Whaleco Technology Limited (“WTL”), which operates the Temu e-commerce platform in the European Union (the “Platform” or Temu”), welcomes the opportunity to submit its responses to the European Commission’s (“Commission”) simple Request for Information (“RFI”) pursuant to Article 67(2) and Article 34(3) of Regulation (EU) 2022/2065 regarding Temu’s compliance with Articles 27(1), (2) and (3), 34, 35(1), 38 and 40(12) of Regulation (EU) 2022/2065 (“DSA”), dated 11 October 2024.

WTL is committed to meeting its obligations under the DSA, as well as other applicable EU laws, and embraces compliance as an opportunity to demonstrate to its customers the desire to protect their rights and interests. Set forth below are WTL’s confidential written responses to each question in Annex I. WTL has provided any relevant accompanying material by means of a separate annex (the “Annex”) for the Commissions ease of review.1Within the Annex, WTL has included an index setting out the responsive documentation requested (the “Index”). 3. WTL understands from the RFI that the Commission considers that it cannot yet ascertain WTL’s compliance with certain articles of the DSA in relation to Temu. WTL takes this concern very seriously. WTL has invested vast resources in implementing and enforcing its policies and developing and implementing appropriate features to ensure that Temu remains a safe and useful e-commerce platform for its users. WTL takes its responsibility to provide a safe e-commerce platform for its users very seriously.

The DSA required that WTL, as the provider of Temu, must “diligently identify, analyse and assess any systemic risks in the Union stemming from the design or functioning of their service and its related systems” . The risk assessment should be “specific to their services and proportionate to the systemic risks” .

8. WTL provided its Year 1 Systemic Risk Assessment Report (“Y1RAR”) to the Commission pursuant to Article 42(4)(a) DSA on 30 September 2024. WTL dedicated over four months preparing this Y1RAR, through which WTL invested a significant amount of time and resource. In light of theY1RAR, reasonable, proportionate and effective mitigation measures have been adopted and further measures may be adopted in the future pursuant to Article 35 DSA.

13. WTL is committed to achieving the transparency objectives that underpin Article 27 DSA, by providing meaningful information about its recommender systems, with the goal of educating recipients about how it impacts their experience on the Platform and why they receive particular content.

At the outset, WTL wishes to stress that the underlying logic that it employs on its Platform to suggest and prioritise content to recipients reflects a common set of parameters (hereinafter, “factors”). However, because recipients engage with the Platform in a variety of different contexts, including searching for products, both generally and more specifically, accessing reviews, or engaging with promotions, this necessarily affects the particular content that is recommended to them.

In all cases, WTL’s broad objective is to present recipients with content that will be of most relevance and interest to them.

If WTL adopts the Commission’s preferred approach, and focus upon the scenarios in which content is recommended to recipients on the Platform, then based on the nature of the content recommended, WTL arguably operates three separate recommender systems as follows:

(1) A product-related recommendation system: comprised of recommendations relating to how products listed on Temu are presented to recipients through the product feed and its sub-sections, as well as via search results. This corresponds to scenarios (a)-(e), and the following elements of scenario (g): “Lightning Dealsand price reductions,4listed above;

18. WTL respectfully submits that this is a more intuitive approach for classifying the recommender systems used on the Platform, as it is more aligned with how the Temu Platform’s computer algorithms operate and the factors they rely upon to present content in the recommendation scenarios.

19. Article 27(1) DSA requires providers of online platforms to set out “the main parameters used in their recommender systems” (emphasis added). In a similar vein, Recital 70 clarifies that “[…] online platforms should consistently ensure that recipients of their service are appropriately informed about how recommender systems impact the way information is displayed, and can influence how information is presented to them. They should clearly present the parameters for such recommender systems in an easily comprehensible manner to ensure that the recipients of the service understand how information is prioritised for them.” (emphasis added)

20. The DSA thus does not mandate precisely how platform providers should present such factors, and there is nothing in Article 27(1) DSA to suggest that providers are obliged to disclose the main factors for each recommender system separately. The objective, as Recital 70 explains, should only be “to ensure that the recipients of the service understand how information is prioritised for them” (emphasis added). In light of this, where the recommender systems on a platform are all informed by the same underlying logic and apply the same primary factors, a provider arguably should be able to comply with Article 27(1) DSA by describing those common factors once, clearly and comprehensively, rather than multiple times.

21. Since 17 February 2024, WTL has presented to recipients the “main” or primary factors that underpin all of its recommender systems (accepting, for the sake of argument, that they are distinct recommender systems), on Temu’sDSA Help Page, under the section “HOW TEMU RECOMMENDS CONTENT?5

5 Since it became subject to the DSA, WTL made three changes to enhance the quality of the disclosures relating to the recommender system on its DSA Help Page. In April 2024, WTL divided the existing bullet list of main factors into two lists (as shown above), in order to better clarify to recipients which factors were “the most important ones” . In June 2024, WTL deleted the reference to the term “gender” from the information illustrated within the “Your account profile” factor, because it confirmed that such input was not used for recommendations. In September 2024, in connection with WTL’s periodic review of its systems and related disclosures, WTL relegated the “ratings given to a product” factor from the first to second set of bullets, after determining that its influence in determining content was less impactful. 25. In the DSA Help Page, WTL generally explains to recipients the relative importance of the main factors used to recommend content in relation to its recommendation systems. For (1) product-related recommendations, and (2) promotion-related recommendations, the two factors listed in the first set of bullet points in the section “HOW TEMU RECOMMENDS CONTENT?”, i.e., (1) browsing, searching and purchasing history; and (2) time spent viewing products, are the most influential factors in deciding content. The reason for this is that these factors generate recommendations that are most likely to align with the recipient’s expectations and preferences, in WTL’s experience.

27. For (3) review-related recommendations, a more restricted set of factors apply, as noted above, due to the different nature of the content and the role that reviews perform on the Platform. The three factors listed above for reviews allow the Platform to present reviews that are helpful for the recipient, for instance, by displaying reviews that have been published on the same country site which the recipient is browsing. Recipients can, in any case, adjust how reviews are displayed by using an on-screen sorting function, allowing them to view reviews with ratings from highest to lowest or vice versa, the most recent reviews of a product, and so on.

Finally, WTL would wish to make clear that it remains very open to adapting its DSA Help Page and providing additional information about its recommender systems and their inputs, if the Commission recommends that it take such action. For instance, WTL would be willing on its DSA Help Page to differentiate between the three broad categories of recommender systems mentioned above and explain more granularly how each of the main factors mentioned above applies with respect to each system. Although this may give rise to some duplication, given the common factors at play, WTL would be willing to adopt this approach if it was felt that it would better meet the transparency aims of Article 27 DSA.

39. In addition to the dedicated personnel mentioned above, Temu’s Trust and Safety Team is composed of over 300 full-time staff members (FTSs) and more than 600 external third-party providers. 44. WTL respectfully would like to clarify that at present only China-based traders and EU-based traders can list and sell products in the EU market. Traders based in any other country, for example traders based in the US and UK, cannot list and sell products in the EU market. In addition, WTL only started to offer services to EU-based traders in mid July 2024. At the moment the only EU-based traders on Temu are based in France, Germany, Italy, the Netherlands and Spain.

49. WTL uses both algorithm-based machine screening and manual reviews to verify the reliability and completeness of documents and information provided by traders during the trader onboarding process. The algorithm-based machine screening checks whether the information provided by traders matches the information on trader’s personal identification documents and company’s business registration license. In addition, WTL ensures that all applications for registration submitted by traders are manually reviewed. The reviewers cross-check certain information provided by traders against third-party databases or through services provided by third-party agencies and systems (mentioned under the “Third-party databases and services provided by third-party agencies” subheading above) to verify the information’s reliability and completeness.

50. After traders are registered with the platform, WTL applies algorithmic screening to regularly monitor the validity status of the documents and information provided during the trader registration. If this algorithmic screening detects any incomplete, inaccurate or out of date information, such as expiration of business registration licenses or ID documents, change of legal representative, among other examples, the case will be sent to the manual review stage for further review and verification. If the reviewer considers that any information is incomplete, inaccurate or out of date, the trader will receive a notice from WTL to update any relevant information within a certain period of time. If a trader fails to update or provide relevant information within the requested period, WTL will suspend the traders account and immediately remove all existing product listings under the trader’s account in the EU. In addition, new products cannot be listed under a suspended account in the EU.
