the person in charge.

3.政府依法設立之事業機構檢附設立證明文件影本。
(3) A copy of the establishment document is attached to the governmental organization established by law.

4.以電業籌備處名義申請者應檢附籌備處成立相關證明及資格證明文件:
4. The applicant in the name of the Electricity Preparatory Office should attach the certificate of the establishment of the Preparatory Office and the qualification documents:

(1)主管機關核准成立發電業箁備處證明文件。   (1) Documents proving that the competent authority has approved the establishment of the Power Generation Reserve Office.
(2)電業籌備處發起人之財力證明:視該發起人為公司或自然人(行號),檢附公司登記實收資本額或銀行出具之存款證明。
(2) Proof of financial strength of the promoter of the Electricity Preparation Office: Depending on whether the promoter is a company or a natural person (line number), the company's registered paid-in capital or a certificate of deposit issued by a bank is attached.

(3)電業籌備處發起人中持股比例達 30 % 30 % 30%30 \% 以上者持有之發電設備累積設置容量達 2,000 峰无 ( kWp ) ( kWp ) (kWp)(\mathrm{kWp}) 以上證明:提供台灣電力股份有限公司或國外再生能源蒀購契約書頁面影本等相關證明文件。
(3) Proof that the cumulative installed capacity of the power generation equipment owned by the promoter of the power plant organization with a shareholding ratio of 30 % 30 % 30%30 \% or more reaches 2,000 peaks or less: Provide a copy of the page of the contract with Taipower or foreign renewable energy sources, or other relevant documents.
前項各款文件應分別依序装訂成册,加蓋法人,商號及代表人印章,影本並應加註「與正本相符,如有不實願負法律責任」字様。文件不齊者,概不受理。
The documents in the preceding paragraph should be bound in separate volumes in order, stamped with the seals of the corporation, firm and representative, and the photocopies should be endorsed with the words "conform to the original, and are willing to bear the legal responsibility if there is any inaccuracy". The application will not be accepted if the documents are not complete.

(十二)興辨事業能力計畫書, 1 式 15 份,内容須包含下列項目(詳附錄一所示):
(xii) A project plan for identifying the capacity of the ministry, in 1 set of 15 copies, which shall include the following items (as shown in Appendix I):
1.發電設備建置計畫。(規格詳附銚二)  1. Power generation equipment construction plan. (Detailed specifications are attached in Choshi 2)
2.管運及管理計畫。   2. Management and administration program.
3.電價競謤回饋。   3. Tariff competition feedback.
4.景觀設計規劃。   4. Landscape design planning.
5.實績經騟。   5. Performance.
6.其他承諾事項。   6. Other commitments.

(缴款期限)  (Contribution period)

十七,服務中心應於接獲工業局䨪查結果通知之日起15日内,依核准承租與否,通知申請承租人限期缴款簽約或無息退還原繳保證金。
The Service Center shall, within 15 days from the date of receipt of the notification of the results of the Industrial Development Bureau's investigation, notify the applicant of the deadline for payment and signing of the contract or refund of the original deposit without interest, depending on whether the lease is approved or not.

(應缴價款)  (price payable)

十八,申請人申租本區土地應繳價款包含土地租金,擔保金,預繳 2 年租金及 5 % 5 % 5%5 \% 㗊業稅(按當期應繳租金之 5 % 5 % 5%5 \% 計算)。
The price to be paid by the applicant for the lease of land in this district includes land rent, security deposit, prepaid rent for 2 years and 5 % 5 % 5%5 \% 㗊trade tax (calculated on the basis of 5 % 5 % 5%5 \% of the rent payable for the current period).

(售價及年租金率之計算與調整)  (Calculation and adjustment of selling price and annual rental rate)

十九,本區土地據以計算租金之售價及年租金率由工業局審定,各期應缴租金以簽約繳款當月之租金標準為基期計算。
The selling price and annual rental rate of the land in this district are determined by the Industrial Development Bureau, and the rent payable for each period is calculated on the basis of the rental rate of the month in which the contract is signed and paid.
前項據以計算租金之售價自第 2 年起逐年於契約簽訂日之相當日,按最近一期行政院主計總處公布之消費者物價指數調整幅度比率調整之。各期應缴租金,按缴款當期調整後之租金重新計算。
The selling price used for the calculation of rent in the preceding paragraph shall be adjusted annually from the second year onwards according to the rate of adjustment of the Consumer Price Index published by the General Accounting Office of the Executive Yuan on the equivalent date of the lease signing. The rent payable for each installment shall be recalculated based on the adjusted rent for the payment period.
二十,適用「擴大投資方案-工業區土地出租優惠方案」申請承租之案件2年内或經「經濟部工業局產業園區土地或建築物租售審查小組」審查會核定之計畫期程內按核定計畫取得電業執照(或再生能源發電設備登記)者,得享有前 2 年免土地租金之優惠。
Within two years of application for lease under the "Program for Expanding Investment - Preferential Program for Leasing of Land in Industrial Parks" or within the project period approved by the "Examination Group for Leasing and Sales of Land or Buildings in Industrial Parks, Industrial Development Bureau, Ministry of Economic Affairs, Taiwan", those who have obtained an electric license (or registration of renewable energy power generation equipment) under the approved plan are entitled to the first two years of exemption of the land rental fee.

(擔保金及預缴 2 年租金)  (Guarantee and prepayment of 2 years' rent)

二十一,擔保金按 6 個月租金同額計算,於租約終止且無違約須扣除擔保金之情形者,全額無息退還。
The security deposit is calculated on the basis of six months' rent and will be refunded in full, without interest, upon termination of the tenancy agreement without any breach of contract requiring deduction of the security deposit.
二十二,申請人於簽訂土地租賃契約時,須先預繳 2 年租金(按簽約時審定月租金 × 12 × 12 xx12\times 12 個月 × 2 × 2 xx2\times 2 年),並得以現金,銀行保證書,銀行可轉讓定期存單設
At the time of signing the land lease, the applicant should pay 2 years' rent in advance (based on the monthly rent × 12 × 12 xx12\times 12 per month × 2 × 2 xx2\times 2 per year as assessed at the time of signing the land lease), and set up a bank transferable certificate of deposit (TCD) with cash, a bank guarantee, and a bank transferable certificate of deposit (BTD).
質方式為之。如申請人於簽訂土地租賃契約之日起2年内按核定計畫取得電業執照(或再生能源發電設備登記)者,即享有前 2 年免土地租金之優惠;以現金繳納之 2 年租金可抵繳第 3 年,第 4 年租金,或申請無息退還。
If the applicant obtains an electricity license (or registration of renewable energy power generation equipment) within two years from the date of signing the land lease contract under the approved program, the applicant will be entitled to the first two years of land rental exemption. If the applicant obtains an electricity license (or registration of renewable energy power generation equipment) within 2 years from the date of signing the land lease contract under the approved plan, the applicant will be entitled to a land rental waiver for the first 2 years, and the 2 years' rent paid in cash can be credited to the 3rd and 4th year's rent or applied for a non-interest-bearing refund.

(租賃期間)  (period of lease)

二十三,申租土地之租期以年為單位,首次承租者,最低不得少於 6 年,最高不得超過20年。
The lease term of the land applied for is based on years, with a minimum of 6 years and a maximum of 20 years for first-time tenants.

申請人欲申請續租者,須於租賃期間無違反租貨契約情事,並於租期屈滿前 1 個月以書面向服務中心提出申請。
Applicants wishing to apply for lease renewal must not be in breach of the lease during the lease period and must apply in writing to the Service Center one month prior to the expiration of the lease.
前項申請續租之租期最低不得少於2年。  The minimum lease term for renewal of the preceding application shall not be less than 2 years.

(價款繳納方式及簽訂租賃契約)  (Payment of price and signing of lease agreement)

二十四,申請承租案件經番查核准後,服務中心應於接獲工業局核准承租通知之日起15日内,通知申請人限期繳款。
XXIV. After the application for tenancy has been approved by double checking, the service center shall notify the applicant of the deadline for payment within 15 days from the date of receipt of the notice of approval of tenancy from the Industrial Development Bureau.

(一)申請人應於接獲繳款通知之次日起 2 個月内繳清預繳 2 年租金(簽約時審定月租金 × 12 × 12 xx12\times 12 個月 × 2 × 2 xx2\times 2 年),擔保金及營業稅後,與服務中心簽訂租賃契約書。逾期未繳款視為放棄,原繳保證金不予退還。
(a) The applicant shall sign the lease contract with the service center after paying the prepaid 2-year rent (monthly rent × 12 × 12 xx12\times 12 months × 2 × 2 xx2\times 2 year is examined at the time of signing the contract), security deposit and business tax within 2 months from the next day after the applicant is notified of the payment. Late payment is regarded as abandonment and the original deposit will not be refunded.

(二)申請人以現金繳納預繳 2 年租金(簽約時審定月租金 × 12 × 12 xx12\times 12 個月 × 2 × 2 xx2\times 2 年)者,則原繳保證金無息抵充應繳預繳 2 年租金。
(b) If the applicant pays the prepaid 2-year rent in cash (monthly rent × 12 × 12 xx12\times 12 months × 2 × 2 xx2\times 2 yearly as assessed at the time of signing the contract), the original deposit shall be credited to the prepaid 2-year rent without interest.

(三)申請人以銀行保證書,銀行可轉讓定期存單設質預繳 2 年租金(簽約時審定月租金 × 12 × 12 xx12\times 12 個月 × 2 × 2 xx2\times 2 年)者,則於簽訂租賃契約書後無息退還原繳保證金價款。
(c) If the applicant pays 2 years' rent in advance in the form of a bank guarantee or a bank transferable time deposit certificate (the monthly rent is × 12 × 12 xx12\times 12 months × 2 × 2 xx2\times 2 years as determined at the time of the signing of the contract), the applicant shall be refunded the original amount of the guarantee deposit without interest after the signing of the lease contract.
二十五,租金之給付以 3 個月為一期,並於首月—次繳清。但申請人有特別請求時,得由服務中心同意後按月分期,按月繳交。
The rent shall be paid in 3-month installments and shall be paid in full in the first month. However, if the applicant has a special request, the Service Center may agree to pay the rent by monthly installments.
二十六,預繳 2 年租金及擔保金得以銀行可轉讓定期存單設質,銀行保證或現金繳納方式為之。惟預繳 2 年租金及擔保金以銀行可轉讓定期存單設質者,設質期間申請人不得向銀行領取利息。
The 2-year prepaid rent and guarantee deposit may be pledged in the form of bank transferable time deposit certificates, bank guarantee or cash payment. However, if the prepaid 2-year rent and guarantee deposits are pledged in the form of bank transferable time certificates of deposit, the applicant is not allowed to receive interest from the bank during the pledging period.

(預繳 2 年租金及擔保金之繳交)  (Prepayment of 2 years' rent and guarantee payment)

二十七,申請人不得延期繳納預繳 2 年租金及擔保金,逾期未繳清價款者,視為放棄承租,其原繳保證金不予退還,解繳經濟部產業園區開發管理基金。
The applicant shall not postpone the payment of the prepaid rent for 2 years and the guarantee deposit. If the applicant fails to pay the full price after the due date, the applicant shall be regarded as giving up the lease, and the original guarantee deposit shall not be refunded, and shall be paid into the fund of the Ministry of Economic Affairs for the development and management of industrial parks.

(違約金)  (Liquidated damages)

二十八,申請人未依指定期限缴付租金時,應依下列規定累計繳付逾期之違約金:
If the applicant fails to pay the rent by the specified deadline, the applicant shall pay the late default fee in accordance with the following provisions:

(一)逾期 1 個月以上未滿 2 個月者,按未繳首月月租金金額部分加收 5 % 5 % 5%5 \%
(a) If the rent is overdue for more than one month but less than two months, an additional charge shall be levied on the unpaid portion of the first month's rent 5 % 5 % 5%5 \% .

(二)逾期 2 個月以上未滿 3 個月者,按未缴首月月租金金額部分加收 10 % 10 % 10%10 \% ,並按未缴次月月租金金額部分加收 5 % 5 % 5%5 \%
(b) For a period of more than 2 months but less than 3 months, an additional charge of 10 % 10 % 10%10 \% shall be levied on the unpaid portion of the first month's rent, and an additional charge of 5 % 5 % 5%5 \% shall be levied on the unpaid portion of the next month's rent.

If the applicant fails to pay the rent for more than 4 months, the Industrial Development Bureau may terminate the tenancy agreement in addition to recovering the rent for the period of use and charging a 15 % 15 % 15%15 \% default fee for each month of unpaid rent.
申請人逾期 4 個月以上不缴清逾期違約金者,其累積達第 1 次未繳首月月租金之數額時,工業局亦得終止租約。
The Industrial Development Bureau may terminate the lease if the applicant fails to pay the overdue default fee for more than 4 months and the accumulated amount reaches the amount of the first month's rent for the first time.

(放采承租及已缴款項之處理)  (Disposal of leased and paid amounts)

二十九,申請人於接獲服務中心缴款通知後至完成租賃契約簽訂前放秦承租或未依規定期限繳款,簽約者,其原繳 3 % 3 % 3%3 \% 保證金不予退還,解繳經濟部產業園區開發管理基金,並取消其承租資格。
If the applicant fails to make the payment or fails to make the payment according to the stipulated period after receiving the payment notice from the service center until the completion of the lease contract, the original payment of the 3 % 3 % 3%3 \% security deposit will not be refunded, the fund of the Ministry of Economic Affairs for the development and management of industrial parks will be released, and the applicant will be disqualified from leasing the property.

(放棄承租或終止租約時租金及擔保金之處理)  (Handling of rent and security deposit in case of abandonment or termination of tenancy)

三十,申請人於完成租賃契約簽訂後至租貨期限屈滿前放鞋承租或經工業局終止租約者,已繳款項依下列規定辨理:
If the applicant releases its shoes or terminates the lease through the Industrial Development Bureau before the expiration of the lease term after the lease agreement is completed, the amount paid will be recognized as follows:

(一)當期租金自放棄承租或終止租約之日起,按當期剩稌月数折算,無息退還。其剩稌月數之計算,未滿1個月者,不予計入。
(a) The current rent shall be refunded without interest on the basis of the number of sticky rice months remaining in the current period from the date of abandonment or termination of the lease. If the sticky rice balance is less than one month, it will not be counted.

(二)已缴擔保金於扣除依相關規定之處理費用後,如有稌款無息退還。
(b) After deducting the expenses incurred in accordance with the relevant regulations, the amount of guaranteed deposits paid, if any, will be refunded without interest.

(保證金無息退還之事由)  (Subject matter of refund of security deposit without interest)

三十一,申請人符合下列情形之一者,所缴保證金無息退還:
The security deposit paid by the applicant shall be refunded without interest if the applicant meets one of the following conditions:

(一)申租案件自收件日起至接獲服務中心繳款通知之前一日止自動申請放具承租者。
(a) The application for release of tenant is automatically applied for from the date of receipt of the application until one day prior to the date of receipt of the payment notice from the service center.

(二)申租案件經評選結果,未獲承租資格者,予以退件,已繳保證金無
(b) If the applicant is not qualified for the lease after the evaluation, the application will be returned and the security deposit paid will not be refunded.
息退還。  The interest rate is returned.
(三)申租案件經雷查應補正而未於期限内補正者。   (c) Failure to make corrections within the time limit when a lease application should be corrected after a thorough investigation.
(四)申租案件經審查未核准承租或因不可歸責於申請人之理由無法建設者。
(d) The applicant has not been approved for the lease after the examination of the application, or the construction is not possible due to reasons that cannot be attributed to the applicant.

(面積結算)  (area settlement)

三十二,申租本區土地實際面積以地政機關土地登記簿所載面積為準。其較原申請時之面積有增減並應按依規定結算互為退補租金。
The actual area of the land to be leased in this district shall be based on the area shown in the land register of the land administration bureau. If there is any increase or decrease in the area of the land as compared with the area of the original application, the land shall be subject to reciprocal refund of rent in accordance with the regulations.

(土地點交)  (Land Points handed over)

三十三,申請人簽訂租賃契約後,由服務中心通知訂期點交土地,並由工業局掣發土地使用同意書。
After signing the lease agreement, the service center will notify the applicant to deliver the land at the scheduled time, and the Industrial Development Bureau will issue a land use consent letter.
申請人無故不到場點交者,視同已點交。  Applicants who do not show up for the enumeration without any reason are deemed to have enumerated.

(終止租賃契約)  (Termination of lease)

三十四,申請人如有下列各款情事之一者,工業局得終止租賃契約,收回土地,已繳交之擔保金概不退還:
The Industrial Development Bureau may terminate the lease and take back the land if the applicant has any of the following circumstances, and the guarantee deposit paid will not be refunded:

(一)違反租賃契約者。   (i) Breach of lease.
(二)擅自轉租,借用或以其他方式供他人使用者。   (ii) Unauthorized subletting, borrowing or otherwise making it available to other users.
(三)租賃物供違反法令之使用者。   (c) Leased goods for users who violate the Act.
(四)自簽訂租賃契約(或環境影響評估審查通過,或海岸特定區位開發許可審查通過)之日起未依期限按核定計畫取得電業執照( 或再生能源發電設備登記)者。
(d) Failure to obtain an electric power license (or registration of renewable energy power generation equipment) in accordance with the approved plan by the deadline from the date of signing the lease agreement (or approval of the environmental impact assessment, or approval of the development permit for a specific coastal area).

(五)未經工業局同意,擅自開挖土石方,違反土石採取法者。
(e) Unauthorized earth and rock excavation without the consent of the Industrial Development Bureau, in violation of the law on earth and rock mining.

(六)申請人從事違反土壤及地下水污染整治法或相關環保法令,致租賃標的物遭污染者。
(f) The applicant has violated the Soil and Groundwater Pollution Remediation Act or related environmental protection laws and regulations, resulting in the contamination of the subject matter of the lease.
三十五,申請人擬於租期屈満前放軍承租,應於 1 個月前以書面通知服務中心,租金應計算至終止契約當月止。
If the applicant wishes to terminate the lease before the expiration of the lease term, the applicant shall notify the Service Center in writing one month in advance, and the rent shall be calculated until the month of termination of the lease.
三十六,申請人於租期未滿 6 年而要求提前終止租約時,已繳交之擔保金概不退還。
If the applicant requests for early termination of the lease before the expiration of 6 years, the guarantee deposit paid will not be refunded.

(終止租貨契約後之回復原狀)  (Reinstatement after termination of lease)

三十七,申請人於租期屈霂前放氣承租或經工業局終止租約或租期居滿不再續租者,應於租約终止或租期屈满之日起 1 個月內將租貨標的物回復原狀返還,逾期未辦理者,每逾1日應支付按日租金3倍計算之違約金予服務中心並負損害賠償責任,必要時工業局得訴請法院強制執行,並由服務中心代為清理拆除,所需費用由申請人負擔,並優先自己缴擔保金項下扣抵。
If the applicant has let down the lease before the expiration of the lease term, or if the Industrial Development Bureau terminates the lease or does not renew the lease upon expiration of the lease term, the applicant shall return the subject of the lease in its original condition within one month from the date of termination of the lease or expiration of the lease term. If the applicant fails to do so, the applicant shall pay to the Service Center for every one day after the expiration of the lease term a liquidated damages of three times of the daily rent, and shall be liable to pay compensation for the damage, and the Industrial Development Bureau may, if necessary, apply to the court for compulsory enforcement and the Service Center shall clean up and remove the subject of the lease on behalf of the applicant. If necessary, the Industrial Development Bureau may appeal to the court for enforcement, and the Service Center will clean up and dismantle the building on behalf of the applicant, with the costs to be borne by the applicant and to be deducted from the guarantee paid by the applicant.

(用地需知)  (Site Requirements)

三十八,本區土地用水量不足部分,申請人應説明替代方案,承諾自覚水源及自行規劃設置安全用水儲存設備。
In the event of a shortfall in the District's land-based water use, the applicant shall help to identify alternatives and commit to a self-extinguishing water source and self-planning for the installation of safe water storage.
三十九,本區土地使用倘有空氣污染物,實際排放量需經最佳可行技術(BAT)檢討後確定。應處理至符合空氣污染物排放標準,並依環保法規及環境影響評估要求處理。
The actual emissions of air pollutants from land uses in the District shall be determined by a Best Available Technology (BAT) review. They should be treated to meet the air pollutant emission standards and be handled in accordance with environmental regulations and the requirements of the Environmental Impact Assessment (EIA).
四十,申請人應自行依相關規定申請供電或自行設置發電或汽電共生設備。
The applicant shall apply for electricity supply or set up power generation or steam-electricity co-generation facilities on its own in accordance with the relevant regulations.

四十一,申請人承租本區土地從事再生能源發電設備所產生之廢(污)水,由申請人自行依環保法規及環境影響評估要求處理。
The waste (sewage) water generated from renewable energy power generation equipment on the land leased by the applicant shall be treated by the applicant in accordance with environmental regulations and the requirements of the Environmental Impact Assessment (EIA).
四十二,本區土地使用所產生之廢葉物應依廢萐物清理法及相關環保法規與環境影響評估要求辨理。
Leaf litter generated from land use in this district shall be handled in accordance with the Waste Disposal Law, relevant environmental protection laws and regulations, and the requirements of the Environmental Impact Assessment (EIA).
四十三,申請人在取得土地使用同意書前,不得擅自使用土地構築工事及其他違反承租目的之行為,倘因而發生損害時,應負賠償責任。
The applicant shall not use the land without authorization to construct structures and other acts that violate the purpose of the lease before obtaining the land use consent, and shall be liable for any damages incurred as a result of the use of the land.
四十四,申請人所需之用水,用電,電信及廢(污)水等設施應自行向各該事業主管機關申請。並由服務中心提供必要之協助。
The applicant shall apply for water, electricity, telecommunication and waste (sewage) water facilities from the competent authority of the respective business. The service center will provide the necessary assistance.
四十五,為保護雲林離島式基礎工業區新興區新興區東二區填地料源不被掏刷,本區土地設置北側及西側之臨時性海堤並由服務中心維護管理,申請人應依產業創新條例第53條規定繳交其他特定設施之使用費或維護費。預估雲林離島式基礎工業區新與區新與區東二區其他特定設施之使用費或維護費費率約為每月每平方公尺 0.616 元;惟此部分仍應依後續經濟部雲林離島式基礎工業區服務中心依產業㓱新條例第53條第2項陳報經濟部核定後為準。
In order to protect the material source of the reclaimed land in the East 2nd District of Yunlin Outlying Islands Basic Industrial Park, the temporary seawalls on the north and west sides of the land in this district are maintained and managed by the service center, and the applicant should pay the usage fee or maintenance fee of other specific facilities in accordance with Article 53 of the Industrial Innovation Ordinance. It is estimated that the usage fee or maintenance fee for other specific facilities in the new Yunlin Outlying Islands Basic Industrial Zone, the new district, and the eastern two districts of the district will be approximately NT$0.616 per square meter per month; however, this portion shall be subject to the approval of the Service Center of Yunlin Outlying Islands Basic Industrial Zone of the Ministry of Economic Affairs, in accordance with Article 53, Paragraph 2 of the Industrial Innovation Ordinance.

四十六,申請人所從事之事業如為行政院環境保護署依土壤及地下水污染整治
If the applicant is engaged in the business of remediation of soil and groundwater contamination by the Environmental Protection Administration of the Executive Yuan, the applicant may apply for a license to remediate the soil and groundwater contamination.
法公告指定之事業,應於設立,停業,歇業或移博土地時,依土壤及地下水污染整治法第 8 佟及第 9 條規定自行辨理土壤污染檢測作業,所需費用由申請人自行負擔。
When setting up, closing down, discontinuing business, or transferring land, the designated business shall identify the soil contamination testing operation in accordance with Article 8 Tong and Article 9 of the Soil and Groundwater Pollution Remediation Act, and the cost shall be borne by the applicant itself.
前項污染檢測資料應同時檢送服務中心 1 份。  One copy of the previous contamination test data should be sent to the service center at the same time.
申請人於终止租貨契約交還土地時,應比照第 2 項規定,提供土壤污染檢測資料予服務中心。
Upon surrender of the land upon termination of the lease, the applicant should provide the soil contamination test information to the service center in accordance with the requirements in item 2.
四十七,雲林離島式基礎工業區新興區東二區之臨時施工便橋原規劃使用年限至97年10月屈満,屈満迄今(108年)已逾10年,此期間該便橋僅供人員及巡邏機車通行,除保全人員目視檢視外,並無額外施行保養維護等相關措施,基於安全考量,本施工便橋不提供進駐廠商施工,維護機具及車轌通行使用。
The temporary construction bridge in the East 2nd District of Yunlin Outlying Islands Basic Industrial Park was originally planned to be used until October 1997, and has been used for more than 10 years since then. During this period, the bridge was only used for personnel and patrol motorcycles to pass through, and there was no additional maintenance and repair measures except for visual inspection by the security personnel. For safety reasons, this construction bridge is not available for the use of construction and maintenance equipment and vehicles of the stationed vendors.
四十八,雲林離島式基礎工業區新興區其他分區所需園堤之卵塊石等料源堆置於已填地完成之新興區東二區劃設之卵塊石堆置區(新與段 286-8,286-9, 286-12 地號),其所堆置之卵塊石依重量或粒径大小分開堆置,經長時間堆置,造成堆置區下方填地可能因壓密沉陷而填地高程較低(詳附圖 2),考量卵塊石料源之移除需另覓他處堆置及搬運,移除後須再整地,是本卵塊石堆置區依現況保留,本堆置區內之卵塊石不得遥為使用,且本卵塊石堆置區不提供出租。
The pebbles for the park embankment in other sub-districts of Yunlin Outlying Islands Basic Industrial Zone were deposited in the pebble dumping area (Lot 286-8, 286-9, and 286-12 of Xinhe Section) in the East 2nd District of the Newly Developed Area where the land reclamation had been completed, and the pebbles were deposited separately according to their weights or particle sizes. The pebbles are stacked separately according to their weight or particle size. After a long time of stacking, the fill level below the stacking area may be lower due to compacting and subsidence (Attachment 2). Considering that the removal of pebble material source needs to find another place for stacking and transportation, and the land has to be reorganized again after removal, this pebble stockpile is retained according to the current situation, and the pebbles in the stockpile are not allowed to be used remotely and this pebble stockpile does not provide rentals.

四十九,本區土地現況尚有零星之消波塊,抽砂管等施工料源或設備,前述施工料源或設備屬工業局財產,如相關料源或設備影響申請人之開發使用,申請人得書面向服務中心提出申請移置,經同意後由申請人遥行移置至工業局指定之雲林離島式基礎工業區新興區東二區卵塊石堆置區(新興段 286-8,286-9,286-12 地號)堆放並負擔相關費用,不得占為已有,必要時服務中心得派人巡查。
There are still some construction materials or equipments such as wave elimination blocks, sand extraction pipes, etc., which belong to the Industrial Development Bureau (IDB). If such materials or equipments affect the applicant's development and use, the applicant may apply in writing to the Service Center for relocation, and after approval, the applicant may remotely relocate the materials or equipments to the pebble mounding area of the East 2nd District of the Newly Developed Outlying Islands Basic Industrial Zone in Yunlin, which has been designated by the Industrial Development Bureau (Section 286-8, 286-9, and 286-12), and shall not occupy them. 286-8, 286-9, 286-12) designated by the Industrial Development Bureau and bear the related expenses, and shall not take over the pebbles, and the Service Center may send inspectors to inspect the pebbles if necessary.

一,雲林離島式基礎工業區新典區束二區土地出租公告,出租須知及其相關法令規定,本公司(商號,機構,等借處)均已詳細闗読碓實了解,並同意遵守各項有關規定,日後如有糾纷,本公司(商號,機構,等備處)同意按申請承租當時之法令規定為仲裁之依據。
In case of any dispute in the future, the Company (firm, organization, and other lenders) agrees to arbitrate according to the laws and regulations at the time of the application for lease.
二,本公司(商號,機構,箒備虞)同意依經濟部工業局规劃闌發圆院辨理,並按現況( 不施作公共設施)申請,本公司( 商躆,機構,筹備處)不得要求經濟部工業局增設任何公共設施。

九,本公司(商號,機構,籌備處)使用承租土地所產生之污染,保證依下列規定辦理:

(一)廢水:自行依環保法規及環境影響評估要求處理。
(a) Wastewater: Disposed of on its own in accordance with environmental protection laws and regulations and environmental impact assessment requirements.

(二)廢氣:處理至符合空氣污染物排放標準,並自行依環保法規及環境影響評估要求處理。
(b) Waste gas: treat the waste gas until it meets the air pollutant emission standards, and treat it on its own in accordance with the environmental protection regulations and the requirements of the Environmental Impact Assessment (EIA).

(三)噪音:處理至符合噪音管制標準。   (c) Noise: treat the noise to meet the noise control standards.
(四)廢棄物:依照廢棄物清理法及相關環保法規處理。

In addition, the Company (firm, organization, and preparatory office) undertakes to pay 2 years' rent in advance (based on the monthly rent × 12 × 12 xx12\times 12 per month × 2 × 2 xx2\times 2 per year as determined at the time of the signing of the land lease) if the Company (firm, organization, and preparatory office) has not paid the rent within 2 years from the date of signing of the land lease (or the examination and approval of the environmental impact statement or assessment, or the examination and approval of the Coastal Specific Area Development Permit), or within 2 years from the date of the examination and approval of the "Review of Lease and Sale of Land or Buildings in Industrial Parks" by the Bureau of Industry of the Ministry of Economic Affairs, or within 2 years from the date of the examination and approval of the Environmental Protection Law. Within 2 years from the date of approval of the land or building lease and sale review panel of the Industrial Development Bureau of the Ministry of Economic Affairs, or after obtaining an electricity license (or registration of renewable energy power generation equipment) within the approved project period, the Company will enjoy the first 2 years of land rent exemption; the 2 years of rent paid in cash can be credited to the third and fourth years of rent, or applied for a non-interest-bearing refund; if the Company fails to obtain an electricity license (or registration of renewable energy power generation equipment) within the period of time as per the approved project, the 2 years of rent paid in cash can be credited to the third and fourth years of rent, or applied for a non-interest-bearing refund. If the license (or registration of renewable energy power generation equipment) is not obtained according to the approved plan within the term, the two years' rent paid in cash will be treated as the first year's rent and the second year's rent, and if the rent is secured by a bank guarantee or a bank transferable certificate of deposit, the rent for the first two years will be recovered in accordance with the agreement, i.e., the concessionary rent for the first two years will not be enjoyed, and the Industrial Development Bureau may terminate the lease to repossess the land. 十三,本公司(商號,機構,等備處)如未履行上開各項條款或違反法令相關規定或放棄承租資格時,除上條款另有規定外,同意經濟部工業局將土地依法收回,如有地上物,本公司(商號,機構,籌備處)同意無䒩件自行拆除清理回復原狀,逾期視為放菄,任由經濟部工業局沒收全權虗理,絶無異議,特具承諾書為昰。

本公司(商號,機構,等備處)向經濟部申請承租雲林離島式基礎工業區新興區東二區適用工業區土地出租優惠方案之土地,同意並知悉承租前述優惠方案之土地應依經濟部「工業區土地出租優惠方案」之各項規定辨理,特切結如下:
The Company (firm, organization, etc.) applies to the Ministry of Economic Affairs (MOEA) for the lease of land under the preferential program for leasing land in the Eastern 2nd District of the Newly Developed Outlying Islands-type Basic Industrial Park in Yunlin, and agrees to and understands that the lease of the land under the aforementioned preferential program should be handled in accordance with the regulations of the Ministry of Economic Affairs' "Preferential Program for Leasing of Land in Industrial Zones", and hereby makes the following conclusions:
1.本公司(商號,機構,籌備處)申請承租工業區土地出租優惠方案之土地應於接獲缴款通知之次日起 2 個月內缴納 6 個月租金同額之擔保金及預缴 2 年租金,該等款項需為現金,同額之經濟部工業局可接受之銀行保證書或辨妥質權設定予經濟部工業局並經簽發銀行承諾抛革行使抵銷權之銀行可轉讓定存單。
(1) The Company (firm, organization, or preparatory office) applying for a lease of land under the preferential land lease program in industrial zones shall, within 2 months from the date of receipt of the notice of payment, pay a security deposit of the same amount as 6 months' rent and 2 years' rent in advance, which shall be in cash, and the same amount shall be supported by a bank guarantee acceptable to the Industrial Development Bureau (IDB) of the Ministry of Economic Affairs (MOEA), or a bank which has identified the bank that has set up a right of pledge to the Industrial Development Bureau of the Ministry of Economic Affairs (IDB), and which has executed an undertaking by the bank to exercise the right of setoff. 2.本公司(商號,機構,籌備處)知悉並同意如於簽訂租賃契約(或環境影響說明書或評估書審查通過,或海岸特定區位開發許可霜查通過)之日起 2 年内或經「經濟部工業局產業園區土地或建築物租售雷查小組」審查會核定之計畫期程內按核定計畫取得電業執照(或再生能源發電設備登記)者,可得享有第1年及第2年免租金之優惠。
(2) The Company (firm, organization, and preparatory office) understands and agrees that if it obtains an electric license (or registration of renewable energy power generation equipment) within 2 years from the date of signing the lease agreement (or from the date of passing the environmental impact statement or assessment, or from the date of passing the Coastal Specific Area Development Permit), or from the date of obtaining an electric license (or registration of renewable energy power generation equipment) within the approved plan period as approved by the "Rental and Sales Leasing and Leasing Team of the Industrial Park of Bureau of the Ministry of Economic Affairs". The first and second year's rent will be waived for those who have obtained an electricity license (or registration of renewable energy power generation equipment) within the approved program period.
3.本公司(商號,機構,籌備處)知悉並同意本公司(商號,機構,籌備處)如享有第1年及第2年免租金之優惠,得以書面通知經濟部工業局抵缴第3年,第4年租金,或請求無息退還預繳之 2 年租金。
(3) The Company (firm, organization, preparatory office) understands and agrees that if the Company (firm, organization, preparatory office) is entitled to the 1st and 2nd year rent free, it may notify the Industrial Development Bureau, Ministry of Economic Affairs in writing to pay the 3rd and 4th year rent, or request a refund of the prepaid 2 years' rent without interest.
4.本公司(商號,機構,籌備處)知悉並同意本公司(商號,機構,籌備處)如未享有第1年及第2年免租金之優惠,則本公司(商號,機構,籌備處)預繳之 2 年租金,以現金缴納者,不予退還;以銀行可轉讓定期存單設質或銀行保證書繳納者,經濟部得追繳其租金。
4. The Company (firm, organization, or preparatory office) understands and agrees that if the Company (firm, organization, or preparatory office) does not enjoy the first and second year's rent-free privilege, the Company (firm, organization, or preparatory office) will not be refunded for the two years' pre-paid rent if paid in cash, and the Ministry of Economic Affairs will be able to recover the rent if the rent is in the form of a negotiable time certificate of deposit or a guarantee from a bank.
5.本公司(商號,機構,籌備處)知悉並同意不得將承租土地全部或一部轉租,出借或以其他方式供他人使用,且不得將興建之建築物及設施全部或一部移轉,出租,出借或以其他方式供他人使用。
5. 7.本公司(商號,機構,籌備處)知悉並同意租期屈満前終止租約或經經濟部終止租約或租期屋滿不再續約者,應於租約终止或租期屈满之日起1個月內回復土地原狀返還租賃標的物。
7. The Company (firm, organization, or organization) understands and agrees that if the lease is terminated before the expiration of the lease term, or if the lease is terminated by the Ministry of Economic Affairs, or if the lease is not renewed upon expiration of the lease term, the Company (firm, organization, or organization) shall restore the land to its original condition and return the subject of the lease to the owner of the leased property within one month from the date of the termination of the lease or the expiration of the lease term.

8. The Company (firm, organization, preparatory office) acknowledges and agrees that if the Company (firm, organization, preparatory office) applies in writing for an authorization to appoint the Economic and Industrial Affairs Bureau to act on behalf of the Company (firm, organization, preparatory office) for the sale of all the premises owned by the Company (firm, organization, preparatory office) one month prior to the date of the termination of the tenancy or expiry of the tenancy term, it shall at the same time undertake in writing that
諾配合辦理後續地上物之產權移轉登記手續,應經經濟部工業局同意後,方得暫不回復土地原狀直至經濟部工業局書面通知回復原狀時止。逾期未辦理回復原狀者,每逾1日本公司(商號,機構,籌備處)應支付按原租約日租金 3倍計算之違約金予經濟部。
In order to cooperate with the registration procedures for the transfer of the property rights of the land, the Company shall obtain the consent of the Industrial Development Bureau of the Ministry of Economic Affairs (MOEA) to temporarily suspend the reinstatement of the original status of the land until such time as the Industrial Development Bureau of MOEA notifies in writing of the reinstatement of the original status of the land. If the reinstatement procedure is not completed after the expiration of one year, the company (firm, organization, or preparatory office) shall pay to the Ministry of Economic Affairs a penalty of three times the daily rent of the original lease agreement for every day that the reinstatement procedure is not completed.
9.本公司(商號,機構,籌備處)知悉並同意經經濟部工業局同意暫不回復原狀者,其期間仍應比照原租約之租金支付賠償金予經濟部。本公司(商號,機構,籌備處)並不得以租期居滿仍繼續使用土地或己繳付賠償金等任何理由,依民法第 451 條主張雙方租賃關係繼續存在。
(9) The Company (firm, organization, and preparatory office) understands and agrees that if the Industrial Development Bureau of the Ministry of Economic Affairs (MOEA) agrees not to restore the original status quo ante for a temporary period of time, the Company (firm, organization, and preparatory office) shall pay compensation to the Ministry of Economic Affairs during the period of time in accordance with the rent of the original lease agreement. The Company (firm, organization, and preparatory office) shall not claim that the lease relationship between the two parties continues to exist in accordance with Article 451 of the Civil Code on the grounds that the Company (firm, organization, and preparatory office) continues to use the land after the expiration of the lease term or that it has paid the compensation.
